Senator John C. Calhoun to Anna Calhoum Clemson, March 7, 1848

Washington 7th March 1848

MY DEAR DAUGHTER, The letter from home enclosed with this, and mine to Mr Clemson will give you all the Pendleton and political news, so that you must regard this but a brief answer to your's by the Britania. I am happy to hear that you all, except yourself, escaped the Influenza, and that you have recovered from its effects.

You must not suppose, that in contending against corruption and interest, that I am impelled by the hope of success. Had that been the case, I would long since have retired from the conflict. Far higher motives impel me; a sense of duty; to do our best for our country, and leave the rest to Providence. I hold the duties of life to be greater than life itself, and that in performing them manfully, even against hope, our labour is not lost, but will be productive of good in after times. Indeed, I regard this life very much as a struggle against evil, and that to him, who acts on proper principle, the reward is in the struggle, more than in victory itself, although that greatly enhances it. So strong is my faith in this belief, my dear Daughter, that no appreciation of my efforts, either by the present, or after times, is necessary to sustain me in struggling to do my duty in resisting wrong, especially where our country is concerned, although I put a high value on renown. You will thus see, that in struggling against the downward tendency of our country, it is not because I do not take a just view of human nature, as you suppose, but because I am actuated by higher motives, than what you attribute to me. But enough of this.

I am not surprised, that the powers of Europe so much dread changes. They are right; because what are called reform, will lead to anarchy, revolution and finally to a worse state of things than now exists, through the most erroneous opinions now entertained both in Europe and this country by the movement, or popular party, as to in wh[at] liberty consists, and by what means, it can be obtained and secured. Their opinion of liberty is, neither more nor less, than Dorrism. . . .

MY DEAR SIR, Your letter indicates much and mature reflection on the character and tendency of the present great crisis of the civilized world. It is clear, that the old monarchies on the continent of Europe are about coming to an end. The intelligence and progress of the age have out grown them; but it is by no means certain, that they are so advanced and enlightened on political science, as to substitute more suitable ones in their place. I fear they are not. It seems to me, that what is called the progress party, both in this country and in Europe, have not advanced in political knowledge beyond Dorrism; that is, the right of a mere majority to overturn law and constitution at its will and pleasure. They must be cured of this radical and most dangerous of all errors, before they can substitute in the place of those that may be overthrown, better Governments. Nothing but woful [sic] experience can apply a remedy; except perhaps in Germany, where the advantage of an existing system of confederation of states, and the dread of France from the experience of the first revolution, may lead to establish a federal system some what like ours. I have far more hope of her, than of France, or any other of the continental Countries. Indeed, I look to her to save Europe, including France herself.

What I propose to publish on the subject of Government is not yet prepared for the press. I had hoped to have had it prepared last fall; but was so interrupted, as to fall far short of my calculation. I am, and fear will continue to be, too much occupied here during the session to do anything towards its completion, but will resume it, as soon as I return home. I do not think anything will be loast by the delay. I do not think the publick mind is yet fully prepared for the work, nor will be, until there has been such failure and embarassment in the French experiment (which will be made under highly favourable circumstances) as will bring into distrust and doubt, Dorrism, so as to prepare the publick mind to have its errors and consequences pointed out, and to reflect seriously on the question: What are the elements, which are indispensible to constitute a constitutional popular Government?

I am obliged to you for the suggestions you have made, both in reference to the topicks to be discussed, and the precautions to be adopted in securing the copy right. My plan is to divide it into two parts; an elementary treatise on political science, to be followed by a treatise on the Constitution of the United States, not in the shape of commentaries, but a philosophical discussion on its character and constitution in illustration of the elementary Treatise. To avoid details, as much as possible. I propose to annex the various Speeches,

Reports and letters, in which I have discussed Constitutional questions, and to refer to them in illustration of my opinion of the various parts of the Constitution, to which they relate. I hope I may have so far completed my labours, before I leave home next fall, as to enable me to submit the work to your perusal.

I wait the meeting of the Convention in France and the German Diet with deep interest. They will afford much light by which to judge the future.

I see no reason to doubt, but we shall [have] peace with Mexico. The administration intended to conquer and annex the country, but were defeated by my speech on my resolutions which so effectually turned the tide of publick sentiment as to compelled them to take Trist's treaty.1

Senator John C. Calhoun to Andrew Pickens Calhoun, April 16, 1848

Washington 16th April 1848

MY DEAR ANDREW, Everything here is in a state of uncertainty, in reference to the Presidential election. The parties are more distracted than ever. Clay's address1 has done him great injury with his party. It has in particular deeply offended the Southern portion.

In the mean time, the address of the Barnburners, just come out, has weakened and distracted the Democratick party. They take strong ground against us on the Wilmot proviso, and proclaim that they must be received by the Baltimore Convention to the exclusion of the Hunker delegates from the State. That I take it will be impossible, and a permanent split, with the loss of the State will be the result. I trust, out of all this confusion, a sufficient number of both parties will be found to be independent enough to make a rally to save ourselves and our institutions. As bad, as you suppose things to be here, it is not worse than the reality.

We are waiting with impatience for farther information from Europe. I have little hope from France, but a good deal of reliance on Germany. She has the materials for a good Govt, if they should be skillfully used. But we shall soon see.

MY DEAR DAUGHTER, The Sarah Sands brought me a letter from Mr Clemson and one from you to Cornelia, but none was received by the Acadia from either of you.

I was happy to hear of the continued good health of yourself and Mr Clemson and the children, and how much they grow and improve.

We all, on this side of the Atlantick, look with intense solicitude on the great events, transpiring in Europe, and no one more so than myself. As frequent as the arrivals of Stemers now are, and as short as is the interval between their arrivals, there is no abatement of the anxiety with which each succeeding one is looked for. If there be the interval of but a few days, as much and more exciting news is expected, than formally there was after one of a month. I look, perhaps, with greater solicitude for the unfolding of the great events now in progress in Europe, as they afford me an opportunity to test the truth or error, of the principles, which I have laid down in my elementary discourse on Government. It is as yet in the rough draft, waiting the completion of the rough draft of the discourse on our system of Government. I cannot doubt the correctness of the principles, I have laid down, for they are drawn from facts in the moral world, just as certain, as any in the physical; but I am solicitous to see, how far they are subject to modification in their practical application to the present condition of the civilized world, which is so very different from any, that ever preceded it in many respects. There are powerful, long established, and widely extended errors now at work, which tend to universal disorder and anarchy throughout Christendom; while on the other hand there are powerful causes in operation to counteract them, and which, I trust, and believe, in time, will overpower them, and give a fairer prospect, than has ever yet existed, to the cause of real liberty and civilization. But in the meane time, it is to be feared, there will be great disorders, conflicts and suffering. You will see, that I am still hopeful. Had such a revolution—so wide and so rapid, occured 50 years ago, I would have dispaired, and regarded it, as the commencement of a great retrograde movement in the most advanced and civilized portion of the world. Even now, I regret—greatly regret its rapidity, extent, and too thorough and radical character, especially in France. It ought never be forgotten, that the past is the parent of the present, and that the past condition of Europe, which has given birth to a state of advance and civilization, far exceeding any heretofore known to the world, could not be a bad one. It may have, indeed, contained, within itself, causes calculated to retard, or prevent a farther progress, but these ought to have been removed cautiously, as experience pointed them out, without overthrowing all at once the peace of Governments, and the social condition of communities, which led to such great and happy results; especially as such an overthrow must of necessity be accompanied by such universal embarrassment and distress, and run the hazard of a retrograde, instead of an advance movement, in the condition of the race.

I had, my dear daughter, no intention of writing you such a letter, when I took up my pen. I commenced with the Intention, to relate the ordinary occurrences of the day on this side of the Ocean; but the allusion to the far greater, taking place in Europe, has led me, insensibly, in the direction I have taken. You must take it, better for worse, as I have not time to write another, or space, more than briefly to touch on, what I intended to make the subject of my letter.

My health continues as usual. When I last heard from home (a few days since) all were well and doing well. Your mother had turned to guarding and improving the yard, which Willey writes, has kept her employed, cheerful and hearty.

Edward Bates to the Whig Committee of New York, February 24, 1859

St. Louis, Feb. 24, 1859.

To Messrs. J. PHILIPS PHOENIX, WILLIS BLACKSTONE, H. M. BININGER, DAVID J. LILET AND H. R. SMITH, Committee, New York.

Sirs: A short time ago I was favored with your note of the 7th inst., covering a resolution of the Committee, to the effect that it is inexpedient at this time further to discuss or agitate the Negro question, but rather to turn the attention of the people to other topics — "topics of general importance, such as our Foreign Relations, including the Extension of Territory; the building of Railroads for National purposes; the improvement of our Harbors, the navigation of our Rivers to facilitate Internal Commerce; the subject of Currency, and a Tariff of Duties, and other means of developing our own internal resources, our home wealth, and binding together by ties of national and fraternal feelings, the various parts and sections of our widely extended Republic."

Your letter, gentlemen, opens a very wide field, in asking for my "opinion upon the subject, and my views as to the signs of the times." Books have been written upon these matters, and speeches delivered by the thousand ; and yet the argument seems as far from being exhausted as it was at the beginning ; and I take it for certain that you do not expect or desire me to discuss at large, all or any of these interminable quarrels. That I have opinions upon all or most of them, is true — not the opinions of this or that party, ready to be abandoned or modified to suit this or that platform, but my own opinions — perhaps the more fixed and harder to be changed because deliberately formed in the retirement of private life, free from the exigencies of official responsibility and from the perturbations of party policy. They are my own opinions, right or wrong.

As to the Negro question — I have always thought, and often declared in speech and in print, that it is a pestilent question, the agitation of which has never done good to any party, section or class, and never can do good, unless it be accounted good to stir up the angry passions of men, and exasperate the unreasoning jealousy of sections, and by those bad means foist some unfit men into office, and keep some fit men out. It is a sensitive question into whose dangerous vortex it is quite possible for good men to be drawn unawares. But when I see a man, at the South or the North, of mature age and some experience, persist in urging the question, after the sorrowful experience of the last few years, I can attribute his conduct to no higher motive than personal ambition or sectional prejudice.

As to the power of the General Government to protect the persons and properties, and advance the interests of the people, by laying taxes, raising armies and navies, building forts and arsenals, light houses, moles, and breakwaters, surveying the coasts and adjacent seas, improving rivers, lakes, and harbors, and making roads — I should be very sorry to doubt the existence of the power, or the duty to exercise it, whenever the constituted authorities have the means in their hands, and are convinced that its exercise is necessary to protect the country and advance the prosperity of the people.

In my own opinion, a government that has no power to protect the harbors of its country against winds and waves and human enemies, nor its rivers against snags, sands and rocks, nor to build roads for the transportation of its armies and its mails and the commerce of its people, is a poor, impotent government, and not at all such a government as our fathers thought they had made when they produced the Constitution which was greeted by intelligent men everywhere with admiration and gratitude as a government free enough for all the ends of legal liberty and strong enough for all the purposes of national and individual protection. A free people, if it be wise, will make a good constitution; but a constitution, however good in itself, did never make a free people. The people do not derive their rights from the government, but the government derives its powers from the people; and those powers are granted for the main, if not the only, purpose of protecting the rights of the people. Protection, then, if not the sole, is the chief end of government.

And it is for the governing power to judge, in every instance, what kind and what degree of protection is needful — whether a Navy to guard our commerce all around the world, or an Army to defend the country against armed invasion from without, or domestic insurrection from within; or a Tariff, to protect our home industry against the dangerous obtrusion of foreign labor and capital.

Of the existence of the power and duty of the Government to protect the People in their persons, their property, their industry and their locomotion, I have no doubt; but the time, the mode and the measure of protection, being always questions of policy and prudence, must of necessity be left to the wisdom and patriotism of those whose duty it is to make laws for the good government of the country. And with them I freely leave it, as the safest, and indeed the only, constitutional depository of the power.

As to our Foreign Policy generally, I have but little to say. I am not much of a progressive, and am content to leave it where Washington [Jefferson] placed it, upon that wise, virtuous, safe maxim — "Peace [. . .] with all nations; entangling alliance[s] with none." The greedy and indiscriminate appetite for foreign acquisition, which makes us covet our neighbor's lands, and devise cunning schemes to get them, has little of my sympathy. I view it as a sort of political gluttony, as dangerous to our body politic as gluttony is to the natural man — producing disease certainly, hastening death, probably. Those of our politicians who are afflicted with this morbid appetite are wont to cite the purchase of Louisiana and Florida, as giving countenance to their inordinate desires. But the cases are wholly unlike in almost every particular. Louisiana was indispensable to our full and safe enjoyment of an immense region which was already owned, and its acquisition gave us the unquestioned control of that noble system of Mississippi waters, which nature seems to have made to be one and indivisible, and rounded off the map of the nation into one uniform and compacted whole. Nothing remained to mar and disfigure our national plat, but Florida, and that was desirable, less for its intrinsic value, than because it would form a dangerous means of annoyance, in case of war with a Maritime Power, surrounded as it is, on three sides by the ocean, and touching three of our present States, with no barrier between. The population of Louisiana and Florida, when acquired, was very small compared with the largeness of the territory; and, lying in contact with the States, was easily and quickly absorbed into and assimilated with the mass of our people. Those countries were acquired, moreover, in the most peaceful and friendly manner, and for a satisfactory consideration.

Now, without any right or any necessity, it is hard to tell what we do not claim in all the continent south of us, and the adjacent islands. Cuba is to be the first fruit of our grasping enterprise, and that is to be gotten at all hazards, by peaceful purchase if we can, by war and conquest if we must.2 But Cuba is only an outpost to the Empire of Islands and continental countries that are to follow. A leading Senator3 has lately declared (in debate on the Thirty Million bill4) that we must not only have Cuba, but all the islands from Cape Florida to the Spanish Main, so as to surround the Gulf of Mexico and Caribbean Sea, and make them our "mare clausum" like the Mediterranean, in old times, when the Roman Emperor ruled both its shores, from the pillars of Hercules to the Hellespont.5 This claim of mare nostrum implies, of course, that we must own the continent that bounds our sea on the west, as well as the string of islands that inclose it on the east — that is, Mexico, Central America, and all South America, so far south at least as the Orinoco.6 In that wide compass of sea and land there are a good many native governments, and provinces belonging to the strongest maritime powers, and a narrow continental isthmus which we ourselves, as well as England and France, are wont to call the highway of nations. To fulfill the grand conception, and perfect our tropical empire, we must buy or conquer all these torrid countries, and their mongrel populations. As to buying them, it strikes me that we had better waite [sic] awhile, at least until the Government has ceased to borrow money to pay its current expenses. And as to conquering them, perhaps it would be prudent to pause and make some estimate of costs and contingencies, before we rush into war with all maritime Europe and half America.

I am not one of those who believe that the United States is not an independent and safe nation, because Cuba is not a part of it. On the contrary, I believe that we are quite capable of self-defense, even if the "Queen of the Antilles" were a province of England, France or Russia; and surely, while it remains an appendage of a comparatively feeble nation, Cuba has much more cause to fear us than we have to fear Cuba. In fact, gentlemen, I cannot help doubting the honesty of the cowardly argument by which we are urged to rob poor old Spain of this last remnant of her Western empire, for fear that she might use it to rob us.

But suppose we could get, honestly and peaceably, the whole of the country — continental and insular — from the Rio Grande to the Orinoco, and from Trinidad to Cuba, and thus establish our mare clausum, and shut the gate of the world across the Isthmus, can we govern them wisely and well? For the last few years, in the attempt to govern our home Territories of Kansas and Utah, we have not very well maintained the dignity and justice of the nation, nor secured the peace and prosperity of the subject people.7 Can we hope to do better with the various mixed races of Mexico, Central and South America, and the West India Islands? Some of those countries have been trying for fifty years to establish republican governments on our model, but in every instance have miserably failed; and yet, there was no obstacle to complete success but their own inaptitude.

For my part, I should be grieved to see my country become, like Rome, a conquering and dominant nation; for I think there are few or no examples in history, of Governments whose chief objects were glory and power, which did ever secure the happiness and prosperity of their own people. Such Governments may grow great and famous, and advance a few of their citizens to wealth and nobility; but the price of their grandeur is the personal independence and individual freedom of their people. Still less am I inclined to see absorbed into our system, "on an equal footing with the original States," the various and mixed races (amounting to I know not how many millions) which inhabit the continent and islands south of our present border. I am not willing to inoculate our body politic with the virus of their diseases, political and social — diseases which, with them, are chronic and hereditary, and with us could hardly fail to produce corruption in the head and weakness in the members.

Our own country, as it is, in position, form and size, is a wonder which proclaims a wisdom above the wit of man. Large enough for our posterity, for centuries to come: All in the temperate zone, and therefore capable of a homogeneous population, yet so diversified in climates and soils, as to produce everything that is necessary to the comfort and wealth of a great people: Bounded east and west by great oceans, and bisected in the middle by a mighty river, which drains and fructifies the continent, and binds together the most southern and northern portions of our land by a bond stronger than iron. Beside all this, it is new and growing — the strongest on the continent, with no neighbor whose power it fears, or of whose ambition it has cause to be jealous. Surely such a country is great enough and good enough for all the ends of honest ambition and virtuous power.

It seems to me that an efficient home-loving Government, moderate and economical in its administration, peaceful in its objects, and just to all nations, need have no fear of invasion at home, or serious aggression abroad. The nations of Europe have to stand continually in defense of their existence; but the conquest of our county by a foreign power is simply impossible, and no nation is so absurd as to entertain the thought. We may conquer ourselves by local strifes and sectional animosities; and when, by our folly and wickedness, we have accomplished that great calamity, there will be none to pity us for the consequences of so great a crime.

If our Government would devote all its energies to the promotion of peace and friendship with all foreign countries, the advancement of Commerce, the increase of Agriculture, the growth and stability of Manufactures, and the cheapening, quickening and securing the internal trade and travel of our country ; in short, if it would devote itself in earnest to the establishment of a wise and steady policy of internal government, I think we should witness a growth and consolidation of wealth and comfort and power for good, which cannot be reasonably hoped for from a fluctuating policy, always watching for the turns of good fortune, or from a grasping ambition to seize new territories, which are hard to get and harder to govern.

The present position of the Administration is a sorrowful commentary upon the broad democracy of its professions. In theory, the people have the right and ability to do anything; in practice, we are verging rapidly to the One-Man power.

The President, the ostensible head of the National Democrats, is eagerly striving to concentrate power in his own hands, and thus to set aside both the People and their Representatives in the actual affairs of government. Having emptied the Treasury, which he found full, and living precariously upon borrowed money, he now demands of Congress to entrust to his unchecked discretion the War power, the Purse and the Sword. First, he asks Congress to authorize him, by statute, to use the Army to take military possession of the Northern Mexico, and hold it under his protectorate, and as a security for debts due to our citizens8 — civil possession would not answer, for that might expose him, as in the case of Kansas, to be annoyed by a factious Congress and a rebellious Territorial Legislature.

Secondly: Not content with this, he demands the discretionary power to use the Army and Navy in the South, also in blockading the coast and marching his troops into the interior of Mexico and New Granada, to protect our citizens against all evil-doers along the transit routes of Tehuantepec and Panama.9 And he and his supporters in Congress claim this enormous power upon the ground that, in this particular at least, he ought to be the equal of the greatest monarch of Europe. They forget that our fathers limited the power of the President by design, and for the reason that they had found out by sad experience that the monarchs of Europe were too strong for freedom.

Third: In strict pursuance of this doctrine, first publicly announced from Ostend,10 he demands of Congress to hand over to him thirty millions of dollars to be used at his discretion, to facilitate his acquisition of Cuba.11 Facilitate how ? Perhaps it might be imprudent to tell.

Add to all this, the fact (as yet unexplained) that one of the largest naval armaments which ever sailed from our coast is now operating in South America, ostensibly against a poor little republic far up the Plate River,12 to settle some little quarrel between the two Presidents.13 If Congress had been polite enough to grant the President's demand of the sword and the purse against Mexico, Central America and Cuba, this navy, its duty done at the south, might be made, on its way home, to arrive in the Gulf very opportunely, to aid the " Commander-in-Chief " in the acquisition of some very valuable territory.

I allude to these facts with no malice against Mr. Buchanan, but as evidences of the dangerous change which is now obviously sought to be made in the practical working of the Government — the concentration of power in the hands of the President, and the dangerous policy, now almost established, of looking abroad for temporary glory and aggrandizement, instead of looking at home, for all the purposes of good government — peaceable, moderate, economical, protecting all interests alike, and by a fixed policy, calling into safe exercise all the talents and industry of our people, and thus steadily advancing our country in everything which can make a nation great, happy, and permanent.

The rapid increase of the Public Expenditures (and that, too, under the management of statesmen professing to be peculiarly economical) is an alarming sign of corruption and decay.

That increase bears no fair proportion to the growth and expansion of the country, but looks rather like wanton waste or criminal negligence. The ordinary objects of great expense are not materially augmented — the Army and Navy remain on a low peace establishment— the military defenses are little, if at all, enlarged — the improvement of Harbors, Lakes and Rivers is abandoned, and the Pacific Railroad is not only not begun but its very location is scrambled for by angry sections, which succeed in nothing but mutual defeat. In short, the money to an enormous amount (I am told at the rate of $80,000,000 to $100,000,000 a year) is gone, and we have little or nothing to show for it. In profound peace with foreign nations, and surrounded with the proofs of National growth and individual prosperity, the Treasury, by less than two years of mismanagement, is made bankrupt, and the Government itself is living from hand to mouth, on bills of credit and borrowed money!

This humiliating state of things could hardly happen if men in power were both honest and wise. The Democratic economists in Congress confess that they have recklessly wasted the Public Revenue; they confess it by refusing to raise the Tariff to meet the present exigency, and by insisting that they can replenish the exhausted Treasury and support the Government, in credit and efficiency, by simply striking off their former extravagances.

An illustrious predecessor of the President is reported to have declared "that those who live on borrowed money ought to break." I do not concur in that harsh saying; yet I am clearly of opinion that the Government, in common prudence (to say nothing of pride and dignity), ought to reserve its credit for great transactions and unforeseen emergencies. In common times of peace, it ought always to have an established revenue, equal, at least, to its current expenses. And that revenue ought to be so levied as to foster and protect the Industry of the country employed in our most necessary and important manufactures.

Gentlemen, I cannot touch upon all the topics alluded to in your letter and resolution. I ought rather to beg your pardon for the prolixity of this answer. I speak for no party, because the only party I ever belonged to has ceased to exist as an organized and militant body.

And I speak for no man but myself.

I am fully aware that my opinions and views of public policy are of no importance to anybody but me, and there is good reason to fear that some of them are so antiquated and out of fashion as to make it very improbable that they will ever again be put to the test of actual practice.

2 This was the substance of the Ostend Manifesto which Buchanan as Minister to Great Britain had joined Ministers John Y. Mason and Pierre Soulé in promulgating. As Secretary of State under President Polk, Buchanan had tried to buy Cuba. In his second, third, and fourth annual messages he urged Congress to cooperate with him in securing it by negotiation.

Senator John C. Calhoun to Anna Calhoun Clemson, June 23, 1848

Washington 23d June 1848

MY DEAR DAUGHTER, If a long interval lies between the date of this and your last, you must attribute it to the fact, that my heavy correspondence, publick and private, and official duties, compel me to lengthen the period between my answers and the letters to which they reply, to a much greater extent than I desire in writing to you and the rest of the family. I correspond with all of them which of itself occupies a good deal of my time.

The opinions you express in reference to the state of things in Europe are very sensible and just. There is no prospect of a successful termination of the efforts of France to establish a free popular Government; nor was there any from the begining. She has no elements out of which such a government could be formed; and if she had, still she must fail from her total misconception of the principles, on which such a government, to succeed, must be constructed. Indeed, her conception of liberty is false throughout. Her standard of liberty is ideal; belongs to that kind of liberty which man has been supposed to possess, in what has been falsely called a state of nature, a state supposed to have preceded the social and political, and in which, of course, if it ever existed, he must have live[d] a part, as an isolated individual, without Society, or Government. In such a state, if it were possible for him to exist in it, he would have, indeed, had two of the elements of the French political creed; liberty and equality, but no fraternity. That can only exist in the social and political; and the attempt to unite the other two, as they would exist, in the supposed state of nature, in man, as he must exist in the former, must and ever will fail. The union is impossible, and the attempt to unite them absurd; and must lead, if persisted in, to distraction, anarchy and finally absolute power, in the hand of one man.

It is this false conception that is upheaving Europe, and which, if not corrected, will upset all her efforts to reform her social and political condition. It is at the same time threatening our institutions. Abolitionism originates in it, which every day becomes more formidable, and if not speedily arrested, must terminate in the dissolution of our Union, or in universal confusion, and overthrow of our system of Government. But enough of these general speculations.

We are in the midest of the presidential canvass. It will be one of great confusion. Neither party is satisfied, or united on its nominee; and there will probably be a third candidate, nominated by what are called the Barnburners, or Van Burenites. The prospect, I think, is, that Taylor will succeed, tho' it is not certain. The enclosed will give you all the home news.

It is still uncertain, when Congress will adjourn; but, I think it probable it will about the 1st August.

My health continues good. I am happy to hear you are all well, and that the children [are] growing and doing so well. Kiss them for their Grandfather, and tell them how happy he is to learn, that they are such good children. Give my love to Mr. Clemson.

Diary of Adam Gurowski, April 1861

COMMISSIONERS from the rebels; Seward parleying with them through some Judge Campbell. Curious way of treating and dealing with rebellion, with rebels and traitors; why not arrest them?

Corcoran, a rich partisan of secession, invited to a dinner the rebel commissioners and the foreign diplomats. If such a thing were done anywhere else, such a pimp would be arrested. The serious diplomats, Lord Lyons, Mercier, and Stoeckl refused the invitation; some smaller accepted, at least so I hear.

The infamous traitors fire on the Union flag. They treat the garrison of Sumpter as enemies on sufferance, and here their commissioners go about free, and glory in treason. What is this administration about? Have they no blood; are they fishes?

The crime in full blast; consummatum est. Sumpter bombarded; Virginia, under the nose of the administration, secedes, and the leaders did not see or foresee anything: flirted with Virginia.

Now, they, the leaders or the administration, are terribly startled; so is the brave noble North; the people are taken unawares; but no wonder; the people saw the Cabinet, the President, and the military in complacent security. These watchmen did nothing to give an early sign of alarm, so the people, confiding in them, went about its daily occupation. But it will rise as one man and in terrible wrath. Vous le verrez mess les Diplomates.

The President calls on the country for 75,000 men; telegram has spoken, and they rise, they arm, they come. I am not deceived in my faith in the North; the excitement, the wrath, is terrible. Party lines burn, dissolved by the excitement. Now the people is in fusion as bronze; if Lincoln and the leaders have mettle in themselves, then they can cast such arms, moral, material, and legislative, as will destroy at once this rebellion. But will they have the energy? They do not look like Demiourgi.

Massachusetts takes the lead; always so, this first people in the world; first for peace by its civilization and intellectual development, and first to run to the rescue.

The most infamous treachery and murder, by Baltimoreans, of the Massachusetts men. Will the cowardly murderers be exemplarily punished?

The President, under the advice of Scott, seems to take coolly the treasonable murders of Baltimore; instead of action, again parleying with these Baltimorean traitors. The rumor says that Seward is for leniency, and goes hand in hand with Scott. Now, if they will handle such murderers in silk gloves as they do, the fire must spread.

The secessionists in Washington—and they are a legion, of all hues and positions are defiant, arrogant, sure that Washington will be taken. One risks to be murdered here.

I entered the thus called Cassius Clay Company, organized for the defence of Washington until troops came. For several days patrolled, drilled, and lay several nights on the hard floor. Had compensation, that the drill often reproduced that of Falstaff's heroes. But my campaigners would have fought well in case of emergency. Most of them office-seekers. When the alarm was over, the company dissolved, but each got a kind of certificate beautifully written and signed by Lincoln and Cameron. I refused to take such a certificate, we having had no occasion to fight.

The President issued a proclamation for the blockade of the Southern revolted ports. Do they not know better?

How can the Minister of Foreign Affairs advise the President to resort to such a measure? Is the Minister of Foreign Affairs so willing to call in foreign nations by this blockade, thus transforming a purely domestic and municipal question into an international, public one?

The President is to quench the rebellion, a domestic fire, and to do it he takes a weapon, an engine the most difficult to handle, and in using of which he depends on foreign nations. Do they not know better here in the ministry and in the councils? Russia dealt differently with the revolted Circassians and with England in the so celebrated case of the Vixen.

The administration ought to know its rights of sovereignty and to close the ports of entry. Then no chance would be left to England to meddle.

Yesterday N—— dined with Lord Lyons, and during the dinner an anonymous note announced to the Lord that the proclamation of the blockade is to be issued on to-morrow. N——, who has a romantic turn, or rather who seeks for midi a' 14¾ heures, speculated what lady would have thus violated a secret d'Etat.

I rather think it comes from the Ministry, or, as they call it here, from the Department. About two years ago, when the Central Americans were so teased and maltreated by the fillibusters and Democratic administration, a Minister of one of these Central American States told me in New York that in a Chief of the Departments, or something the like, the Central Americans have a valuable friend, who, every time that trouble is brewing against them in the Department, gives them a secret and anonymous notice of it. This friend may have transferred his kindness to England.

How will foreign nations behave? I wish I may be misguided by my political anglophobia, but England, envious, rapacious, and the Palmerstons and others, filled with hatred towards the genuine democracy and the American people, will play some bad tricks. They will seize the occasion to avenge many humiliations. Charles Sumner, Howe, and a great many others, rely on England, on her antislavery feeling. I do not. I know English policy. We shall see.

France, Frenchmen, and Louis Napoleon are by far more reliable. The principles and the interest of France, broadly conceived, make the existence of a powerful Union a statesmanlike European and world necessity. The cold, taciturn Louis Napoleon is full of broad and clear conceptions. I am for relying, almost explicitly, on France and on him.

The administration calls in all the men-of-war scattered in all waters. As the commercial interests of the Union will remain unprotected, the administration ought to put them under the protection of France. It is often done so between friendly powers. Louis Napoleon could not refuse; and accepting, would become pledged to our side.

Germany, great and small, governments and people, will be for the Union. Germans are honest; they love the Union, hate slavery, and understand, to be sure, the question. Russia, safe, very safe, few blackguards excepted; so Italy. Spain may play double. I do not expect that the Spaniards, goaded to the quick by the former fillibustering administrations, will have judgment enough to find out that the Republicans have been and will be anti-fillibusters, and do not crave Cuba.

Wrote a respectful warning to the President concerning the unvoidable results of his proclamation in regard to the blockade; explained to him that this, his international demonstration, will, and forcibly must evoke a counter proclamation from foreign powers in the interest of their own respective subjects and of their commercial relations. Warned, foretelling that the foreign powers will recognize the rebels as belligerents, he, the President, having done it already in some way, thus applying an international mode of coercion. Warned, that the condition of belligerents, once recognized, the rebel piratical crafts will be recognized as privateers by foreign powers, and as such will be admitted to all ports under the secesh flag, which will thus enjoy a partial recognition.

Foreign powers may grumble, or oppose the closing of the ports of entry as a domestic, administrative decision, because they may not wish to commit themselves to submit to a paper blockade. But if the President will declare that he will enforce the closing of the ports with the whole navy, so as to strictly guard and close the maritime league, then the foreign powers will see that the administration does not intend to humbug them, but that he, the President, will only preserve intact the fullest exercise of sovereignty, and, as said the Roman legist, he, the President, "nil sibi postulat quod non aliis tribuit." And so he, the President, will only execute the laws of his country, and not any arbitrary measure, to say with the Roman Emperor, "Leges etiam in ipsa arma imperium habere volumus." Warned the President that in all matters relating to this country Louis Napoleon has abandoned the initiative to England; and to throw a small wedge in this alliance, I finally respectfully suggested to the President what is said above about putting the American interests in the Mediterranean under the protection of Louis Napoleon.

Few days thereafter learned that Mr. Seward does not believe that France will follow England. Before long Seward will find it out.

All the coquetting with Virginia, all the presumed influence of General Scott, ended in Virginia's secession, and in the seizure of Norfolk.

Has ever any administration, cabinet, ministry—call it what name you will—given positive, indubitable signs of want and absence of foresight, as did ours in these Virginia, Norfolk, and Harper's Ferry affairs? Not this or that minister or secretary, but all of them ought to go to the constitutional guillotine. Blindness—no mere short-sightedness-permeates the whole administration, Blair excepted. And Scott, the politico-military adviser of the President! What is the matter with Scott, or were the halo and incense surrounding him based on bosh? Will it be one more illusion to be dispelled?

The administration understood not how to save or defend Norfolk, nor how to destroy it. No name to be found for such concrete incapacity.

The rebels are masters, taking our leaders by the nose. Norfolk gives to them thousands of guns, &c., and nobody cries for shame. They ought to go in sackcloth, those narrow-sighted, blind rulers. How will the people stand this masterly administrative demonstration? In England the people and the Parliament would impeach the whole Cabinet.

Charles Sumner told me that the President and his Minister of Foreign Affairs are to propose to the foreign powers the accession of the Union to the celebrated convention of Paris of 1856. All three considered it a master stroke of policy. They will not catch a fly by it.

Again wrote respectfully to Mr. Lincoln, warning him against a too hasty accession to the Paris convention. Based my warning,

1st. Not to give up the great principles contained in Marcy's amendment.

2d. Not to believe or suppose for a minute that the accession to the Paris convention at this time can act in a retroactive sense; explained that it will not and cannot prevent the rebel pirates from being recognized by foreign powers as legal privateers, or being treated as such.

3d. For all these reasons the Union will not win anything by such a step, but it will give up principles and chain its own hands in case of any war with England. Supplicated the President not to risk a step which logically must turn wrong.

Baltimore still unpunished, and the President parleying with various deputations, all this under the guidance of Scott. I begin to be confused; cannot find out what is the character of Lincoln, and above all of Scott.

Governors from whole or half-rebel States refuse the President's call for troops. The original call of 75,000, too small in itself, will be reduced by that refusal. Why does not the administration call for more on the North, and on the free States? In the temper of this noble people it will be as easy to have 250,000 as 75,000, and then rush on them; submerge Virginia, North Carolina, etc.; it can be now so easily done. The Virginians are neither armed nor organized. Courage and youth seemingly would do good in the councils.

The free States undoubtedly will vindicate self-government. Whatever may be said by foreign and domestic croakers, I do not doubt it for a single minute. The free people will show to the world that the apparently loose governmental ribbons are the strongest when everybody carries them in him, and holds them. The people will show that the intellectual magnetism of convictions permeating the million is by far stronger than the commonly called governmental action from above, and it is at the same time elastic and expansive, even if the official leaders may turn out to be altogether mediocrities. The self-governing free North will show more vitality and activity than any among the governed European countries would be able to show in similar emergencies. This is my creed, and I have faith in the people.

The infamous slavers of the South would even be honored if named Barbary States of North America. Before the inauguration, Seward was telling the diplomats that no disruption will take place; now he tells them that it will blow over in from sixty to ninety days. Does Seward believe it? Or does his imagination or his patriotism carry him away or astray? Or, perhaps, he prefers not to look the danger in the face, and tries to avert the bitter cup. At any rate, he is incomprehensible, and the more so when seen at a distance.

Something, nay, even considerable efforts ought to be made to enlighten the public opinion in Europe, as on the outside, insurrections, nationalities, etc., are favored in Europe. How far the diplomats sent by the administration are prepared for this task?

Adams has shown in the last Congress his scholarly, classical narrow-mindedness. Sanford cannot favorably impress anybody in Europe, neither in cabinets, nor in saloons, nor the public at large. He looks and acts as a commis voyageur, will be considered as such at first sight by everybody, and his features and manners may not impress others as being distinguished and high-toned.

Every historical, that is, human event, has its moral and material character and sides. To ignore, and still worse to blot out, to reject the moral incentives and the moral verdict, is a crime to the public at large, is a crime towards human reason.

Such action blunts sound feelings and comprehension, increases the arrogance of the evil-doers.

The moral criterion is absolute and unconditional, and ought as such unconditionally to be applied to the events here. Things and actions must be called by their true names. What is true, noble, pure, and lofty, is on the side of the North, and permeates the unnamed millions of the free people; it ought to be separated from what is sham, egotism, lie or assumption. Truth must be told, never mind the outcry. History has not to produce pieces for the stage, or to amuse a tea-party.

Regiments pour in; the Massachusetts men, of course, leading the van, as in the times of the tea-party. My admiration for the Yankees is justified on every step, as is my scorn, my contempt, etc., etc., of the Southern chivalrous slaver.

Wrote to Charles Sumner expressing my wonder at the undecided conduct of the administration; at its want of foresight; its eternal parleying with Baltimoreans, Virginians, Missourians, etc., and no step to tread down the head of the young snake. No one among them seems to have the seer's eye. The people alone, who arm, who pour in every day and in large numbers, who transform Washington into a camp, and who crave for fighting, the people alone have the prophetic inspiration, and are the genuine statesmen for the emergency.

How will the Congress act? The Congress will come here emerging from the innermost of the popular volcano; but the Congress will be manacled by formulas; it will move not in the spirit of the Constitution, but in the dry constitutionalism, and the Congress will move with difficulty. Still I have faith, although the Congress never will seize upon parliamentary omnipotence. Up to to-day, the administration, instead of boldly crushing, or, at least, attempting to do it; instead of striking at the traitors, the administration is continually on the lookout where the blows come from, scarcely having courage to ward them off. The deputations pouring from the North urge prompt, decided, crushing action. This thunder-voice of the twenty millions of freemen ought to nerve this senile administration. The Southern leaders do not lose one minute's time; they spread the fire, arm, and attack with all the fury of traitors and criminals.

The Northern merchants roar for the offensive; the administration is undecided.

Some individuals, politicians, already speak out that the slaveocratic privileges are only to be curtailed, and slavery preserved as a domestic institution. Not a bit of it. The current and the development of events will run over the heads of the pusillanimous and contemptible conservatives. Slavery must perish, even if the whole North, Lincoln and Seward at its head, should attempt to save it.

Already they speak of the great results of Fabian policy; Seward, I am told, prides in it. Do those Fabiuses know what they talk about? Fabius's tactics—not policy—had in view not to expose young, disheartened levies against Hannibal's unconquered veterans, but further to give time to Rome to restore her exhausted means, to recover political influences with other Italian independent communities, to reconclude broken alliances with the cities, etc. But is this the condition of the Union? Your Fabian policy will cost lives, time, and money; the people feels it, and roars for action. Events are great, the people is great, but the official leaders may turn out inadequate to both.

What a magnificent chance-scarcely equal in history to become a great historical personality, to tower over future generations. But I do not see any one pointing out the way. Better so; the principle of self-government as the self-acting, self-preserving force will be asserted by the total eclipse of great or even eminent men.

The administration, under the influence of drill men, tries to form twenty regiments of regulars, and calls for 45,000 three years' volunteers. What a curious appreciation of necessity and of numbers must prevail in the brains of the administration. Twenty regiments of regulars will be a drop in water; will not help anything, but will be sufficient to poison the public spirit. Citizens and people, but not regulars, not hirelings, are to fight the battle of principle. Regulars and their spirit, with few exceptions, is worse here than were the Yanitschars.

When the principle will be saved and victorious, it will be by the devotion, the spontaneity of the people, and not by Lincoln, Scott, Seward, or any of the like. It is said that Seward rules both Lincoln and Scott. The people, the masses, do not doubt their ability to crush by one blow the traitors, but the administration does.

What I hear concerning the Blairs confirms my high opinion of both. Blair alone in the Cabinet represents the spirit of the people.

Something seems not right with Scott. Is he too old, or too much of a Virginian, or a hero on a small scale?

If, as they say, the President is guided by Scott's advice, such advice, to judge from facts, is not politic, not heroic, not thorough, not comprehensive, and not at all military, that is, not broad and deep, in the military sense. It will be a pity to be disappointed in this national idol.

Scott is against entering Virginia, against taking Baltimore, against punishing traitors. Strange, strange!

Diplomats altogether out of their senses; they are bewildered by the uprising, by the unanimity, by the warlike, earnest, unflinching attitude of the masses of the freemen, of my dear Yankees. The diplomats have lost the compass. They, duty bound, were diplomatically obsequious to the power held so long by the pro-slavery party. They got accustomed to the arrogant assumption and impertinence of the slavers, and, forgetting their European origin, the diplomats tacitly — but for their common sense and honor I hope reluctantly admitted the assumptions of the Southern banditti to be in America the nearest assimilation to the chivalry and nobility of old Europe. Without taking the cudgel in defence of European nobility, chivalry, and aristocracy, it is sacrilegious to compare those infamous slavers with the old or even with the modern European higher classes. In the midst of this slave-driving, slave-worshipping, and slave-breeding society of Washington, the diplomats swallowed, gulped all the Southern lies about the Constitution, state-rights, the necessity of slavery, and other like infamies. The question is, how far the diplomats in their respective official reports transferred these pro-slavery common-places to their governments. But, after all, the governments of Europe will not be thoroughly influenced by the chat of their diplomats.

Among all diplomats the English (Lord Lyons) is the most sphinx; he is taciturn, reserved, listens more than he speaks; the others are more communicative.

What an idea have those Americans of sending a secret agent to Canada, and what for? England will find it out, and must be offended. I would not have committed such an absurdity, even in my palmy days, when I conspired with Louis Napoleon, sat in the councils with Godefroi Cavaignac, or wrote instructions for Mazzini, then only a beginner with his Giovina Italia, and his miscarried Romarino attempt in Savoy.

Of what earthly use can be such politique provocatrice towards England? Or is it only to give some money to a hungry, noisy, and not over-principled office-seeker?

Employment of Negroes in the Army: September 3, 1863

This knotty subject is exciting comment in nearly all of the newspapers in the confederacy, (says the Selma Mississippian,) and thoughtful men throughout the country are giving it their serious attention.  It seems to us there should be no difficulty in its solution.  We must either employ the negroes ourselves or the enemy will employ them against us.  While the enemy retains so much of our territory, they are, in the present avocation and status, a dangerous element, a source of weakness.  They are no longer negative characters, but subjects of volition as other people.  They must be taught to know that this is peculiarly the country of the black man—that in no other is the climate and soil so well adapted to his nature and capacity.  He must further be taught that it is his duty as well as the white man’s, to defend his home with arms, if need be.

We are aware that there are persons who shudder at the bare [idea] of placing arms in the hands of negroes, and who are not willing to trust them under any circumstances.—The negro, however, is proverbial for his faithfulness under kind treatment.  He is an affectionate, grateful being, and we are persuaded that the tears of such persons are groundless.

There are in the slaveholding States four millions of negroes, and out of this number at least six hundred thousand able-bodied men capable of bearing arms can be found.  Lincoln proposes to free and arm them against us.  There are already 50,000 of them in arms in the federal ranks.  Lincoln’s plan has worked well so far, and if not checkmated, will most assuredly be carried out.  The Confederate Government must adopt a counter policy.  It must thwart the enemy in this gigantic scheme, at all hazards, and if nothing else will do it—if the negroes cannot be made effective and trustworthy to the Southern cause in no other way, we solemnly believe it is the duty of this Government to forestall Lincoln and proceed at once to take steps for the emancipation or liberation of the negroes itself.  Let them be declared free, placed in the ranks, and told to fight for their homes and country.

We are fully sensible of the grave importance of the question, but the inexorable logic of events has forced it upon us.  We must deal with it, then, not with fear and trembling—not as timid, time serving men—but with a boldness, a promptness and a determination which the exigency requires, and which should over characterize the action of a people resolved to sacrifice everything for liberty.  It is true, that such a step would revolutionize our whole industrial system—that it would, to a great extent, impoverish the country and be a dire calamity to both the negro [and] the white race of this and the Old World; but better this than the loss of the negroes, the country and liberty.

If Lincoln succeeds in arming our slaves against us, he will also succeed in making them our masters.  He will reverse the social order of things in the South.  Whereas, if he is checkmated in times, our liberties will remain intact; the land will be ours, and the industrial system of the country will still [be] controlled by Southern men.

Such action on the part of our Government would place our people in a purer and better light before the world.  It would disabuse the European mind of a grave error in regard to the cause of our separation.  It would prove to them that there were higher and holier motives which actuated our people than the mere love of property.  It would show that although slavery is one of the principles that we started out to fight for, yet it falls far short of being the chief one; that for the sake of our liberty were are capable of any personal sacrifice; that we regard the emancipation of slaves and the consequent loss of property as an evil infinitely less than the subjugation and enslavement of ourselves; that it is not a war exclusively for the privilege of holding negroes in bondage.  It would prove to our own soldiers, three-fourths of whom never owned a negro, that it is not “the rich man’s war and the poor man’s fight;” but a war for the most sacred of all principles, for the dearest of all rights—the right to govern ourselves.  It would show them that the rich man who owned slaves was not willing to jeopardize the precious liberty of the country by his eagerness to hold on to his slaves, but that he was ready to give them up and sacrifice his interest in them whenever the cause demanded it.  It would lend a new impetus, a new enthusiasm, a new and powerful strength to the cause, and place our success beyond a peradventure.  It would at once remove all the odium which attaches to us on account of slavery, and bring us speedy recognition, and, if necessary, intervention.

We sincerely trust that the Southern people will be found willing to make any and every sacrifice which the establishment of our independence may require.  Let it never be said that to preserve slavery we were willing to wear the chains of bondage ourselves—that the very avarice which prompted us to hold on to the negro for the sake of the money invested in him, riveted upon us shackles more galling and bitter than ever a people yet endured.  Let not slavery prove a barrier to our independence.  If it is found in the way—if it proves an insurmountable obstacle to the achievement of our liberty and separate nationality, away with it!  Let it perish!—We must make up our minds to one solemn duty—the first duty of the patriot—and that is to save ourselves from the rapacious North WHATEVER THE COST.

Jefferson Davis to the Confederate Congress, January 12, 1863

RICHMOND, January 12, 1863.

The SENATE AND HOUSE OF REPRESENTATIVES OF THE CONFEDERATE STATES:

At the date of your last adjournment the preparations of the enemy for further hostilities had assumed so menacing an aspect as to excite in some minds apprehension of our ability to meet them with sufficient promptness to avoid serious reverses. These preparations were completed shortly after your departure from the seat of government, and the armies of the United States made simultaneous advance on our frontiers, on the Western rivers, and on the Atlantic Coast, in masses so great as to evince their hope of overbearing all resistance by mere weight of numbers. This hope, however, like those previously entertained by our foes, has vanished. In Virginia their fourth attempt at invasion by armies whose assured success was confidently predicted, has met with decisive repulse. Our noble defenders, under the consummate leadership of their general, have again, at Fredericksburg, inflicted on the forces under General Burnside the like disastrous overthrow as had been previously suffered by the successive invading armies commanded by Generals McDowell, McClellan, and Pope.

In the West obstinate battles have been fought with varying fortunes, marked by frightful carnage on both sides; but the enemy's hopes of decisive results have again been baffled, while at Vicksburg another formidable expedition has been repulsed with considerable loss on our side and severe damage to the assailing forces. On the Atlantic Coast the enemy has been unable to gain a footing beyond the protecting shelter of his fleets, and the city of Galveston has just been recovered by our forces, which succeeded not only in the capture of the garrison, but of one of the enemy's vessels of war, which was carried by boarding parties from merchant river steamers. Our fortified positions have everywhere been much strengthened and improved, affording assurance of our ability to meet with success the utmost efforts of our enemies, in spite of the magnitude of their preparations for attack.

A review of our history during the two years of our national existence affords ample cause for congratulation and demands the most fervent expression of our thankfulness to the Almighty Father, who has blessed our cause. We are justified in asserting, with a pride surely not unbecoming, that these Confederate States have added another to the lessons taught by history for the instruction of man; that they have afforded another example of the impossibility of subjugating a people determined to be free, and have demonstrated that no superiority of numbers or available resources can overcome the resistance offered by such valor in combat, such constancy under suffering, and such cheerful endurance of privation as have been conspicuously displayed by this people in the defense of their rights and liberties. The anticipations with which we entered into the contest have now ripened into a conviction which is not only shared with us by the common opinion of neutral nations, but is evidently forcing itself upon our enemies themselves. If we but mark the history of the present year by resolute perseverance in the path we have hitherto pursued, by vigorous effort in the development of all our resources for defense, and by the continued exhibition of the same unfaltering courage in our soldiers and able conduct in their leaders as have distinguished the past, we have every reason to expect that this will be the closing year of the war. The war, which in its inception was waged for forcing us back into the Union, having failed to accomplish that purpose, passed into a second stage, in which it was attempted to conquer and rule these States as dependent provinces. Defeated in this second design, our enemies have evidently entered upon another, which can have no other purpose than revenge and thirst for blood and plunder of private property. But however implacable they may be, they can have neither the spirit nor the resources required for a fourth year of a struggle uncheered by any hope of success, kept alive solely for the indulgence of mercenary and wicked passions, and demanding so exhaustive an expenditure of blood and money as has hitherto been imposed on their people. The advent of peace will be hailed with joy. Our desire for it has never been concealed. Our efforts to avoid the war, forced on us as it was by the lust of conquest and the insane passions of our foes, are known to mankind. But earnest as has been our wish for peace and great as have been our sacrifices and sufferings during the war, the determination of this people has with each succeeding month become more unalterably fixed to endure any sufferings and continue any sacrifices, however prolonged, until their right to self-government and the sovereignty and independence of these States shall have been triumphantly vindicated and firmly established.

In this connection the occasion seems not unsuitable for some reference to the relations between the Confederacy and the neutral powers of Europe since the separation of these States from the former Union. Four of the States now members of the Confederacy were recognized by name as independent sovereignties in a treaty of peace concluded in the year 1783 with one of the two great maritime powers of Western Europe, and had been, prior to that period, allies in war of the other. In the year 1778 they formed a Union with nine other States under Articles of Confederation. Dissatisfied with that Union, three of them, Virginia, South Carolina, and Georgia, together with eight of the States now members of the United States, seceded from it in 1789, and these eleven seceding States formed a second Union, although by the terms of the Articles of Confederation express provision was made that the first Union should be perpetual. Their right to secede, notwithstanding this provision, was neither contested by the States from which they separated nor made the subject of discussion with any third-power. When at a later period North Carolina acceded to that second Union, and when, still later, the other sovereign States, now members of this Confederacy, became also members of the same Union, it was upon the recognized footing of equal and independent sovereignties, nor had it then entered into the minds of men that sovereign States could be compelled by force to remain members of a confederation into which they had entered of their own free will, if at a subsequent period the defense of their safety and honor should, in their judgment, justify withdrawal. The experience of the past had evinced the futility of any renunciation of such inherent rights, and accordingly the provision for perpetuity contained in the Articles of Confederation of 1778 was omitted in the Constitution of 1789. When, therefore, in 1861 eleven of the States again thought proper, for reasons satisfactory to themselves, to secede from the second Union and to form a third one under an amended constitution, they exercised a right which, being inherent, required no justification to foreign nations, and which international law did not permit them to question. The usages of intercourse between nations do, however, require that official communication be made to friendly powers of all organic changes in the constitution of States, and there was obvious propriety in giving prompt assurance of our desire to continue amicable relations with all mankind. It was under the influence of these considerations that your predecessors, the Provisional Government, took early measures for sending to Europe commissioners charged with the duty of visiting the capitals of the different powers and making arrangements for the opening of more formal diplomatic intercourse. Prior, however, to the arrival abroad of those commissioners the United States had commenced hostilities against the Confederacy by dispatching a secret expedition for the re-enforcement of Fort Sumter, after an express promise to the contrary, and with a duplicity which has been fully unveiled in a former message. They had also addressed communications to the different cabinets of Europe in which they assumed the attitude of being sovereign over this Confederacy, alleging that these independent States were in rebellion against the remaining States of the Union, and threatening Europe with manifestations of their displeasure if it should treat the Confederate States as having an independent existence. It soon became known that these pretensions were not considered abroad to be as absurd as they were known to be at home, nor had Europe yet learned what reliance was to be placed on the official statements of the Cabinet at Washington.

The delegation of power granted by these States to the Federal Government to represent them in foreign intercourse had led Europe into the grave error of supposing that their separate sovereignty and independence had been merged into one common sovereignty, and had ceased to have a distinct existence. Under the influence of this error, which all appeals to reason and historical fact were vainly used to dispel, our commissioners were met by the declaration that foreign governments could not assume to judge between the Conflicting representations of the two parties as to the true nature of their previous mutual relations. The Governments of Great Britain and Franco accordingly signified their determination to confine themselves to recognizing the self-evident fact of the existence of a war, and to maintaining a strict neutrality during its progress. Some of the other powers of Europe pursued the same course of policy, and it became apparent that by some understanding, express or tacit, Europe had decided to leave the initiative in all action touching the contest on this continent to the two powers just named, who were recognized to have the largest interests involved, both by reason of proximity and of the extent and intimacy of their commercial relations with the States engaged in war. It is manifest that the course of action adopted by Europe, while based on an apparent refusal to determine the question, or to side with either party, was in point of fact an actual decision against our rights and in favor of the groundless pretensions of the United States. It was a refusal to treat us as an independent government. If we were independent States the refusal to entertain with us the same international intercourse as was maintained with our enemy was unjust, and was injurious in its effects, whatever may have been the motive which prompted it. Neither was it in accordance with the high moral obligations of that international code whose chief sanction is the conscience of sovereigns and the public opinion of mankind, that those eminent powers should decline the performance of a duty peculiarly incumbent on them from any apprehension of the consequences to themselves. One immediate and necessary result of their declining the responsibility of a decision which must have been adverse to the extravagant pretensions of the United States was the prolongation of hostilities to which our enemies were thereby encouraged, and which have resulted in nothing but scenes of carnage and devastation on this continent, and of misery and suffering on the other, such as have scarcely a parallel in history. Had those powers promptly admitted our right to be treated as all other independent nations, none can doubt that the moral effect of such action would have been to dispel the delusion under which the United States have persisted in their efforts to accomplish our subjugation. To the continued hesitation of the same powers in rendering this act of simple justice toward this Confederacy is still due the continuance of the calamities which mankind suffers from the interruption of its peaceful pursuits, both in the Old and the New World.

There are other matters in which less than justice has been rendered to this people by neutral Europe, and undue advantage conferred on the aggressors in a wicked war. At the inception of hostilities the inhabitants of the Confederacy were almost exclusively agriculturists, those of the United States, to a great extent, mechanics and merchants. We had no commercial marine, while their merchant vessels covered the ocean. We were without a navy, while they had powerful fleets. The advantage which they possessed for inflicting injury on our coasts and harbors was thus counterbalanced in some measure by the exposure of their commerce to attack by private armed vessels. It was known to Europe that within a very few years past the United States had peremptorily refused to accede to proposals for abolishing privateering, on the ground, as alleged by them, that nations owning powerful fleets would thereby obtain undue advantage over those possessing inferior naval forces. Yet no sooner was war flagrant between the Confederacy and the United States than the maritime powers of Europe issued orders prohibiting either party from bringing prizes into their ports. This prohibition, directed with apparent impartiality against both belligerents, was in reality effective against the Confederate States alone, for they alone could find a hostile commerce on the ocean. Merely nominal against the United States, the prohibition operated with intense severity on the Confederacy, by depriving it of the only means of maintaining with some approach to equality its struggle on the ocean against the crushing superiority of naval force possessed by its enemies. The value and efficiency of the weapon which was thus wrested from our grasp by the combined action of neutral European powers in favor of a nation which professes openly its intention of ravaging their commerce by privateers in any future war is strikingly illustrated by the terror inspired among the commercial classes of the United States by a single cruiser of the Confederacy. One national steamer, commanded by officers and manned by a crew who are debarred, by the closure of neutral ports, from the opportunity of causing captured vessels to be condemned in their favor as prizes, has sufficed to double the rates of marine insurance in Northern ports and consign to forced inaction numbers of Northern vessels, in addition to the direct damage inflicted by captures at sea. How difficult, then, to overestimate the effects that must have been produced by the hundreds of private armed vessels that would have swept the seas in pursuit of the commerce of our enemy if the means of disposing of their prizes had not been withheld by the action of neutral Europe.

But it is especially in relation to the so-called blockade of our coast that the policy of European powers has been so shaped as to cause the greatest injury to the Confederacy and to confer signal advantages on the United States. The importance of this subject requires some development. Prior to the year 1856 the principles regulating this subject were to be gathered from the writings of eminent publicists, the decisions of admiralty courts, international treaties, and the usages of nations. The uncertainty and doubt which prevailed in reference to the true rules of maritime law in time of war, resulting from the discordant and often conflicting principles announced from such varied and independent sources, had become a grievous evil to mankind. Whether a blockade was allowable against a port not invested by land as well as by sea; whether a blockade was valid by sea if the investing fleet was merely sufficient to render ingress to the blockaded port "evidently dangerous," or whether it was further required for its legality that it should be sufficient "really to prevent access," and numerous other similar questions had remained doubtful and undecided.

Animated by the highly honorable desire to put an end “to differences of opinion between neutrals and belligerents, which may occasion serious difficulties and even conflicts” (I quote the official language), the five great powers of Europe, together with Sardinia and Turkey, adopted in 1856 the following “solemn declaration” of principles:

1. Privateering is, and remains, abolished.

2. The neutral flag covers enemy's goods with the exception of contraband of war.

3. Neutral goods, with the exception of contraband of war, are not liable to capture under enemy's flag.

4. Blockades, in order to be binding, must be effective; that is to say, maintained by a force sufficient really to prevent access to the coast of the enemy.

Not only did this solemn declaration announce to the world the principles to which the signing powers agreed to conform in future wars, but it contained a clause to which those powers gave immediate effect, and which provided that the states not parties to the Congress of Paris should be invited to accede to the declaration. Under this invitation every independent state in Europe yielded its assent—at least, no instance is known to me of a refusal; and the United States, while declining to assent to the proposition which prohibited privateering, declared that the three remaining principles were in entire accordance with their own views of international law. No instance is known in history of the adoption of rules of public law under circumstances of like solemnity, with like unanimity, and pledging the faith of nations with a sanctity so peculiar.

When, therefore, this Confederacy was formed, and when neutral powers, while deferring action on its demand for admission into the family of nations, recognized it as a belligerent power, Great Britain and France made informal proposals about the same time that their own rights as neutrals should be guaranteed by our acceding as belligerents, to the declaration of principles made by the Congress of Paris. The request was addressed to our sense of justice, and therefore met immediate favorable response in the resolutions of the Provisional Congress of the 13th August, 1861, by which all the principles announced by the Congress of Paris were adopted as the guide of our conduct during the war, with the sole exception of that relative to privateering. As the right to make use of privateers was one in which neutral nations had, as to the present war, no interest; as it was a right which the United States had refused to abandon, and which they remained at liberty to employ against us; as it was a right of which we were already in actual enjoyment, and which we could not be expected to renounce flagrante bello against an adversary possessing an overwhelming superiority of naval forces, it was reserved with entire confidence that neutral nations could not fail to perceive that just reason existed for the reservation. Nor was this confidence misplaced, for the official documents published by the British Government, usually called “Blue Books,” contained the expression of the satisfaction of that Government with the conduct of the officials who conducted successfully the delicate business confided to their charge.

These solemn declarations of principle—this implied agreement between the Confederacy and the two powers just named—have been suffered to remain inoperative against the menaces and outrages on neutral rights committed by the United States with unceasing and progressive arrogance during the whole period of the war. Neutral Europe remained passive when the United States, with a naval force insufficient to blockade effectively the coast of a single State, proclaimed a paper blockade of thousands of miles of coast, extending from the capes of the Chesapeake to those of Florida, and encircling the Gulf of Mexico from Key West to the mouth of the Rio Grande. Compared with this monstrous pretension of the United States, the blockades known in history under the names of the Berlin and Milan decrees and the British orders in council, in the years 1806 and 1807, sink into insignificance. Yet those blockades were justified by the powers that declared them on the sole ground that they were retaliatory; yet those blockades have since been condemned by the publicists of those very powers as violations of international law; yet those blockades evoked angry remonstrances from neutral powers, among which the United States were the most conspicuous; yet those blockades became the chief cause of the war between Great Britain and the United States in 1812; yet those blockades were one of the principal motives that led to the declaration of the Congress of Paris, in 1856, in the fond hope of imposing an enduring check on the very abuse of maritime power which is now renewed by the United States in 1861 and 1862, under circumstances and with features of aggravated wrong without precedent in history.

The records of our State Department contain the evidence of the repeated and formal remonstrances made by this Government to neutral powers against the recognition of this blockade. It has been shown by evidence not capable of contradiction, and which has been furnished in part by the officials of neutral nations, that the few ports of this Confederacy, before which any naval forces at all have been stationed, have been invested so inefficiently that hundreds of entries have been effected into them since the declaration of the blockade; that our enemies have themselves admitted the inefficiency of their blockade in the most forcible manner by repeated official complaints of the sale to us of goods contraband of war, a sale which could not possibly affect their interests if their pretended blockade was sufficient "really to prevent access to our coast;" that they have gone farther and have alleged their inability to render their paper blockade effective as the excuse for the odious barbarity of destroying the entrance to one of our harbors by sinking vessels loaded with stone in the channel; that our commerce with foreign nations has been intercepted, not by effective investment of our ports, nor by the seizure of ships in the attempt to enter them, but by the capture on the high seas of neutral vessels by the cruisers of our enemies whenever supposed to be bound to any point on our extensive coast, without inquiry whether a single blockading vessel was to be found at such point; that blockading vessels have left the ports at which they were stationed for distant expeditions, have been absent for many days, and have returned without notice either of the cessation or renewal of the blockade; in a word, that every prescription of maritime law and every right of neutral nations to trade with a belligerent, under the sanction of principles heretofore universally respected, have been systematically and persistently violated by the United States. Neutral Europe has received our remonstrances and has submitted in almost unbroken silence to all the wrongs that the United States have chosen to inflict on its commerce. The Cabinet of Great Britain, however, has not confined itself to such implied acquiescence in these breaches of international law as results from simple inaction, but has, in a published dispatch of the Secretary of State for Foreign Affairs, assumed to make a change in the principle enunciated by the Congress of Paris, to which the faith of the British Government was considered to be pledged; a change too important and too prejudicial to the interests of the Confederacy to be overlooked, and against which I have directed solemn protest to be made, after a vain attempt to obtain satisfactory explanations from the British Government. In a published dispatch from Her Majesty's Foreign Office to her minister at Washington under the date of 11th February, 1862, occurs the following passage:

Her Majesty's Government, however, are of opinion that, assuming that the blockade was duly notified, and also that a number of ships are stationed and remain at the entrance of a port sufficient really to prevent access to it, or to create an evident danger of entering it or leaving it, and that these ships do not voluntarily permit ingress or egress, the fact that various ships may have successfully escaped through it (as in the particular instance here referred to) will not of itself prevent the blockade from being an effectual one by international law.

The words which I have italicized are an addition made by the British Government of its own authority to a principle the exact terms of which were settled with deliberation by the common consent of civilized nations and by implied convention with this Government, as already explained, and their effect is clearly to reopen to the prejudice of the Confederacy one of the very disputed questions on the law of blockade which the Congress of Paris professed to settle. The importance of this change is readily illustrated by taking one of our ports as an example. There is "evident danger" in entering the port of Wilmington from the presence of a blockading force, and by this test the blockade is effective. "Access is not really prevented" by the blockading fleet to the same port, for steamers are continually arriving and departing, so that tried by this test the blockade is ineffective and invalid. The justice of our complaint on this point is so manifest as to leave little room for doubt that further reflection will induce the British Government to give us such assurances as will efface the painful impressions that would result from its language if left unexplained.

From the foregoing remarks you will perceive that during nearly two years of struggle, in which every energy of our country has been evoked for maintaining its very existence, the neutral nations of Europe have pursued a policy which, nominally impartial, has been practically most favorable to our enemies and most detrimental to us. The exercise of the neutral right of refusing entry into their ports to prizes taken by both belligerents was eminently hurtful to the Confederacy. It was sternly asserted and maintained. The exercise of the neutral right of commerce with a belligerent whose ports are not blockaded by fleets sufficient really to prevent access to them would have been eminently hurtful to the United States. It was complacently abandoned. The duty of neutral states to receive with cordiality and recognize with respect any new confederation that independent states may think proper to form was too clear to admit of denial, but its postponement was eminently beneficial to the United States and detrimental to the Confederacy. It was postponed.

In this review of our relations with the neutral nations of Europe it has been my purpose to point out distinctly that this Government has no complaint to make that those nations declared their neutrality. It could neither expect nor desire more. The complaint is that the neutrality has been rather nominal than real, and that recognized neutral rights have been alternately asserted and waived in such manner as to bear with great severity on us, and to confer signal advantages on our enemy.

I have hitherto refrained from calling to your attention this condition of our relations with foreign powers for various reasons. The chief of these was the fear that a statement of our just grounds of complaint against a course of policy so injurious to our interests might be misconstrued into an appeal for aid. Unequal as we were in mere numbers and available resources to our enemies, we were conscious of powers of resistance, in relation to which Europe was incredulous, and our remonstrances were therefore peculiarly liable to be misunderstood. Proudly self-reliant, the Confederacy knowing full well the character of the contest into which it was forced, with full trust in the superior qualities of its population, the superior valor of its soldiers, the superior skill of its generals, and above all in the justice of its cause, felt no need to appeal for the maintenance of its rights to other earthly aids, and it began and has continued this struggle with the calm confidence ever inspired in those who, with consciousness of right, can invoke the Divine blessing on their cause. This confidence has been so assured that we have never yielded to despondency under defeat, nor do we feel undue elation at the present brighter prospect of successful issue to our contest. It is, therefore, because our just grounds of complaint can no longer be misinterpreted that I lay them clearly before you. It seems to me now proper to give you the information, and, although no immediate results may be attained, it is well that truth should be preserved and recorded. It is well that those who are to follow us should understand the full nature and character of the tremendous conflict in which the blood of our people has been poured out like water, and in which they have resisted, unaided, the shock of hosts which would have sufficed to overthrow many of the powers which, by their hesitation in according our rights as an independent nation, imply doubt of our ability to maintain our national existence. It may be, too, that if in future times unfriendly discussions not now anticipated shall unfortunately arise between this Confederacy and some European power, the recollection of our forbearance under the grievances which I have enumerated may be evoked with happy influence in preventing any serious disturbance of peaceful relations.

It would not be proper to close my remarks on the subject of our foreign relations without adverting to the fact that the correspondence between the Cabinets of France, Great Britain, and Russia, recently published, indicate a gratifying advance in the appreciation by those Governments of the true interests of mankind as involved in the war on this continent. It is to the enlightened ruler of the French nation that the public feeling of Europe is indebted for the first official exhibition of its sympathy for the sufferings endured by this people with so much heroism, of its horror at the awful carnage with which the progress of the war has been marked, and of its desire for a speedy peace. The clear and direct intimation contained in the language of the French note, that our ability to maintain our independence has been fully established, was not controverted by the answer of either of the Cabinets to which it was addressed. It is indeed difficult to conceive a just ground for a longer delay on this subject after reading the following statement of facts contained in the letter emanating from the minister of His Imperial Majesty:

There has been established, from the very beginning of this war, an equilibrium of forces between the belligerents, which has since been almost constantly maintained, and after the spilling of so much blood they are to-day in this respect in a situation which has not sensibly changed. Nothing authorizes the prevision that more decisive military operations will shortly occur. According to the last advices received in Europe, the two armies were, on the contrary, in a condition which permitted neither to hope within a short delay advantages sufficiently marked to turn the balance definitely and to accelerate the conclusion of peace.

As this Government has never professed the intention of conquering the United States, but has simply asserted its ability to defend itself against being conquered by that power, we may safely conclude that the claims of this Confederacy to its just place in the family of nations cannot long be withheld, after so frank and formal an admission of its capacity to cope on equal terms with its aggressive foes, and to maintain itself against their attempts to obtain decisive results by arms.

It is my painful duty again to inform you of the renewed examples of every conceivable atrocity committed by the armed forces of the United States at different points within the Confederacy, and which must stamp indelible infamy not only on the perpetrators but on their superiors, who, having the power to check these outrages on humanity, numerous and well authenticated as they have been, have not yet in a single instance of which I am aware inflicted punishment on the wrong-doers. Since my last communication to you one General McNeil murdered seven prisoners of war in cold blood, and the demand for his punishment has remained unsatisfied. The Government of the United States, after promising examination and explanation in relation to the charges made against General Benjamin F. Butler, has by its subsequent silence, after repeated efforts on my part to obtain some answer on the subject, not only admitted his guilt but sanctioned it by acquiescence, and I have accordingly branded this criminal as an outlaw, and directed his execution in expiation of his crimes if he should fall into the hands of any of our forces. Recently I have received apparently authentic intelligence of another general by the name of Milroy, who has issued orders in Western Virginia for the payment of money to him by the inhabitants, accompanied by the most savage threats of shooting every recusant, besides burning his house, and threatening similar atrocities against any of our citizens who shall fail to betray their country by giving him prompt notice of the approach of any of our forces, and this subject has also been submitted to the superior military authorities of the United States with but faint hope that they will evince any disapprobation of the act. Humanity shudders at the appalling atrocities which are being daily multiplied under the sanction of those who have obtained temporary possession of power in the United States, and who are fast making its once fair name a byword of reproach among civilized men. Not even the natural indignation inspired by this conduct should make us, however, so unjust as to attribute to the whole mass of the people who are subjected to the despotism that now reigns with unbridled license in the city of Washington a willing acquiescence in its conduct of the war. There must necessarily exist among our enemies very many, perhaps a majority, whose humanity recoils from all participation in such atrocities, but who cannot be held wholly guiltless while permitting their continuance without an effort at repression.

The public journals of the North have been received, containing a proclamation, dated on the 1st day of the present month, signed by the President of the United States, in which he orders and declares all slaves within ten of the States of the Confederacy to be free, except such as are found within certain districts now occupied in part by the armed forces of the enemy. We may well leave it to the instincts of that common humanity which a beneficent Creator has implanted in the breasts of our fellow men of all countries to pass judgment on a measure by which several millions of human beings of an inferior race, peaceful and contented laborers in their sphere, are doomed to extermination, while at the same time they are encouraged to a general assassination of their masters by the insidious recommendation “to abstain from violence unless in necessary self-defense.” Our own detestation of those who have attempted the most execrable measure recorded in the history of guilty man is tempered by profound contempt for the impotent rage which it discloses. So far as regards the action of this Government on such criminals as may attempt its execution, I confine myself to informing you that I shall, unless in your wisdom you deem some other course more expedient, deliver to the several State authorities all commissioned officers of the United States that may hereafter be captured by our forces in any of the States embraced in the proclamation, that they may be dealt with in accordance with the laws of those States providing for the punishment of criminals engaged in exciting servile insurrection. The enlisted soldiers I shall continue to treat as unwilling instruments in the commission of these crimes, and shall direct their discharge and return to their homes on the proper and usual parole.

In its political aspect this measure possesses great significance, and to it in this light I invite your attention. It affords to our whole people the complete and crowning proof of the true nature of the designs of the party which elevated to power the present occupant of the Presidential chair at Washington and which sought to conceal its purposes by every variety of artful device and by the perfidious use of the most solemn and repeated pledges on every possible occasion. I extract in this connection as a single example the following declaration, made by President Lincoln under the solemnity of his oath as Chief Magistrate of the United States, on the 4th of March, 1861:

Apprehension seems to exist among the people of the Southern States that by the accession of a Republican Administration their property and their peace and personal security are to be endangered. There has never been any reasonable cause for such apprehensions. Indeed, the most ample evidence to the contrary has all the while existed and been open to their inspection. It is found in nearly all the published speeches of him who now addresses you. I do but quote from one of those speeches when I declare that I have no purpose, directly or indirectly, to interfere with the institution of slavery in the States where it exists. I believe I have no lawful right to do so; and I have no inclination to do so. Those who nominated and elected me did so with full knowledge that I had made this and many similar declarations and have never recanted them. And more than this, they placed in the platform for my acceptance and as a law to themselves and to me the clear and emphatic resolution which I now read:

"Resolved, That the maintenance inviolate of the rights of the States, and especially the right of each State to order and control its own domestic institutions according to its own judgment exclusively, is essential to that balance of powers on which the perfection and endurance of our political fabric depend; and we denounce the lawless invasion by armed force of the soil of any State or Territory, no matter under what pretext, as among the gravest crimes."

Nor was this declaration of the want of power or disposition to interfere with our social system confined to a state of peace. Both before and after the actual commencement of hostilities the President of the United States repeated in formal official communication to the Cabinets of Great Britain and France that he was utterly without constitutional power to do the act which he has just committed, and that in no possible event, whether the secession of these States resulted in the establishment of a separate Confederacy or in the restoration of the Union, was there any authority by virtue of which he could either restore a disaffected State to the Union by force of arms or make any change in any of its institutions. I refer especially for verification of this assertion to the dispatches addressed by the Secretary of State of the United States, under direction of the President, to the ministers of the United States at London and Paris, under date of 10th and 22d of April, 1861.

The people of this Confederacy, then, cannot fail to receive this proclamation as the fullest vindication of their own sagacity in foreseeing the uses to which the dominant party in the United States intended from the beginning to apply their power, nor can they cease to remember with devout thankfulness that it is to their own vigilance in resisting the first stealthy progress of approaching despotism that they owe their escape from consequences now apparent to the most skeptical. This proclamation will have another salutary effect in calming the fears of those who have constantly evinced the apprehension that this war might end by some reconstruction of the old Union or some renewal of close political relations with the United States. These fears have never been shared by me, nor have I ever been able to perceive on what basis they could rest. But the proclamation affords the fullest guarantee of the impossibility of such a result; it has established a state of things which can lead to but one of three possible consequences—the extermination of the slaves, the exile of the whole white population from the Confederacy, or absolute and total separation of these States from the United States.

This proclamation is also an authentic statement by the Government of the United States of its inability to subjugate the South by force of arms, and as such must be accepted by neutral nations, which can no longer find any justification in withholding our just claims to formal recognition. It is also in effect an intimation to the people of the North that they must prepare to submit to a separation, now become inevitable, for that people are too acute not to understand that a restoration of the Union has been rendered forever impossible by the adoption of a measure which from its very nature neither admits of retraction nor can coexist with union.

Among the subjects to which your attention will be specially devoted during the present session you will no doubt deem the adoption of some comprehensive system of finance as being of paramount importance. The increasing public debt, the great augmentation in the volume of the currency, with its necessary concomitant of extravagant prices for all articles of consumption, the want of revenue from a taxation adequate to support the public credit, all unite in admonishing us that energetic and wise legislation alone can prevent serious embarrassment in our monetary affairs. It is my conviction that the people of the Confederacy will freely meet taxation on a scale adequate to the maintenance of the public credit and the support of their Government. When each family is sending forth its most precious ones to meet exposure in camp and death in battle, what ground can there be to doubt the disposition to devote a tithe of its income, and more, if more be necessary, to provide the Government with means for insuring the comfort of its defenders? If our enemies submit to an excise on every commodity they produce and to the daily presence of the tax-gatherer, with no higher motive than the hope of success in their wicked designs against us, the suggestion of an unwillingness on the part of this people to submit to the taxation necessary for the success of their defense is an imputation on their patriotism that few will be disposed to make and that none can justify.

The legislation of your last session, intended to hasten the funding of outstanding Treasury notes, has proved beneficial, as shown by the returns annexed to the report of the Secretary of the Treasury. But it was neither sufficiently prompt nor far-reaching to meet the full extent of the evil. The passage of some enactment carrying still further the policy of that law by fixing a limitation not later than the 1st of July next to the delay allowed for funding the notes issued prior to the 1st of December, 1862, will, in the opinion of the Secretary, have the effect to withdraw from circulation nearly the entire sum issued previous to the last-named date. If to this be added a revenue from adequate taxation, and a negotiation of bonds guaranteed proportionately by the several States, as has already been generously proposed by some of them in enactments spontaneously adopted, there is little doubt that we shall see our finances restored to a sound and satisfactory condition, our circulation relieved of the redundancy now productive of so many mischiefs, and our credit placed on such a basis as to relieve us from further anxiety relative to our resources for the prosecution of the war.

It is true that at its close our debt will be large; but it will be due to our own people, and neither the interest nor the capital will be exported to distant countries, impoverishing ours for their benefit. On the return of peace the untold wealth which will spring from our soil will render the burden of taxation far less onerous than is now supposed, especially if we take into consideration that we shall then be free from the large and steady drain of our substance to which we were subjected in the late Union through the instrumentality of sectional legislation and protective tariffs.

I recommend to your earnest attention the whole report* of the Secretary of the Treasury on this important subject, and trust that your legislation on it will be delayed no longer than may be required to enable your wisdom to devise the proper measures for insuring the accomplishment of the objects proposed.

The operations of the War Department have been in the main satisfactory. In the report of the Secretary, herewith submitted, will be found a summary of many memorable successes. They are with justice ascribed in large measure to the reorganization and re-enforcement of our armies under the operation of the enactments for conscription. The wisdom and efficacy of these acts have been approved by results, and the like spirit of unity, endurance, and self-devotion in the people, which has hitherto sustained their action, must be relied on to assure their enforcement under the continuing necessities of our situation. The recommendations of the Secretary to this effect are tempered by suggestions for their amelioration, and the subject deserves the consideration of Congress. For the perfection of our military organization no appropriate means should be rejected, and on this subject the opinions of the Secretary merit early attention. It is gratifying to perceive that under all the efforts and sacrifices of war the power, means, and resources of the Confederacy for its successful prosecution are increasing. Dependence on foreign supplies is to be deplored, and should, as far as practicable, be obviated by the development and employment of internal resources. The peculiar circumstances of the country, however, render this difficult and require extraordinary encouragements and facilities to be granted by the Government. The embarrassments resulting from the limited capacity of the railroads to afford transportation and the impossibility of otherwise commanding and distributing the necessary supplies for the armies render the control of the roads under some general supervision and resort to the power of impressment military exigencies. While such powers have to be exercised, they should be guarded by judicious provisions against perversion or abuse and be, as recommended by the Secretary, under due regulation of law.

I specially recommend in this connection some revision of the exemption law of last session. Serious complaints have reached me of the inequality of its operation from eminent and patriotic citizens, whose opinions merit great consideration, and I trust that some means will be devised for leaving at home a sufficient local police without making discriminations, always to be deprecated, between different classes of our citizens.

Our relations with the Indians generally continue to be friendly. A portion of the Cherokee people have assumed an attitude hostile to the Confederate Government, but it is gratifying to be able to state that the mass of intelligence and worth in that nation have remained true and loyal to their treaty engagements. With this exception there have been no important instances of disaffection among any of the friendly nations and tribes. Dissatisfaction recently manifested itself among certain portions of them, but this resulted from a misapprehension of the intentions of the Government in their behalf. This has been removed and no further difficulty is anticipated.

The report of the Secretary of the Navy, herewith transmitted, exhibits the progress made in this branch of the public service since your adjournment as well as its present condition. The details embraced in it are of such a nature as to render it, in my opinion, incompatible with the public interests that they should be published with this message. I therefore confine myself to inviting your attention to the information therein contained.

The report of the Postmaster-General shows that during the first postal year under our Government, terminating on the 30th of June last, our revenues were in excess of those received by the former Government in its last postal year, while the expenses were greatly decreased. There is still, however, a considerable deficit in the revenues of the Department as compared with its expenses, and although the grants already made from the general Treasury will suffice to cover all liabilities to the close of the fiscal year ending on the 30th of June next, I recommend some legislation, if any can be constitutionally devised, for aiding the revenues of that Department during the ensuing fiscal year, in order to avoid too great a reduction of postal facilities. Your attention is also invited to numerous other improvements in the service recommended in the report, and for which legislation is required.

I recommend to the Congress to devise a proper mode of relief to those of our citizens whose property has been destroyed by order of the Government, in pursuance of a policy adopted as a means of national defense. It is true that full indemnity cannot now be made, but some measure of relief is due to those patriotic citizens who have borne private loss for the public good, whose property in effect has been taken for public use, though not directly appropriated.

Our Government, born of the spirit of freedom and of the equality and independence of the States, could not have survived a selfish or jealous disposition, making each only careful of its own interest or safety. The fate of the Confederacy, under the blessing of Divine Providence, depends upon the harmony, energy, and unity of the States. It especially devolves on you, their representatives, as far as practicable, to reform abuses, to correct errors, to cultivate fraternity, and to sustain in the people a just confidence in the Government of their choice. To that confidence and to the unity and self-sacrificing patriotism hitherto displayed is due the success which has marked the unequal contest, and has brought our country into a condition at the present time such as the most sanguine would not have ventured to predict at the commencement of our struggle. Our armies are larger, better disciplined, and more thoroughly armed and equipped than at any previous period of the war. The energies of a whole nation devoted to the single object of success in this war have accomplished marvels, and many of our trials have, by a beneficent Providence, been converted into blessings. The magnitude of the perils which we encountered have developed the true qualities and illustrated the heroic character of our people, thus gaining for the Confederacy from its birth a just appreciation from the other nations of the earth. The injuries resulting from the interruption of foreign commerce have received compensation by the development of our internal resources. Cannon crown our fortresses that were cast from the products of mines opened and furnaces built during the war. Our mountain caves yield much of the niter for the manufacture of powder, and promise increase of product. From our own foundries and laboratories, from our own armories and workshops, we derive in a great measure the warlike material, the ordnance and ordnance stores which are expended so profusely in the numerous and desperate engagements that rapidly succeed each other. Cotton and woolen fabrics, shoes and harness, wagons and gun carriages are produced in daily increasing quantities by the factories springing into existence. Our fields, no longer whitened by cotton that cannot be exported, are devoted to the production of cereals and the growth of stock formerly purchased with the proceeds of cotton. In the homes of our noble and devoted women, without whose sublime sacrifices our success would have been impossible, the noise of the loom and of the spinning wheel may be heard throughout the land. With hearts swelling with gratitude let us, then, join in returning thanks to God, and in beseeching the continuance of His protecting care over our cause and the restoration of peace with its manifold blessings to our beloved country.
