John Tyler to James Buchanan, Saturday Evening, February 9, 1861

Saturday evening, February 9, 1861.

MY DEAR SIR: I communicated to Governor Pickens what passed between us as to Mr. Holt's letter, and I am happy to say that the reply, received a moment ago, leaves me no ground to fear any early disturbance. The whole subject is referred to the convention at Montgomery, as I plainly infer. The conclusion is in these words: "Everything which can be done consistently with the honor and safety of this State, to avoid collision and bloodshed, has been and will be the purpose of the authorities here."

Thus, my dear sir, the inquietude you expressed may be dismissed.

BROWN'S HOTEL, WASHINGTON, February 13, 1861.

I have a moment to myself just before tea, and I may have time to write you in haste something of the doings here. Since I last wrote, I have not been allowed a moment's leisure. When within the hotel it has been an incessant stream of company, and then I have had visits to return, the Capitol to visit, etc., etc. Last night I attended, with the President, the party of Senator Douglas, and I met in the throng my old friend, Mrs. Dixon, who, by the way, looked so well that the President thought her the handsomest person in the room. She had early called, but I was out, as was the case with her when I called. She was, of course, charmed to meet me again. We are all the time surrounded, and had greetings from old, and introductions to new acquaintances without number. People turned up, and recalled themselves to me that I certainly never expected to have met again. I saw and shook hands with two Messrs. Griswold. Mr. Bancroft (the historian) claimed relationship with me through the Chandlers, who married a Miss Gardiner, of Gardiner's Island. I paraded the rooms with the handsomest man here, Governor Morehead, of Kentucky—one of the best likenesses of Papa you ever saw in appearance, voice, laugh, and manner. I suppose I may conclude that I looked quite well. No attempts at entertainments have succeeded before, I was told, this winter, and to the hopes that are placed upon the efforts of this Peace Convention is to be attributed the success of this.

People are catching at straws as a relief to their pressing anxieties, and look to the Peace Commissioners, as if they possessed some divine power to restore order and harmony. Here you can realize more than anywhere else the distracted state of the country. In the Peace Conference a committee are engaged (one from each State) in the preparation of a plan of adjustment, and when they report, which will be on Friday, the end I suppose can be foreseen. In the meantime all is suspense, from the President down. The New York and Massachusetts delegation will no doubt perform all the mischief they can; and it may be, will defeat this patriotic effort at pacification. But whether it succeeds or not, Virginia will have sustained her reputation, and in the latter event will retire with dignity from the field to join without loss of time her more Southern sisters; the rest of the slave Border States will follow her lead, and very likely she will be able to draw off, which would be glorious, a couple of Northern States. It is to be hoped that this state of suspense, which is bringing disaster to trade everywhere, will soon be removed in one way or another.

The President has hundreds of letters of the enclosed description, which I enclose you because it is from Mr. Beeckman's son-in-law.

Mr. Buchanan (the President) spent the evening in our parlor evening before last. I suppose it is the first visit he has paid since being the nation's chief. He first wrote the President a letter full of gratitude for the relief he had afforded him in probably preventing, through his influence at Charleston, the attack on Fort Sumter. Miss Lane and Miss Ellis called upon me yesterday. If the President is detained here indefinitely, I shall run home. I want to be with my children. Probably I shall go on Friday, unless I hear from home in the meantime to my satisfaction. Old Mrs. Hilliard, of Troy, called upon me this morning; she spoke of Miss Mary Gardiner, of Gardiner's Island, having been at her school. Mrs. Catron is quite sick; but I must conclude. I have so much to say of persons and events, and no time to say it in. . . . With love to all.

MY DEAR SIR: I dispatched the telegram at about five o'clock. No answer yet. Perhaps it was referred to Montgomery, or time may not have been given to respond before the close of the office. A consultation of cabinet may have been required. In short, many things of a similar nature may have occurred. General Davis will be written to to-day. No attack can be made without orders from Montgomery.

BROWN'S HOTEL, February 24, 1861.

MY DEAR SIR: I think you may rely upon tranquillity at the South. Since you left me I have made particular inquiries. General Davis has been written to. He is advised to send a commissioner, and to go to Charleston himself to represent and quiet all things. In fact, from information from one directly from Richmond, and who travelled with merchants from the South going North, the probability is that he is now in Charleston. The fact may probably be announced in the papers to-morrow. Every one that I have seen, secessionists and others, concur with myself in the improbability of any movement until a commissioner shall come on here, and a failure in the mission.

Speech of John Tyler to the Peace Congress, February 5, 1861

Gentlemen, I fear you have committed a great error in appointing me to the honorable position you have assigned me. A long separation from all deliberative bodies has rendered the rules of their proceedings unfamiliar to me, while I should find, in my own state of health, variable and fickle as it is, sufficient reason to decline the honor of being your presiding officer. But, in times like these, one has but little option left him. Personal considerations should weigh but lightly in the balance. The country is in danger; it is enough; one must take the place assigned him in the great work of reconciliation and adjustment. The voice of Virginia has invited her co-States to meet her in council. In the initiation of this Government, that same voice was heard and complied with, and the results of seventy-odd years have fully attested the wisdom of the decisions then adopted. Is the urgency of her call now less great than it was then? Our godlike fathers created, we have to preserve. They built up, through their wisdom and patriotism, monuments which have eternized their names. You have before you, gentlemen, a task equally grand, equally sublime, quite as full of glory and immortality. You have to snatch from ruin a great and glorious Confederation, to preserve the Government, and to renew and invigorate the Constitution. If you reach the height of this great occasion, your children's children will rise up and call you blessed. I confess myself to be ambitious of sharing in the glory of accomplishing this grand and magnificent result.

To have our names enrolled in the Capitol, to be repeated by future generations with grateful applause—this is an honor higher than the mountains, more enduring than the monumental alabaster. Yes, Virginia's voice, as in the olden time, has been heard. Her sister States meet her this day at the council board. Vermont is here, bringing with her the memories of the past, and reviving in the memories of all, her Ethan Allen and his demand for the surrender of Ticonderoga, in the name of the Great Jehovah and the American Congress. New Hampshire is here, her fame illustrated by memorable annals, and still more lately as the birthplace of him who won for himself the name of defender of the Constitution, and who wrote that letter to John Taylor which has been enshrined in the hearts of his countrymen. Massachusetts is not here. (Some member said "She is coming.") I hope so, said Mr. TYLER, and that she will bring with her her daughter Maine. I did not believe it could well be that the voice which in other times was so familiar to her ears had been addressed to her in vain. Connecticut is here, and she comes, I doubt not, in the spirit of ROGER SHERMAN, whose name with our very children has become a household word, and who was in life the embodiment of that sound practical sense which befits the great lawgiver and constructer of governments. Rhode Island, the land of ROGER WILLIAMS, is here, one of the two last States, in her jealousy of the public liberty, to give in her adhesion to the Constitution, and among the earliest to hasten to its rescue. The great Empire State of New York, represented thus far but by one delegate, is expected daily in fuller force to join in the great work of healing the discontents of the times and restoring the reign of fraternal feeling. New Jersey is also here, with the memories of the past covering her all over. Trenton and Princeton live immortal in story, the plains of the last incrimsoned with the hearts blood of Virginia's sons. Among her delegation I rejoice to recognize a gallant son of a signer of the immortal Declaration which announced to the world that thirteen Provinces had become thirteen independent and sovereign States. And here, too, is Delaware, the land of the BAYARDS and the RODNEYS, whose soil at Brandywine was moistened by the blood of Virginia's youthful MONROE. Here is Maryland, whose massive columns wheeled into line with those of Virginia in the contest for glory, and whose state house at Annapolis was the theatre of the spectacle of a successful Commander, who, after liberating his country, gladly ungirthed his sword, and laid it down upon the altar of that country. Then comes Pennsylvania, rich in revolutionary lore, bringing with her the deathless names of FRANKLIN and MORRIS, and, I trust, ready to renew from the belfry of Independence Hall the chimes of the old bell, which announced Freedom and Independence in former days. All hail to North Carolina! with her Mecklenberg Declaration in her hand, standing erect on the ground of her own probity and firmness in the cause of public liberty, and represented in her attributes by her MACON, and in this assembly by her distinguished son at no great distance from me. Four daughters of Virginia also cluster around the council board on the invitation of their ancient mother—the eldest, Kentucky, whose sons, under the intrepid warrior ANTHONY WAYNE, gave freedom of settlement to the territory of her sister, Ohio. She extends her hand daily and hourly across la belle riviere, to grasp the hand of some one of kindred blood of the noble states of Indiana, and Illinois, and Ohio, who have grown up into powerful States, already grand, potent, and almost imperial. Tennessee is not here, but is coming—prevented only from being here by the floods which have swollen her rivers. When she arrives, she will wear the badges on her warrior crest of victories won in company with the Great West on many an ensanguined plain, and standards torn from the hands of the conquerors at Waterloo. Missouri, and Iowa, and Michigan, Wisconsin, and Minnesota, still linger behind, but it may be hoped that their hearts are with us in the great work we have to do.

Gentlemen, the eyes of the whole country are turned to this assembly, in expectation and hope. I trust that you may prove yourselves worthy of the great occasion. Our ancestors, probably, committed a blunder in not having fixed upon every fifth decade for a call of a general convention to amend and reform the Constitution. On the contrary, they have made the difficulties next to insurmountable to accomplish amendments to an instrument which was perfect for five millions of people, but not wholly so as to thirty millions. Your patriotism will surmount the difficulties, however great, if you will but accomplish one triumph in advance, and that is, a triumph over party. And what is party, when compared to the work of rescuing one's country from danger? Do that, and one long, loud shout of joy and gladness will resound throughout the land.

Congressman Charles S. Morehead to Senator John J. Crittenden, March 30, 1850

WASHINGTON, March 30, 1850.

MY DEAR SIR,—I received your letter of the 19th inst., for which I am very much obliged to you. All that is done here is so fully detailed in the daily papers that I need not attempt to give you an account of it. We are proceeding slowly with the debate on the absorbing topic growing out of our territorial acquisitions. I begin to believe that the whole question will be satisfactorily settled by admitting California as a State and making territorial governments for the residue of the country without the proviso. I regret, however, to state that we can hope for very little, if any, aid from the Whigs of the North in the House. I do not know one man that we can certainly count. There were eight or ten who promised to go with us, but I have reason to believe that the cabinet influence has drawn them off. Ewing and Meredith have evidently much feeling on the subject. Clayton, Crawford, Preston, and Johnson, I understand, will go for territorial bills. It is understood that General Taylor himself would be glad if such bills can be passed without the proviso, and would prefer such a settlement to the non-action policy. I cannot, however, speak from any personal knowledge on this subject. I have no doubt, however, as to the four members of the cabinet I have named. Indeed, it is indispensably necessary that it should be settled on this basis. There is not one single man from any slaveholding State who would agree to any other settlement, and I fear the very worst consequences from any attempt to force through the California bill without a full settlement. Fifty members, under our rules, can prevent the bill from being reported from the committee of the whole, where it now is, to the House. But I believe we have a decided majority for such a settlement as the South demands. There are twenty-nine Democrats from the North pledged to go with us. McClernand, from Illinois, has prepared a bill upon general but private consultation, embracing all the points of difference, and will offer it as a substitute, in a few days, to the California bill. If General Taylor would take open ground for a full settlement, we could get ten or twelve Whigs from the North. I believe he only wants a suitable occasion to do so. I never have in my life had so deep and abiding a conviction upon any subject as at this moment of the absolute necessity of a settlement of this whole question. I am pained to say that I fear that there are some Southern men who do not wish a settlement. We have certainly something to fear from this source, but they are so few that I think we can do without them.

The cabinet, as you might well imagine from the present state of things, receives no support from any quarter. John Tyler had a corporal's guard who defended him manfully, but the cabinet has not one man that I can now name. Each member of the cabinet has a few friends, but I do not know one man who can be called the friend of the cabinet. I apprehend that they are not even friendly to each other. You may have noticed in the Union, if you ever read it, a charge against Ewing for having allowed a very large claim in which Crawford was interested personally to the extent of one hundred and seventeen thousand dollars. It turned out that Mr. Ewing had nothing to do with it; that Whittlesey reported that there was nothing due, and Meredith, in accordance with the opinion of the Attorney-General, allowed it. Now, Ewing, if I am not mistaken (but conjecture on my part, I acknowledge), through his friends is attacking Crawford for having a claim acted on in which he was interested while a member of the cabinet. Upon the whole, I am clearly of opinion that there is but one safe course for General Taylor to pursue, and that is to reconstruct his whole cabinet. I am perfectly satisfied that he cannot carry on the government with his present ministers. Your name and that of Winthrop and of Webster have been spoken of as Secretary of State in the event of a change; but if I had to make a full cabinet I could not do it satisfactorily to myself. I am inclined to think that Mr. Webster would like to be Secretary of State, not from anything I ever heard him say but from occasional remote intimations from his friends. Just at this time his appointment would be exceedingly popular in the South. I wish most sincerely that you were here. We are altogether in a sad, sad condition. There is no good feeling between Mr. Clay and General Taylor, and I am afraid that meddling and busybodies are daily widening the breach. keep entirely aloof, taking especial and particular pains to participate in no manner whatever in the feeling on the one side or the other. I hear all, at least on one side, and try always to reconcile rather than widen the breach. I have sometimes, however, thought that a want of confidence in me resulted from the fact of my being his immediate representative. I may be mistaken—probably am; it may arise altogether from a less flattering consideration. At all events, I have never been able to converse one minute with the President upon politics without his changing the subject, so that when I see him now I never, in the remotest manner, allude to political matters.

John Tyler to Caleb Cushing, December 14, 1860

SHERWOOD FOREST, Dec. 14, 1860.

MY DEAR SIR: I thank you most sincerely for your most eloquent and able speech, delivered before the good people of Newburyport, on the critical condition of public affairs. The strongest evidence of the madness of the times is to be found in the fact that an address so unanswerable, so patriotic, so every way calculated to arrest the downward tendency of the country, does not at once tell on the hearts and minds of the good people of Massachusetts. They, however, still seem to slumber on, and are so deaf as not to hear the unmistakable mutterings of the storm which is destined so soon to break forth.

I confess that I am lost in perfect amazement at the lunacy which seems to have seized on the North. What imaginable good is to come to them by compelling the Southern States into secession? I see great benefits to foreign governments, but nothing but prostration and woe to New England. Virginia looks on for the present with her arms folded, but she only bides her time. Despondency will be succeeded by action.

My own mind is greatly disturbed. I look around in every direction for a conservative principle, but I have so far looked in vain. I have thought that a consultation between the Border States, free and slaveholding, might lead to adjustment. It would embrace six on each side. They are most interested in keeping the peace, and, if they cannot come to an understanding, then the political union is gone, as is already, to a great extent, the union of fraternal feeling. When all things else have failed, this might be tried. It would be a dernier resort.

I shall be most happy at all times to hear from you, and assure you of my high esteem and warm personal friendship.

John Tyler to Colonel David L. Gardiner, January 1, 1861

SHERWOOD FOREST, Jan. 1, 1861.

MY DEAR COLONEL: I am deeply concerned at the condition of public affairs. No ray of light yet appears to dispel the gloom which has settled upon the country. In the meantime the President pursues a wise and statesmanlike course. A blow struck would be the signal for united action with all the slave States, whereas the grain States of the border are sincerely desirous of reconciling matters and thereby preserving the Union. I have for some time thought that a conference between the Border slaveholding and notslaveholding States would result in harmony, if it could obtain. They are so deeply interested in preserving friendly relations that they would agree, if agreement be possible. I see that a movement of that sort has been originated in Washington. A day or two will disclose the result. I like also the movement of New Jersey, which seeks to ascertain through her commissioners the ultimatum of the cotton States, to be submitted to the Northern States. In a short time we shall know the doom of the Union. The low price at which the recent loan for the Government was contracted is of fearful augury. A loss of 37 per cent. on a small loan of 2,500,000 manifests a want of confidence in the stability of the Union of an alarming character. I hope, however, that the kind Providence which has so far protected us will open a way to peace and harmony.

DEAR ROBERT: The pressure on me for my opinions on the crisis leaves me no alternative. My views will be published in the Enquirer and Whig, I hope on Wednesday, certainly on Friday. Look out for the article. I think it will strengthen our friends in the North. I have no time for further remark.

John Tyler to Robert Tyler, January 18, 1861

SHERWOOD FOREST, January 18, 1861.

MY DEAR ROBERT: . . . . . . My paper did not come out in the Richmond papers on Tuesday as I expected. I suppose it reached Richmond on Monday too late for the press. I recommended a meeting of the Border States through commissioners. The course of the Pennsylvania and Ohio Legislatures, made known to me on yesterday, leaves but little hope of any adjustment.

The Legislature of Virginia have so trammelled their convention bill that I fear that we shall have a doubtful result. They talk hereabouts of sending me to the convention. Should the application be made formally, I shall find difficulty in refusing; and yet I in no way desire it. My hope is that they will select some other. Compromise seems to be more distant every day. The fate of Crittenden's project, I suppose, will nearly conclude matters. Keep me advised about movements in Pennsylvania.

I am better in the last two days, but still infirm.

John Tyler to Governor John Letcher, January 31, 1861

To the Governor of the State of Virginia:

DEAR SIR,

SHERWOOD FOREST,

January 31, 1861.

I received your communication notifying me of my appointment by the concurrent vote of the two houses of the General Assembly, as a commissioner to the President of the United States, with instructions respectfully to request the President to abstain, pending the proceedings contemplated by the action of the General Assembly, from any and all acts calculated to produce a collision of arms between the States which have seceded or shall secede, and the government of the United States, on the afternoon of Monday, the 21st instant, by the mail of that day, and in disregard of a severe state of indisposition under which I had labored for some time previous, I resolved at all hazards to myself personally to carry out, so far as I could, the patriotic wishes of the Legislature. By the earliest conveyance, I reached Richmond on the evening of the succeeding day (Tuesday, 22d), and having had an interview with your excellency and my co-commissioner, proceeded by the morning train of cars the next day (Wednesday, 23d) for the city of Washington, which I reached on the afternoon of the same day. I am thus particular in giving precise dates, so that the Legislature may perceive that with all possible promptitude and dispatch I obeyed their wishes; and also to show that I was duly sensible of the importance of time in the whole proceeding. Immediately after reaching Washington, I addressed a note (marked No. 1) to the President of the United States, informing him of my arrival and asking an early hour to be designated by him, to enable me to place him in possession of the wishes and feelings of the Legislature of Virginia, and the instructions which, in the form of her legislative resolves, all having direct reference to the disturbed and painful condition of public affairs, I was desirous of laying before him. He responded promptly by note, and left it optional with myself to select 8 o'clock of that evening, or an early hour the next morning, for the time of the proposed conference. My note (No. 2), for reasons therein set forth, informed him that I would wait upon him in the morning of the ensuing day. My note announcing my arrival, if the objects which had brought me to Washington had any consideration in the mind of the President would, I did not doubt, suspend any hostile movement against any seceding State in the interval of time between its date and the hour at which I should wait upon him the next morning, and supersede the necessity of a night visit.

On the next morning, at the hour of ten, I repaired to the President's mansion, and met from him a warm and cordial reception. I lost no time in handing to him your letter of appointment, attested by the seal of the State, and legislative resolutions. He said that they were the first full copies of the resolutions which he had seen, and after reading them he remarked, that he considered them very important, and was good enough to add, that being borne by myself, he should feel it his duty to make them the subject of a special message to Congress. Either I suggested or he voluntarily remarked, most probably the latter, that he should accompany them with a strong recommendation to Congress, with whom, he said, rested the entire power over the subject of war or peace, to abstain from all action of a hostile character, until Virginia should have had a fair opportunity to exert all her efforts to preserve the public peace and restore harmony to the Union. I said to him, that my mission was to him; that he was commander-in-chief of the army and navy—could regulate the movement of soldiers and ships in peace and war, and that everything that Virginia desired was that the statu quo should be observed. I represented to him that the people of Virginia were almost universally inclined to peace and reconciliation. That I need not inform him of the sacrifices the State had made for the Union in its initiation, or of her instrumentality in the creation of the Constitution. That her efforts to reconstruct or preserve depended for their success on her being permitted to conduct them undisturbed by outside collision. He replied, that he had in no measure changed his views as presented in his annual message; that he could give no pledges; that it was his duty to enforce the laws, and the whole power rested with Congress. He complained that the South had not treated him properly; that they had made unnecessary demonstration by seizing unprotected arsenals and forts, and thus perpetrating acts of useless bravado, which had quite as well been let alone. I suggested to him, that while these things were, I admitted, calculated to fret and irritate the northern mind, that he would see in them only the necessary results of popular excitement, which, after all, worked no mischief in the end, if harmony between the States was once more restored; that the States wherein the seizures had been made, would account for all the public property; and that in the mean time the agency for its preservation was only changed. He repeated his sense of the obligations which rested upon him; could give no pledges but those contained in his public acts, and recurred again to the proceedings of the Legislature and his intention to send them to Congress in a special message, accompanied with a strong recommendation to avoid the passage of any hostile legislation. I asked if I might be permitted to see the sketch of the message, to which he unhesitatingly replied that he would take pleasure in showing it to me next morning. Much more occurred in the course of our interview, which lasted for an hour and a half; all, however, relating exclusively to the above topics, and I left him entirely satisfied with the results of my interview. The President was frank and entirely confiding in his language and whole manner. A moment's reflection satisfied me that if the message contained the recommendation to Congress to abstain from hostile legislation, I was at liberty to infer a similar determination on his part of a state of quietude.

Friday, 25.—I waited on him again the following morning, and he lost no time in reading me so much of the sketch of the proposed message as related to the recommendation to Congress. I suggested no change or alteration, believing it to be amply sufficient, and I became only anxious for its presentation to Congress. He said he should have it all prepared to be submitted to his Cabinet on that day, and would send it in the next day. On the afternoon of the same day—Friday, 25—I was waited upon by the Secretary of State and the Attorney General, who stated that they had called upon me at the request of the President, to express his regret that in consequence of the adjournment over to Monday, he would not be able to send in his message until Monday. While in conversation with those gentlemen, which chiefly turned on the condition of public affairs, I was startled by the receipt of a telegraphic despatch from Judge Robertson, my co-commissioner, dated at Charleston, South Carolina, enquiring into the foundation of a rumor which had reached that place, that the steamship Brooklyn, with troops, had sailed for the South from Norfolk. I immediately handed over the despatch to the gentlemen, with the suitable enquiries. The Attorney General said, in substance: "You know, sir, that I am attached to the law department, and not in the way of knowing anything about it." The Secretary of State said that he had heard and believed that the Brooklyn had sailed with some troops, but he did not know either when she sailed or to what point she was destined. I then said, "I hope that she has not received her orders since my arrival in Washington." On this point the gentlemen could give me no information, but expressed no doubt but that the President would give me the information if requested. I excused myself to them, and immediately withdrawing to the adjoining room, I addressed to the President note No. 3, which Mr. Staunton, the Attorney General, kindly volunteered to bear in person, and without loss of time, to the President. In a short time afterwards, Mr. Staunton returned, to inform me that he had carried the note to the President's house, but for a reason not necessary here to state, he could not see the President, but had placed it in the hands of his servant, to be delivered at the earliest opportunity. The reply of the President, No. 2, reached me at half after eleven o'clock that night. In the interim, I had despatched by telegraph, to Judge Robertson, the information I had collected, and upon the opening of the telegraph office the next morning (Saturday), the material parts of the President's reply relating to the sailing of the Brooklyn, viz: that she had gone on an errand "of mercy and relief," and that she was not destined to South Carolina. The orders for the sailing of the ship, as will be seen, were issued before I reached Washington. After receiving the letter, and willingly adopting the most favorable construction of its expressions, I resolved to remain in Washington until after Monday, when the message would go to the two houses. I listened to its reading in the Senate with pleasure, and can only refer to the newspapers for its contents, as no copies were printed and obtainable by me, before I left Washington, on Tuesday morning, the 29th instant. On Monday afternoon I bade my adieu to the President in the accompanying letters, marked No. 4, to which I received his reply, marked No. 3.

The morning newspapers contained the rumor that the proceeding had been adopted of mounting guns on the land side of Fortress Monroe, and in my letter I deemed it no way inappropriate to call the attention of the President to those rumors.

Thus has terminated my mission to the President under the legislative resolutions. I trust that the result of the Brooklyn's cruise may terminate peacably. No intimation was given me of her having sailed in either of my interviews with the President, and all connected with her destination remains to me a State secret. I had no right to require to be admitted into the inner vestibule of the Cabinet, however much I might complain should the results prove the errand of the ship from the first to have been belligerent and warlike.

MY DEAR SIR: Your letter was duly received, and I thank you for the enclosure. We will talk it over at another time. I have not found it necessary to call in the aid of New Jersey. I resolved to await the results of my first interview with the President before I did so, and that satisfied me that it could all be arranged without the intervention of a third party, and after a manner the most acceptable to me, as it implied a high compliment to the Legislature. He will on Monday send in a special message, communicating to Congress the resolutions, making them the basis of an emphatic recommendation for abstaining from the passage of any measure of a hostile character by that body. The inference, of course, is plain, that what he recommends Congress to do he will do himself. His policy obviously is to throw all responsibility off of his shoulders.

I shall consider myself at full liberty to return home after the message goes in, unless dispatches from the Judge, or something transpiring here, shall require a prolongation of my stay. If the weather is mild I may reach Richmond by the Monday night train.

The sailing of the Brooklyn startled me much, but the President assures me that the orders for her sailing were dispatched before I reached here,—that she is not destined for Charleston, but goes on an errand of mercy and relief. She certainly has troops on board, and I doubt not is designed for Pensacola, the troops for Fort Pickens. Mr. Clay, of Alabama, thinks that there will be no collision until after the 10th February, when the cotton States meet in convention at Montgomery.

MY DEAR SIR: I leave the city to-morrow morning for the brief interval that elapses between this and the meeting of the commissioners on the 4th of February. In making my adieu, which I should do in person but for engagements which prevent, I desire to express my pleasure at hearing your message read to-day in the Senate, and to tender my acknowledgments for the facilities you afforded me of acquitting myself of the mission with which my State entrusted me. I feel but one regret in all that has occurred, and that is the sailing of the Brooklyn under orders issued before my arrival in this city. I hope, however, she sailed with such instructions as, if followed, will prevent any collision. There is nothing I more sincerely desire than that your administration may close amidst the rejoicings of a great people at the consummation of the work of a renewed and more harmonious confederacy.

Will you pardon me for calling your attention to the rumors current in the newspapers of the morning, which state that active proceedings are in course of execution at Fortress Monroe, in planting cannon on the land side of the fort, with their muzzles pointing landward and overlooking the country? If this be so, Mr. President, is such a proceeding either appropriate or well-timed? I shall do no more than call your attention to the circumstance, and leave it without comment, with this single remark, that when Virginia is making every possible effort to redeem and save the Union, it is seemingly ungenerous to have cannon levelled at her bosom.

I hasten to write you this evening of my arrival, with the President, Alex., baby and Fanny. . . . I had several reasons for coming, apart from such enjoyments as you think I shall be disappointed in finding. To be on hand at such a trying and exciting time to the President, and observe and listen to the doings of the convention, which has for me the most intense interest. Perhaps I am here during the last days of the Republic. Everything in the political world is calculated to interest me, and I do not expect or desire gay entertainments under such circumstances as exist. A note has just been handed in to a dinner at Douglas' on Tuesday. . . I don't know that we shall accept. I was really in hopes to find you here on our arrival, and am really sorry to have hoped in vain. I sent this evening to enquire for a box at the express office, but it is not open to-day. I must send in the morning; peradventure you may have forwarded one.

The President has been surrounded with visitors from the moment he could appear to them, after refreshing himself with clean linen, etc. All the Virginia delegation, and a number of others, have just left, and he has retired upon a dose of hydrargum,1 quite tired out with the fatigues of the day; but he is in a stronger condition to bear up than for many a day, and looks well. They are all looking to him in the settlement of the vexed question. His superiority over everybody else is felt and admitted by all.

It would interest you to see how deferentially they gather around him. They will make him president of the Convention, I presume, from what I hear; but whether he will accept or not, is a question which his feelings at the time will determine. All of the South or border States will enter upon the deliberations with very little expectation of saving the Union, I think—there seems such a fixed determination to do mischief on the part of the Black Republicans. General Scott's absurd and high-handed course here in Washington is very much condemned. The rumor to-day is afloat that he is collecting there troops to overawe Virginia and Maryland. If the President concludes so, upon observation, I think he will recommend the Governor of Virginia to send five thousand troops at once to Alexandria to stand on the defensive side, and overawe General Scott's menacing attitude; but this is entre nous, and a "State secret."

We are very handsomely accommodated here—private parlors, etc. I left the children at home well, and, as you may suppose, everybody charged concerning them. Maria and Mrs. Clopton will keep a constant look-out and watch. . . .

The President's centre-table is loaded with correspondence from every quarter. There seems to be a general looking to him by those anxious to save the Union. I wish it might be possible for him to succeed in overcoming all obstacles. They all say, if through him it cannot be accomplished, it could not be through any one else. Mr. Rives remarked this evening that it was admitted his influence in the country at this time is in advance of all others. Mr. Barringer, of North Carolina, said to me to-day in the cars: "President Tyler has had the great happiness accorded him of living to see himself fully appreciated. All party feelings have faded away, and his old enemies are among his warmest friends."

MY DEAR MAMMA: I hastily write you a few lines before retiring. The box by express came safely to hand this morning. If I have occasion I will wear the articles mentioned in it, but I cannot say yet what will occur to make it worth while to bring them into use. I have had, as well as the President, a perfect levée all day, and am so tired that I must go to bed to be in good condition for a continuation to-morrow. You ought to hear all the compliments that are heaped upon me. Of course I haven't changed a bit, except to improve, etc., etc.

But the President is the great centre of attraction. Everybody says he is looked to save the Union. Mr. Crittenden told me to-night that he had great hopes through him. Gov. Morehead went off in a strain of eloquence, while in conversation with me, upon the immortality he would achieve for himself if he (the President) could bring all the discordant elements together. They met to-day, but only to appoint committees for the organization of the convention, and then adjourned.

The President has received a most important dispatch this evening from Montgomery, Ala. The convention there has adjourned over to await the action and result of this meeting. This shows a desire to conciliate and do what is right up to the last moment.

Mr. Crittenden tells me that Mrs. Crittenden is laid up with a sprained ankle. Mrs. Yulee and Mrs. Evans have been with me this evening,-also many others whom you would not know,—and our old friend Mr. Greenway has turned up again. Mrs. Yulee tells me her sister, Mrs. Merrick, has also met with the fashionable accident of a sprained ankle. Mrs. Clay, of Alabama, described to me the withdrawing scene in the Senate to-day of the Louisiana senators. She says Mr. Benjamin's speech was perfectly thrilling,—full of feeling and eloquence. . . . . How I wish you were here, but I suppose I must make up my mind to be satisfied with your coming to Sherwood.

The President is quite bright, bearing up wonderfully and looking remarkably well.

Views of Ex-President Tyler on the National Crisis.

To the Editor of the Whig:

I have been often urged to give my views to the public on the present great crisis of American affairs. I have abstained from doing so for reasons entirely satisfactory to myself—one of the most controlling of which was, that I could not regard with becoming composure the dissolution of that Confederacy in the service of which so great a portion of my life had been passed, and which I had been accustomed to contemplate in a spirit of the truest devotion. Nor did I believe that any thing that I could say would produce the slightest effect upon the public mind. My public life had long since terminated, and the shadow which, sooner or later, falls on all men, and shuts them out from sight had settled upon me. To the younger Athlete, who were in charge of the public trusts and enjoyed its confidence, I was well inclined to leave the task of adjusting existing difficulties, in the hope and trust that a Union so full of glories and so copious in blessings, would survive the trials which threaten it. In the meantime the high toned and gallant State of South Carolina, one of the Old Thirteen, has seen cause to withdraw from the Union, and it is said that her example is to be followed unless sectional differences are adjusted by the cotton States first, and sooner or later by all the slaveholding States. In view of this state of things, and seeing also that all efforts at adjustment have so far failed, I no longer withhold the expression of my opinions on the leading topics of the day.

The enquiry which presents itself, in advance of all others, is as to the effects which follow upon the withdrawal of so many states from the Union as those constituting an entire section of the country. In what condition does that withdrawal leave the remaining States and even the government itself? This enquiry is of the greatest interest and should therefore be made with all possible deliberation. It can do no less than resolve itself into the question as to the nature and character of the government itself. If it be a consolidated government, and the States merely its provinces, then those provinces or States or by whatever other name thy may be called, can make no resistance to its authority, however despotic, which would not be considered rebellious and treasonable. The States would occupy the same position, and none other, to the government of the United States, that each county or town occupies to the government of a state. The uprising of a county against the State would be unqualified rebellion and all concerned in it would be guilty of high treason. These are the inevitable results which arise out of a consolidated government. No matter what the magnitude of the evil complained of, no redress is left but out and out rebellion, and each and all engaged in such rebellion have entered into it with halters round their necks, to be used, unless the rebellion prove successful, by the consolidated government at its will and pleasure. It is idle, in this view of the question, to attempt to draw a distinction between a State in rebellion and any portion of the people of that State. The reasoning applies quite as forcibly to the whole community as to a part of it. No organized condition of the community can justify or excuse the revolt, and war may be made on all alike. Nor will it do to attempt a distinction between a Government like ours, where powers are granted and powers reserved, and an absolute despotism.—The same supreme domination would exist in the enforcement of the granted powers, as where nothing had been reserved and all given.—Whatever the obstruction interposed the authority would be given to remove it—if by individuals, they might be put to the sword—if by a State, it might be crushed. Is there no softening down the asperity of these conclusions? I am asked. I see no mode of doing so. Again, I may be asked, does not the constitution provide within itself some mode by which grievances, when too heavy to be borne, may be redressed? The Constitution professes to do so; but what chance is there of the remedies being available against an immovable sectional majority? Even now, an appeal to that mode of redress has been made in vain.—Every expedient has been resorted to, to obtain constitutional amendment in redress of grievances, through the action of Congress; but there stands that sectional majority, immovable or fixed, or only moving to make matters worse by suggestion the mere pretence of amendments which pass away in the moment of utterance.

No, if the Government be consolidated to the extent of the powers, it is supreme, and resistance to its mandates is treason. But, it is asked, cannot the Supreme Court, the sworn interpreter of the Constitution, give redress for violated rights? That august tribunal should ever be entitled to all respect; but in a sectional conflict, such as that which exists, its decisions, however solemnly delivered, carry no force along with them. Who, of the Northern sectional party, acknowledges the binding force of its decision recently pronounced in the Dred Scott case?—The venerable men who compose that Court, are of advanced age—as they drop off the state of actions. Mr. Lincoln will take care to supply their place, with men who would stand ready to reverse their decisions, and mock at them as of no binding authority. No, if the Government be a consolidated one, if its edicts, uttered by a sectional majority, are to be regarded as supreme, then those edicts are the decrees of fate, and submission of States and people is all that is left. From being considered the proudest and noblest structure of human liberty, it degenerates into the vilest instrument of tyranny and oppression. As indispensably necessary to arrive at the above conclusions as to the nature of the government, its advocates contend that it arose out of the popular will, and not from separate State action. It is only necessary to say that that position was entirely over-ruled, as long ago as 1800, by the decided voice of the American people, and only momentarily revived by Gen. Jackson’s proclamation, (a paper which contradicted all the expressed opinions of his previous and subsequent life,) avowedly written by one who still lingered among the ruins and fragments of antiquated ideas. It is contradicted by the name given the Government in baptism. The Federal Government it was called then, and as the Federal Government it is known to the world; and any dictionary will tell us that the name pertains only to a league—to a compact or political partnership among States. The Federal Legislature is known as a Congress, a term only used to indicate an assemblage of sovereigns; and that Federal Legislature is composed, especially in the Senate, of the representatives of the States equal in rights, and equal in power. There, the smallest State has a voice as potential as the largest. When the articles of confederation ceased to exist, they were succeeded by the present confederation—an improvement, as it was thought, upon the old one. But I abstain from going any further into this subject. I find the whole argument already perfected in the preamble to the resolutions recently adopted by thepeople of Botetourt, drawn by as clear a judicial intellect as is to be found either in the State of Virginia or out of it. In that preamble Judge Allen presents a synopsis of the history of the origin of our institutions, so briefly, yet so lucidly, as to have concluded the argument. It challenges an answer from any quarter. I wish it could be printed, and circulated until it was to be found in the hands of every man in the country.

The facts of history cannot be overcome, and those facts all bespeak the Confederative Republic, founded in a compact to which States were parties. No State thought, that in adopting it, it was imposing fetters upon its limbs, which, however galling, could never be broken. Some States, Virginia one of them, more cautions than the rest, accompanied their ratification with a declaration of the right to resume the powers granted for the peace of all and happiness of all, upon their being abused; and the pregnant fact that General Washington, the President of the General Convention, in his valedictory to the people, admonished them to avoid sectional divisions as the bane of the Union, bespeaks on his part a serious apprehension that the Union would fall asunder, not by any treasonable conduct on the part of his contrymen, surely, but the withdrawal of the States, legitimately and properly. Nor is there sufficient force to countervail the inductions drawn by Judge Allen in the Botetourt preamble, from the too great facility which would exist in overthrowing the Government. The right to secede should rather be regarded as a means of giving it perpetuity; as the acknowledged existence of such right would operate to restrain the conduct of majorities and officials. Secession would never be resorted to for the slight and insufficient causes, nor until after a long course of forbearance. Nothing is more difficult that to bring about a revolution or change of government. Take, in illustration, the calamity which is now impending over us. For thirty years some of the evils complained of by the South, have been existing, and have been increasing in magnitude, until they have culminated from abuse of the most rancorous kind, in Congress and out of Congress, in the pulpit and out of the pulpit, in short, everywhere, and in every conceivable shape, into a systematic sectional form and overruling organization. In the meantime, the Southern people have reasoned, expostulated and protested. So did they in the days preceding the revolution, but their expostulations had quite as well not have been uttered. So, in these latter days. In 1836, I remember to have received, through the Governor of the States of Virginia, a series of resolutions, which had been adopted by the Legislature, addressed to the Northern States, complaining of wrongs perpetrated towards her and her sisters of the South, by people of those States. I presented them, in due time, to the Senate; but, although those resolutions emanated from a State that had never inflicted intentional wrong on any co State, and which had laid down an empire as a rich offering on the alter of Union, they were wholly disregarded. So far from arresting the evils complained of, those evils have been continually increasing, until she and her sister States of the South are not only denounced in the most opprobrious terms, but participation in the benefits of the common territories are denied her and them, and the now-to-be-regarded as authoritative declarations is thundered in their ears, that an “irrepressible conflict” exists between the free and the slave States, which can only be quieted by “making all free, or all slave.” Can the bonds of that Union be so easily broken which have stood such assaults for so many years? Oh! no, there is no danger that any State will too promptly assert its rights and liberties, and privileges. The danger is the other way—the failure promptly to vindicate them may lead to their loss forever. In short, which is most to be desired, a government liable to no peaceful change, under the control of an arbitrary and despotic sectional majority, which proposes to accomplish, by an act of Congress, what others accomplish by sword, or one held in check by an efficient popular veto? The lover of justice and liberty can have no difficulty in deciding. Nor is there the least force in the arguments drawn from the case of the secession of a State recently acquired, either by purchase of conquest. If Texas, for example, seeks admission into the union, she does so to enjoy the blessings of its liberty in security, upon an equal footing with the original States. A few years only elapse, and, instead of equality, she finds herself, by a sectional majority, trampled upon, and in place of enjoying the equal privileges which lead her to desire annexation, she is put under ban along with the entire section to which she belongs. If she seceded singly, the Government might possible insist upon an enumeration for outlays and expenditures; but in justice, that would be all that should be done. Let the Southern States be treated as they were for the first half century of the existence of the Union, and, my life upon it, there would be no secession or talk of secession; nay, let the majority section furnish now sufficient guarantees—guarantees rendered more urgently necessary by reason of the out-spoken words of the leaders, and the danger which threatens our institutions will pass away, and a brighter and more propitious sun than we have yet seen will shine above the horizon. To deny such guarantees may serve very well to advance the wickedly ambitions purposes of political libertines, but augur to all others of us naught by the deepest woe. What then are the consequences resulting from the act of secession—first, to the seceding States—secondly, to the remaining States and Government?

1. Most assuredly it would be better that the full adjustment of the responsibilities to which each member of the political partnership is liable, as well as all the rights and interests of each resulting therefrom,  should be adjusted, prior to the act of separation. No State can justly avoid the assumption of its portion of the public debt, or of its fair share of all the responsibilities which have been contracted by the Government during its continuance in the Union; while, on the other hand, its title to its fair share in the public property, in whatever it may consist, would be equally clear. But as this cannot be done in the present state of Public opinion, the State can do no more that express its readiness fairly and honestly to act upon all its obligations. The act of withdrawal re-invests it with all the powers which it conferred on the agent. Government restores to it all the grants of land made by itself for public purposes; in a word, clothes it with all the powers and attributes and rights of sovereignty which can attach to a sovereign and independent power. Its trade and commerce are under its exclusive control, and revenues collected in its ports are subject to its own orders.

How would the remaining members and the Government itself be affected? If the union of States under a political compact may be likened to that of a mercantile partnership, the question would readily enough be answered. The withdrawal of a single member would break up the concern, and call for a settlement of all its affairs. If the remaining members chose to continue the business, it would be as a new firm, although they might still preserve the original name. The dissolution of the old firm would be quite as complete, although its re-establishment would not be so difficult, by the withdrawal of one member, as if dissolved by united consent. If it undertook to contract in the name of the old partnership, its efforts would be of no avail; if it drew a check on any bank, the check would not be honored. In a word, the functions of the association would have entirely—except so far as would be necessary to wind up the concern—ceased to exist. By a parity of reasoning, similar results would transpire in regard to the compact of Union. Sound policy would dictate to the remaining States an immediate re-construction of the Government. This might be done by tacit consent, or by more formal action, and only a moment of time might elapse between the dissolution of the old, and the re-establishment of the new, advancing from the secession of one member to that of all members of an entire section and still advancing to the secession or withdrawal of an additional number, until only one or two remained attached to the old order of things in a legal point of view. The case finds its illustration, not inaptly, in the establishment of the Constitution under which, thus far, we of the States that have not yet seceded, by tacit consent, since the withdrawal of South Carolina agree still to live. In that case this Constitution was adopted by eleven States, while North Carolina and Rhode Island rejected it, and clung to the old articles of confederation which has been declared perpetual, in plain and unmistakable characters upon its face.

No one doubts but that North Carolina and Rhode Island might have continued the perpetual Union established, or more properly proclaimed, by that first compact; and that they had just cause to complain of the co States for having dissolved it without their consent. But we are enquiring into legal rights and responsibilities of seceding and non seceding members. What if North Carolina and Rhode Island had set up a claim to the Government and all its appendages? What if they had gone on with Congress, established the Treasury board, called upon the eleven seceding States to pay up their installments as required under the perpetual articles of Confederation, which were not to be altered but by unanimous consent; and if disobeyed, had issued their orders to the army, and navy to seize upon the forts and attack those towns and cities of the rebellious seceders—what would the anti-secessionists of this day have said of it?—Would the soldiers have manned the forts?—Would the officers of the navy have laid in ashes the cities? If the non secession of two States could not preserve the Government of the first Constitution, what number is necessary to preserve that Constitution which was engrafted on it? Will a majority do so?—and why? Less than a majority would scarcely attempt it; and why not as well as a majority, in point of right? The secession of one State paralyses the finances—what will that of eight do? What of fifteen, with the sure prospect of other changes threatened and in embryo?—What capitalists will make venture of the earnings of a life-time in so rickety a concern? A re-constructed Confederation, based on ample guarantees, would, on the contrary, command public confidence after being one in motion.—The best way is for these who have the power to act like rational men, and to resolve that the Constitution shall be carried out in good faith; that the emissaries from Exeter Hall, and their confreres in the United States shall be silenced and justice be done to all, and equality be measured out to all. No American citizen but should feel indignant at this insolent interference of Englishmen in our affairs.—If the scheme of Southern emancipation is to be concocted, if a new constitution is to be formed for the South it must be drawn upon foreign soil. If a raid takes place in Virginia, under a lunatic leader, an Englishman, in some way or other must have his hand in it. I submit to the people of the North, whether they have so far parted with all their Americanism, as to tolerate such interference with their unoffending brethren? But I return to the train of my reflections.

It is to be regretted that there should exist so great an instability of public opinion, in regard to the origin and character of the government. If, for example, Massachusetts as in the time of non-intercourse and embargo, or at a still later period, when Texas annexation was the leading topic of the day—take umbrage at the proceeding—no state evinces more fiery zeal in favor of the idea of a Federal league.—She hesitates not to take the strongest position in regard to her own sovereignty. In the case of Texas she set the example of action secession—not by proclamation, it is true, issued by a convention of her people; but by legislative resolution, which announced, as a fact accomplished, her withdrawal from the Union. In the event of the consummation of that measure. Now she is so full of indignation at the withdrawal of South Carolina, if the newspapers speak truly, that she is overflowing with passion, and promises to contribute from 7,000 to 100,000 men to punish South Carolina, for having follower her own example. It is high time that Judge Allen’s preamble should be in the hands of the people. Today it is your bull that gores my ox—to-morrow the thing is reversed. Conquer the south! Suppose such as thing accomplished, and the Northern States invested with supreme rule. What great good will they have achieved for themselves? Instead of looking with delight on fields under industrious culture—on a country teaming with abundance—on ships freighted with the rich productions which regulated the exchanges of the world, and pour into the Northern lap almost fabulous wealth—they would gaze only on burning embers and smoking columns—and the wreaths which would encircle their brows would not be the evergreens that patriot heroes wear, but parched and withered leaves which would burn into their brains. All this, too, would have had its origin in a busy-bodiness—an interference with those people’s affairs which, in private or public life, never fails to produce disturbance and ill-will. If Virginia undertook to control and regulate the domestic affairs of Massachusetts, a day would not pass before the thunders, as in the days of yore, would begin to roll and the lightnings to flash from Faneuil Hall. Can Massachusetts expect anything less from Virginia? Let the states adopt the truly wise rule of attending to their own business and letting their neighbors alone—of fulfilling all their political obligations, and of doing equal justice to all their compeers—and future generations will rise up and call them blessed. Did it ever enter into the head of any man who voted for the adoption of the Constitution that one section of the country would assume the task of supervisors over the laws and morals of another? and, its domestic institutions being precisely the same as when the compact of Union was entered into, that a later day the dominant section would make them the pretext for excluding the minority of section from an equal participation in the Territories which might at any time be acquired? Pretty business, truly, that the men of this day shall esteem themselves more moral than their father; that Seward should be set up as a purer and better man than George Washington, and that Mr. Lincoln would be regarded as the only truly immaculate President of the U. States.

It would, indeed, be a retrograde movement if any State should be constrained by force to remain in a Union which it abhorred. In this matter, one might take a lesson from what is passing in the world. Italy, after the enthrallment of ages, is admitted to the ballot box, and her States claim and exercise the privilege of selecting the condition of their own future. And, while this is passing and that, too, with the approbation of all Europe, we are to take a step backward into the dark ages, and carry into practice the exploded doctrine of absolutism in Government. If we cannot live together, let us part in peace. By doing so we shall at least save something of the old feeling. It is true, the South will be under the necessity of adopting a rigid system of passports and police, which may prevent the perfect freedom of intercourse which, except in notorious cases now exists. But that is no more than other countries have to do, and is entirely protective in its character without being hostile. If necessary, a treaty, offensive and defensive, may be received, and much that now exists may be preserved. Pursue a different course, and all may be lost. Strange, indeed that odious discriminations should be drawn between equals in a common concern. Such was my opinion in 1820, in the discussion on the Missouri question, and such will it ever remain. The talented editors of the “National Intelligencer,” gave me an enviable position in certain able articles, written by them in the Summer of Fall of 1859. They speak of me as being the only member of Congress, at that day, who in debate, denied to Congress the right to prohibit slavery in the Territories. I stood there then, and I stand there now, not as in my early life alone in debate—but now in my age, sustained as I believe, by the concurrent opinions of a majority of the people of the United States, and leaning on the decision of the Supreme Court as on a staff which no rage of faction can weaken, no convulsion, however serious, can break. Could the able editors have deciphered the thoughts of my inmost heart, they would have found me opposed to congressional interference in this behalf with the Territories, for other reasons. Even passing over the impolicy of such interference, it was in its best view useless, God’s own law of climate had regulated the matter; and let the children of earthly wisdom act as they may. It will still continue to do it. The man who would talk of cultivating the rice and cotton fields, and sugar plantations of the South with free labor, denies to himself the light of observation and experience. Look to the West India Islands—no part of the Globe makes a louder outcry for labor, or offers higher wages than they do, and yet the tide of immigration from Europe sweeps by them in a vast current, which is arrested in its course only by a more Northern and healthy clime. Asia and Africa have to be resorted to for laborers, while the Caucasian of Europe flees as from a pestilence, the rays of a burning sun, and becomes the cultivator of the cereals, or turns to herdsman amid the snows of the North. There is but one element that can change, and that but to a limited degree, this law of climate, and that is the price of labor. I need not, therefore draw the picture of what would be the condition of the slave States, looking to the regular increase of the black population in forty years, under the edict formally announced by the leaders of the Northern dominant party of “no more slave States!” It cannot be contemplated by any Southern man with absolute composure.

I will not despair of the good sense of my countrymen. The hope will linger with me to the last that there is enough wisdom and patriotism among us to adjust these difficulties, although I frankly confess my doubts and fears. The minority States can do but little more than suggest—the majority States hold in their hands the fate of the Union. I would by no means, have Virginia to linger by the wayside. On the Contrary, I would have her prompt and decisive in her action—she cannot be too prompt or decisive. Before her Convention can meet full developments of one sort or the other will have been made. She should place herself in position—her destiny, for good or for ill, is with the South. She was the flagship of the Revolution; and borrowing an expression from a recent production of one of her most gifted sons, she should have “Springs upon her cables and her broad-side to.”

If I may be permitted to make a suggestion, it would be, that the Legislature, without delay, and without the interference with its call of convention, might inaugurate a meeting of the border States of Delaware, Maryland, Virginia, Kentucky, Tennessee and Missouri, slave states; and New Jersey, Pennsylvania, Ohio, Indiana, Illinois and Iowa, free States, through two Commissioners from each, to arrange, if possible, a programme of adjustment, to be submitted to the other States as conclusive of the whole matter.

Should they agree, I think their recommendation would be followed by the other States, and incorporated into the Constitution and placed on the footing of an unalterable compact. Surely no States can be more deeply interested in the work of restoring the country to quiet and harmony. If they cannot agree, then it may safely be concluded that the restoration of peace and concord has become impossible. I would have an early day appointed for the meeting of the commissioners; so that Virginia, when she holds her convention, may be in full possession of the result.

Even if a failure to agree should occur, I would still have the Southern States, as a dernier resort, upon assembling in Convention, and after having incorporated in the present Constitution, guarantees going not one iota beyond that strict justice and the security of the South requires, adopt the Constitution of the United States as it now is, and give a broad invitation to the other States to enter our Union with the old flag flying over one and all. When this is done, I would say, in conclusion, to all my countrymen, rally back to the Constitution, thus invigorated and strengthened; and let there, for all time to come, be written on every heart, as a motto—that under all circumstances, and every condition of things, there is but one post of safety, and that is to stand by the Constitution.

Congressman Amos Tuck’s Speech on the Reference of the President James K. Polk’s Message, January 19, 1848

[Delivered in the House of Representatives of the United States, January 19, 1848.]

MR. CHAIRMAN: With the convictions I entertain in regard to the importance of the questions now pending before the country, and the present critical condition of the nation, I am glad that the several attempts which have been made to stop discussion on the President's message have not yet been successful. I believe that more time may be profitably spent in examining into the policy of the Executive, the purposes which he has in view, the means by which it is proposed to accomplish those purposes, and the consequences of success. Let the designs, measures, and general policy of the Administration receive thorough examination, be laid open to the view of this House and the people, and then receive the condemnation or approval of the nation.

The gentleman from Indiana, (Mr. ROBINSON,) at the close of his defence of the President on yesterday, requested that the debate might now be closed. I consider this demand unreasonable, and especially when made by a gentleman who had said all in his power on one side, and taken up one-eighth of the whole time spent in the discussion. I will remind the gentleman, also, that though his defence was as able as any honest man deserved, yet he had entirely omitted to explain some things which we all desire to understand. I hope the debate will not close till the people are put in possession of the facts or explanations, by which the patriotism and foresight of the President can be vindicated, in granting leave to Santa Anna and his suit to pass our blockading squadron and enter Mexico. We have now been at war a long time, have spent a hundred millions of dollars, and sacrificed many thousands of our citizens, in attempting to overcome a force organized principally by this same Santa Anna, and the thirty or forty talented Mexicans who with him passed our lines by direction of the President. This is an astounding fact—too incredible to be believed had it not been confessed; and, upon those who profess to believe in the wisdom and patriotism of the Administration, we make an express demand for explanation.

The President, in a late message, accused a large portion of his fellow-citizens of "giving aid and comfort to the enemy." This accusation was greedily seized by the rivals for executive favor; and we can now hear no speech in this Hall, or elsewhere, from the war party, nor read any of their newspapers, without encountering numberless repetitions of the same charge. There is a maxim, supposed to be of universal application, that those who are most ready to impeach the motives of others, are most liable to act from corrupt motives themselves. Let the people decide where the charge of "giving aid and comfort to the enemy" rightfully belongs. I shall make no accusation against the President, but I shall remind him that his permission to Santa Anna and his suit to pass "the American lines," resembles another pass I have read about in history, given to one John Anderson, and signed by one Benedict Arnold.

It was said yesterday that the delay of this discussion gives aid and comfort to the enemy. Congress have already appropriated a million of dollars to supply the wants of the army, and can we not now take breath and deliberate? Is it required that we daily appropriate a million of the people's money, under the penalty of being accused of treason if we hesitate to yield to such exorbitant demands? I hope not. For one I am resolved, before contributing to involve the present generation in a heavy debt, and to draw a mortgage upon our posterity—before plunging into a course that will sacrifice many of our citizens, endanger our liberties, and incur fearful responsibilities before Heaven, to examine thoroughly the character of the unnatural war now raging between the two North American republics.

In submitting my views, to the extent permitted by my limited time, I shall begin by considering the remote causes of the war. I would not trouble the committee, by calling their attention to some events which are now history, and probably familiar to most of those whom I have the honor to address, did I not believe that it is important to recur to the past in order to form a correct judgment of the character of the struggle in which the nation is engaged.

The annexation of Texas to this Union was the remote cause of the Mexican war; that object was sought and accomplished by our Government, for the purpose of the protection and extension of slavery. And the same considerations and motives now constitute so material a portion of the designs of our Government in prosecuting our conquests, that without those motives the war would cease immediately.

I need not tell you, sir, that the subject of American slavery now attracts the attention of the whole country. In proceeding with my remarks, I shall be obliged to speak freely of this institution. Those who have created this necessity have no reason to complain. Southern gentlemen have thrust this matter upon us, and made it impossible to examine the causes and objects of the war, without also considering the subject of slavery. I will, however, state, that the anti-slavery spirit of the country, which now seems so terrific to many, is entirely defensive; it is an excitement created wholly by the encroachments which have been made upon freedom and the free States. So far as I understand it, it does not contemplate any thing of which the friends of constitutional liberty, and of immunities according to law, need have any apprehensions.

In laying before the Committee some proof of the motives and purposes of annexation, I seem to myself to be supporting a foregone conclusion. I cannot realize that the objects and motives which led to that measure can be a matter of doubt, when the archives of our Government contain the published announcement of those purposes, as set forth in the official negotiations preparatory to the same. But, knowing that many yet deny the designs of that measure, and believing that at the present crisis the truth should in this place be well understood, I invite your attention to a few considerations.

The old province or department of Texas was settled principally by emigrants from the United States, who went there with their slaves while Mexico was subject to Spain, and during the early days of her attempt to adopt the model of our Government. The men who achieved the Mexican independence were not insensible to the inconsistency of claiming liberty for themselves and denying it to others. In 1829, the President of that republic issued a decree abolishing slavery in all the Mexican dominions. This decree was obeyed in all the provinces except Texas, where it was set at defiance. This was the first stage of hostile relations, between the settlers in Texas (who were principally from the Southern States) and the authorities at Mexico. It was an explicit issue between freedom and slavery. There were difficulties at the seat of the central Government which delayed the contest that must eventually be decided.

In the mean time a new impulse was given to emigration from the Southern States; volunteer adventurers rallied for Texas, and the rebel "Patriots," receiving new hope, declared their independence. A conflict approached, and the battle of San Jacinto decided in favor of the Texans.

But the end was not yet; a state of war existed, and the Texans, constantly fearing an invasion by Santa Anna, and encouraged by the sympathy of a few of our own citizens, sent Gen. Hunt to this city in 1837, with a proposition of annexation. He made a written application to our Government, which was promptly considered, and as promptly answered, in accordance with the unanimous opinion of Mr. Van Buren and his cabinet. An extract from the reply of Mr. Forsyth, Secretary of State, to Gen. Hunt, dated August 25, 1837, is so explicit on interesting questions of national law, now very little regarded, and besides is in such dignified contrast to all other state papers that have issued from our Government on the subject of Texas, that I will read it to the committee; asking them, in the mean time, to consider what would have now been the happy state of his country, and our well-founded title to the respect of the world, had the policy of Mr. Forsyth not been abandoned by his successors. It is as follows:

"So long as Texas shall remain at war, while the United States are at peace with her adversary, the proposition of the Texan Minister Plenipotentiary necessarily involves the question of war with that adversary. The United States are bound to Mexico by a treaty of amity and commerce, which will be scrupulously observed on their part, so long as it can be reasonably hoped that Mexico will perform her duties and respect our rights under it. The United States might justly be suspected of a disregard of the friendly purposes of the compact, if the overture of Gen. Hunt were to be even reserved for future consideration, as this would imply a disposition on our part to espouse the quarrel of Texas with Mexico; a disposition wholly at variance with the spirit of the treaty, with the uniform policy, and the obvious welfare of the United States."

This letter, sir, was written by a Democrat who had some regard for the old landmarks of republicanism-by one who paid some attention to the forms of law, the spirit of the Constitution, the sanctity of treaties, and the opinions of the world. The warnings of Washington against intervention—the opinion of Jefferson, that the Constitution had made no provision for incorporating a foreign nation into the Union—had not then been forgotten. Such was the doctrine of the Van Buren democracy, approved by the unanimous voice of the country. It was the doctrine of the Democracy till the date of the Baltimore Convention, when it was reversed, and the whole party made to turn about; not only without reason, but against reason; against the deepest convictions of the conscience and understanding of the whole party. If the time shall ever come when common sense, common law, or common honesty, shall direct the authorities of this nation, this doctrine will again be recognised and practised; and the annexation of Texas, as perpetrated by the united energies of John Tyler and James K. Polk, will be acknowledged to have been in violation of our "treaty of amity and commerce," an espousal of the quarrel of Texas, and an act of war against Mexico.

What were the pressing objects of national interest, not to say necessity, which could force our democratic Government to abandon its integrity, after this public confession of our relations and duties, to a distracted sister republic? What motives have led us to a line of policy that humbles every American heart, robs of national pride every intelligent citizen, and threatens, with imminent danger, our most sacred privileges? The answer is found in the archives of this Capitol, and may be read by all. It was not to "extend the area of freedom," but to enlarge the borders of slavery; it was to build up and establish—to render permanent and perpetual an institution repugnant alike to every principle of freedom, every sentiment of republicanism, every feeling of humanity—an institution which casts a dark shade over our country's history, and which, if cherished, will ultimately number us with the republics which are now no more.

When John Tyler had made the treaty of annexation in 1844, and laid the same before the Senate for approval, that body called upon him to produce the correspondence in regard to that measure, showing the motives which had induced him to enter into it. The information was given under an injunction of secrecy, afterwards removed, and is contained in Senate document No. 341, of the first session of the 28th Congress. In that document is contained an explicit, unequivocal, and often repeated declaration of the only objects of our Government designed to be accomplished by the treaty. These reasons, stated by those who were authorized to speak for the nation, are now of record; and, without any contradictory proof whatever, announce to the world, and will announce to posterity, the true motives which led the United States to that disastrous act. I will give a few extracts, as specimens of the whole correspondence; averring to the committee that the character is the same throughout, and that the one object of continuing and extending slavery in Texas, and protecting it in the United States, is boldly avowed, and made the foundation of every step in the progress of the negotiation. The letter which first announces the incipient scheme, and spreads out the apprehensions of the Tyler Cabinet, on account of the prospects in Texas, was written by Mr. Upshur, Secretary of State under Mr. Tyler, to Mr. Murphy, our chargé at Texas, and bears date August 8th, 1843. The letter is long, and the Secretary begins by informing Mr. Murphy that a plan for the abolition of slavery in Texas had been made known to this Government; that it was understood the same was to be accomplished by the purchase of all the slaves; and that a company in England were to furnish a portion or the whole of the necessary funds. After urging Mr. Murphy to inquire immediately into the designs of Texas in regard to slavery, and its prospects in that country, he recurs to the rumored plan of abolition, and says:

“A movement of this sort cannot be contemplated by us in silence.”

Again, he says:

“It cannot be permitted to succeed, without the most strenuous efforts on our part to arrest a calamity so serious to every part of the country.”

Becoming more particular in stating the causes of alarm, and in order to impress more deeply the importance of the subject, he further says:

“The establishment, in the very midst of our slaveholding States, of an independent government, forbidding the existence of slavery, and by a people born, for the most part, among us, reared up in our habits, and speaking our language, could not fail to produce the most unhappy effects upon both parties. If Texas were in that condition, her territory would afford a ready refuge for the fugitive slaves of Louisiana and Arkansas, and would hold out to them an encouragement to run away, which no municipal regulations of those States could possibly counteract.”

The whole letter is of the same character with the parts I have read, and I will not trouble the committee with reading any more of it. The communication had the desired effect upon the gentleman to whom it was directed, and immediately aroused all the energy of his peculiar patriotism. He adopts all Mr. Upshur's opinions, entertains all his anxieties, and promptly replies under date of Sept. 25th, 1843. He compliments the talent of the Secretary, after the manner of a politician, when writing to his superior in office, and speaking of the designs of England says:

“England is anxious to get rid of the constitution of Texas, because it secures in the most nervous and clear language the rights of the master to his slave, and it also prohibits the introduction of slaves into Texas from any other nation or quarter than the United States."

Again:

"The constitution of Texas secures to the master the perpetual right to his slave, and prohibits the introduction of slaves into Texas from any other quarter than the United States.”

Again:

"If the United States preserves and secures to Texas the possession of her constitution and present form of Government, then we have gained all that we can desire, and also all that Texas asks or wishes."

Again:

“Seeing that this surrender of sovereignty by Texas to Mexico at once liberates all the slaves in Texas, and that England thereby gains all she wants, and more than she ever expected, can the Government of the United States longer doubt what to do?"

Three days after, he again writes to Mr. Upshur, and, echoing the sentiments of the latter, remarks:

"The States in which slavery exists would have good reason to apprehend the worst consequences from the establishment of a foreign non-slaveholding State upon their immediate borders."

Telling the Secretary of "the eloquent manner in which he has pourtrayed those evils," his zeal overflows in the following language:

"I feel a whirlwind of emotion in my bosom which I will not attempt to describe. Let the Government of the United States take some immediate quick step on this subject. You have in this correspondence enough to justify immediate and prompt action.

 

"Pardon me if I am solicitous on this subject. I feel the deep interest at stake. Our whole Southern interests are involved in this negotiation, and with it the interests of the Union itself. The great blow to our civil institutions is to be struck here, and it will be a fatal blow if not timely arrested."

This pretence of enthusiasm, exhibited in the cause of slavery by an obscure pensioner on the Tyler administration, should have been treated with contempt; and his impudent recommendation to our Government to "take some immediate quick step," ought to have received a severe rebuke. Instead of this, we find the whole cabinet caught the contagion, and exerted the whole power of their station and patronage to second the views of this obscure adventurer, residing in Texas. In a subsequent letter, Mr. Murphy writes to the Government on the subject of annexation, and says, that without it "slavery cannot exist ten years in Texas, and probably not half that time." There is any amount of similar proof in the book I hold in my hand, and I might take up all my time in reading the evidence at length. But I need not do this; I have before me democratic proof that the objects of the "Texan iniquity” were not only such as I have represented them to be, but that those objects were understood, exposed, and condemned by the Democratic party in the Northern States, up to the time of the Baltimore Convention.

I ask the self-complacent Democracy, who are so free with their charges of treason, and Mexican federalism, to listen to the following passages from the three newspapers in New Hampshire, which are the mouth-pieces of the unchangeable Democracy, and which are now the pillars of support in the Granite State, to this slavery propagating administration.

The Nashua Gazette, of date Nov. 16th, 1843, contains the following editorial:

"The evils that will be entailed upon the North by the admission of Texas into the Union are incalculable, great, vast—beyond all human calculation.

 

"The object and design throughout is black as ink—as bitter as hell. No other reason on earth can be assigned for this southern movement than a determination to perpetuate that accursed institution, which, as a matter of compromise, was acceded to by the North at the time of the adoption of the Articles of Confederation. If the South persist in forcing Texas upon us, the result is evident to all. The consequences are multifarious, to say nothing of their ruin. May Providence avert this calamity, and save our Republic from disunion, misery, and destruction."

The Portsmouth (N. H.) Mercury, in the fall of 1843, says:

"It is a matter of deep regret that our Southern friends intend to agitate, in the next Congress, the question of the annexation of Texas to our Union. It is understood that this is a favorite project with Mr. Calhoun. But as its accomplishment might prove fatal to our free institutions, it will be a solemn duty of the Northern Democracy to oppose it."

The New Hampshire Patriot, May, 1844, has the following:

"Slavery and the defence of slavery form the controlling considerations urged in favor of the treaty [of annexation] by those who have been engaged in its negotiation. To these doctrines we can never subscribe, and whenever they are offensively urged upon the free States, they deserve to be pointedly rebuked."

I lay the above extracts before the Southern branch of the Democracy, hoping that they will understand the true character of their Northern allies. The same men who, uttered the above sentiments as matters of principle from which they could never swerve, in less than three months denied, utterly reprobated, the faith they had professed; and have ever since employed their time in abusing the men who would not sacrifice their principles at the same time. The Democratic leaders of New Hampshire at the present time are the men who have made this somerset in their confession of faith; who cry out "moral cowards," "enemies of their country," and "Mexican Federalists," while they know in their hearts that they are the most arrant moral cowards alive, and that there is no principle in any creed which they would not sacrifice for a reward. They have been called Northern men with Southern principles, but this is an imputation on the South to which I will not subscribe. They are Northern men with no principles at all. Had they been men of Southern principles, or of any principle whatever, they would not have made such an humiliating exhibition. I will not say that these men would not rather be right than wrong; indeed I think they would have chosen to follow the Van Buren democracy, which they expected would prevail. But the virtue which they possess is not at all adapted to a state of temptation. When the Baltimore Convention sacrificed Mr. Van Buren, and adopted an unknown candidate, and a new creed of faith; and when Mr. Ritchie published the significant fact that "they who did not go for annexation need expect nothing from the new administration," the trial was too strong for them. They hailed the new nomination as "the very best that could be made;" and, in respect to Texas, fulfilled to the letter the prophecy of the eccentric statesman of Roanoke, when, in 1820, he addressed just such a class of men on the floor of this House.

Turning to the representatives who had betrayed the North in the Missouri compromise, Mr. Randolph, pointing to each one separately, said, "you Northern dough-faces! we have bought you once, and when we want you we will buy you again, dog-cheap."

But, sir, I am happy to say that this class of politicians is small in the North, and is daily becoming less. The people, though confiding too long in their leaders, are beginning to understand them, and cast them off. The people may be deceived, but cannot be corrupted.

I will now call the attention of the committee to a new and most important construction of the Constitution, which was first announced in this Texan correspondence, and which may well challenge the attention of the country, both at the North and South. We have seen the purpose for which annexation was sought, and at the first view we are surprised at the official conduct of those who figured in the scheme, and, on examining the correspondence, we discover occasion for serious alarm. We see a construction of the national compact, which declares it to be the function and solemn duty of the General Government to protect and support the institution of slavery.

In the same letter, last quoted from Mr. Upshur, he says:

“Although those non-slaveholding States are as much opposed to the institution, [slavery] as England herself, yet the Constitution of the United States lays them under obligations in regard to it which, if duly respected, would secure the rights of the slaveholder."

Mr. Calhoun, as Secretary of State, takes the same ground. In a letter to Mr. Packenham, dated April 18, 1844, he vindicates the Texan treaty, and, after giving his views of the effect upon the United States of abolishing slavery in Texas, says, in reference to this last object:

"It is felt to be the imperious duty of the Federal Government, the common representative and protector of the States of this Union, to adopt in self-defence the most effectual measures to defeat it,"

Now, sir, before this Government makes any further progress, before we take one more step in our onward march, the people of the United States demand to know if this construction of our national compact is well founded? This point must be settled. It has heretofore been proclaimed by legislative resolutions, reaffirmed by numerous public meetings at the South, that the General Government had nothing to do with slavery. But annexation has destroyed old landmarks, reversed old principles, and introduced a new policy and a new code of morals into the country, which we are anxious to understand. If we live under a Constitution that compels us to support and defend slavery, we want to know it, and we want to know it now. We are at a crisis in the Government when it is important to understand our rights, and also to understand our duties. For, let me inform gentlemen, that this new doctrine will bring with it responsibilities and solemn duties, as well as heavy and disagreeable burdens. If the General Government have a jurisdiction over the subject of slavery to support and defend it, they have also a jurisdiction and a duty to limit, control, and restrain it. Let gentlemen consider the course they are taking, and understand the consequences of this new doctrine. If they take a construction liberal for the purposes of slavery, they must take one liberal also for the purpose of liberty; but they can not have a construction free as regards slavery, but strict as regards liberty.

We discard this novel construction, and pronounce it an infraction and an outrage upon the rights of the free States. The Constitution neither requires nor authorizes the General Government to wield its powers in defence of slavery. Such a representation of the nature of the compact between the States of this Union, made by our Secretary of State to the representative of the English nation, was a slander upon our country, and an indignity upon the memory of our fathers. Their lives, characters, and circumstances, as well as the letter and spirit of the Constitution, prove that they formed no agreement to sustain oppression. When they assembled to form a Constitution, those from the North came with undisguised abhorrence of slavery, which their habits, principles, and religious education taught them to be morally wrong. They were not the men to compromise their principles by involving themselves in guilt. They were crowned with laurels from the revolutionary conflict, and had just written with their blood the truth, that "all men are born free and equal;" and that "the right to life, liberty, and the pursuit of happiness," is "inalienable." They had no belief that the natural rights of a colored man were different from those of the white man: their sentiment was—

"We know no crime in color'd skin,

Nor think the God above

Could fix the brand of slave upon

The children of his love."

Such was the sentiment of the men of the North, who had periled their lives, their fortunes, and their sacred honor, in defence of the principles of universal liberty, and of the doctrine that liberty is the gift of God, and not of any government or potentate. With such sentiments they went to the work of forming a constitution. They believed that when the child first breathed, he was furnished with a charter from God, which secured to him life, liberty, and the pursuit of happiness. This sentiment had been their inspiring faith during every stage of the Revolution, and it never entered into their hearts to sacrifice it for any earthly consideration whatever.

The South had also fought bravely in defence of the same declaration of rights. A disinterested patriotism, a self-sacrificing devotion, had characterized her statesmen and her heroes, and endeared them to the whole country. But they were connnected with slavery, unfortunately thought it necessary to their prosperity, and wished to have the institution preserved to them under the national compact. With the difficulties and dangers attending this difference of opinion the convention labored for many days without any progress. At length, however, it was arranged to the acquiescence of both parties. It was agreed to leave the subject just where it remained under the confederation, that is, with the States where it existed. To make this still plainer, article tenth of the amendments was adopted, by which it was declared that the powers not expressly delegated were "reserved to the States respectively, or to the people." Such was the foundation on which the compact was based; and, in the first sentence, it is by them most appropriately declared, that "we ordain and establish this Constitution to secure the blessings of liberty."

This doctrine has been held by the Supreme Court, in sundry cases settling the point, that slavery is an institution sustained only by the positive law of the district where it exists; that beyond those limits the law which makes one man the property of another has no prescriptive, inferential, or other existence; that the alleged slave, having passed into a free State, may rightfully defend himself; and if he have the physical force to resist his masters, may maintain his freedom there, or go to a place of refuge. It cannot be denied, sir, that the people of the free States hold the blessings of personal liberty as sacredly as the Southern States do the privileges of slavery. The construction of the Constitution promulgated by the authors of the Texan plot, and acted upon by this Administration, is abominable, and must be repudiated. The encroachments upon our rights from the early days of the Goverment have been quite insupportable, but by this new construction all past trespasses are legalized, and it is henceforth proclaimed "a solemn duty" of the General Government to sustain slavery! Sir, this will never be tolerated The free States delegated no more power to the Federal Government to involve them in slavery, than the slave States did to involve them in its abolition. If Virginia claims the right to sustain slavery, New Hampshire claims the right to be exempt from it. The people of the free States claim, a right to be exempt from the sin, the shame, the expenses, and the retributions of this fearful wrong. To shed one drop of our blood, or to pay one cent of our money, for its aid, comfort, protection, or support, is an exaction to which we never can submit. This exemption is our legal, constitutional right, and being sustained by the literature, the moral sentiment, and the religious convictions of every civilized and christian nation, we shall not recede. We shall stand firm and immovable—

“——— constant as the Northern Star,

Of whose true, fixed, and resting quality

There is no fellow in the firmament.”

We say to the South, take to yourselves the full measure of good and evil. connected with this subject. We can have nothing to do with it; we can neither touch nor handle, cherish nor protect it. We leave it where our fathers left it; and though we regard it as the sum of all evils, we shall yet overstep no law in our desire to see it exterminated.

“We ask not ye shall snap the links

That bind you to your dreadful slaves;

Hug, if you will, a corpse that stinks,

And bear it with you to your graves:

But that you may go, coupled thus,

You never shall make slaves of us.”

Are gentlemen surprised at the anti-slavery excitement in this country? If there were no excitement, it would be proof that the spirit of liberty is dead. There not only is excitement, but that excitement will continue and increase, till the free States, under the guaranties of the Constitution, can enjoy exemption from slavery. I cannot promise quiet to the slave States even then; never, till they get rid of their peculiar institution, which is derogatory to man, and in violation of the laws of God. The compensations of Providence are inevitable, and the South cannot escape reaping the fruits of their institutions.

I have said that the anti-slavery spirit of the country is wholly defensive. This assertion cannot be doubted by any who are acquainted with the history of our Government, and particularly if the history, purposes, and consequences of the annexation of Texas be at all considered.

It has been represented by the public press, and in numerous speeches made in Congress, and elsewhere, that the distracting element in the Republic is the fanatical spirit of Northern and Western abolitionists. Most especially have they been made to bear the blame of introducing fanaticism and disunion into the halls of Congress, of disturbing the compromises of the Constitution, and by petitions, remonstrances, and memorials, endangering the perpetuity of our free institutions.

But, sir, no greater error, no more unfounded belief, could be impressed on the public mind. I grant that it is fanaticism that disturbs the harmony of the Government, and has shaken the whole fabric from centre to circumference; but then it is the fanaticism of the propagandists of slavery, the one idea-ism of those men who believe it to be their mission on earth to propagate bondage.

This is the element which has disturbed the nation, discarded well settled principles of policy and law, violated treaties, provoked the indignation of civilized nations, robbed us of our national pride, broken down the Constitution, and involved us in an aggressive, unnecessary, and wicked war. This is the fanaticism which has thrust upon the nation delicate and exciting questions, and demanded of the people to embrace, to honor, and support the peculiar institution. Had Northern men with Northern principles entered the slave States with banners, and proclaimed liberty to the captive and freedom to the bound, they would not have more palpably violated the compromises of the Constitution, than has the slave spirit perpetrated in every period of our history. Let the millions paid by free people to support and extend slavery, to recover runaway slaves, to prevent emancipation, to carry on pro-slavery wars, rebuke the charge and brand with falsehood the assertion that abolitionism, or any thing but the fell spirit of slavery, has introduced discord and danger into the councils of the nation. Let us expose this hypocritical cry against agitation and fanaticism by men who, by their annexations, wars, conquests, and aggressions, are picking our pockets, gagging our mouths, and at the same time raising a hue and cry against us, because we will not stand still and quietly be robbed.

I come now to consider the immediate cause of the war, which was the order of the President to march our army from Corpus Christi, and occupy the country up to the east bank of the Rio Grande, and to inquire whether that order was necessary or justifiable. The supporters of the President say that the Rio Grande was the western boundary of Texas, and therefore we had a right to take possession up to that line. I deny both the premises and the conclusion of this answer. That river was not the boundary of Texas, and if it had been we had no right forcibly to occupy that line, while Mexico was in possession of a portion of the territory claiming it as her own. If, as has been said, Texas were an independent nation at the time of annexation, her territory and her boundaries were limited by her actual possession. She had no title but that of the sword, and gained from Mexico only what she had forcibly seized and held. All the country which was occupied by Texan citizens, and all that from which the Mexicans had been expelled, might be claimed as having been gained by the revolution; but any new conquests or acquisitions could not be vindicated, except by treaty, or by new hostilities, and another war. Had, then, the Texans seized the country to the Rio Grande? There is no pretence of it. The great desert lying between the valley of that river and the valley of the Nueces had never been crossed by Texans. Brazos Santiago, and Santa Fe, lie between these rivers, and in the territory seized by our army. At both of these cities Mexico had custom-houses, where our merchants had for years paid duties to the Mexican government. And we had at the same time a consul, with a commission under the sign manual of the President of the United States, residing at Santa Fe, in an acknowledged foreign country. At the session of Congress at which annexation was effected, a law was passed in regard to drawbacks, in which Santa Fe is expressly named as a city belonging to the Mexican Republic. The inhabitants all spoke the Mexican language, and, according to General Taylor's account, abandoned their houses on the approach of our army. No Texan forces, or Texan inhabitants, had occupied any land within a hundred miles of Matamoras. In one of the despatches of the President to General Taylor, prior to hostilities, he says:

"Mexico has some military establishments on the east side of the Rio Grande, which are, and for some time have been, in the actual occupancy of her troops."

With this evidence, and these admissions, I say that the Rio Grande was not the western boundary of Texas; and if the President understood his own acts, he himself knew that such was not the boundary.

But, supposing our title by annexation to have been good to the Rio Grande, yet, as the Mexicans claimed the valley of that river, and were in possession of it, the President could not expel them from the disputed territory without committing an act of war. The recollections of Oregon, and the northeastern boundary, are too fresh to allow this law to be questioned, unless one rule is to be applied to England and another to Mexico.

I confidently assert, then, that the allegation of the President that "Mexico has passed the boundary of the United States, has invaded our territory, and shed American blood on American soil, "is untrue; and that the preamble to an act of the last Congress, which states that "war exists by the act of Mexico," is justly denominated "the lying preamble."

The President ordered our army to take forcible possession of territory which, if not Mexican, was in dispute, and in the occupancy of Mexican subjects. This was an act of war.

He caused our army, before hostilities commenced, to blockade the mouth of the Rio Grande, through which the Mexican forces at Matamoras received their supplies, and thus commenced starving their army while stationed on their own ground. This was an act of war.

Weeks before hostilities commenced, he caused a battery to be built on this side of the river, opposite to Matamoras, supplied it with cannon pointing into the heart of the city, and manned it with a force capable at any moment of hurling destruction upon the Mexicans. This was an act of war.

Finally, he consummated war by measures which led to an attack by Capt. Thornton, an officer of our army, upon a party of Mexicans who resisted, and sixteen men were killed and wounded. This was the first blood that was spilt, and was war by the act of the President of the United States.

To such conclusions am I inevitably brought by examining this subject. I am forced, also, to observe that the order of the President which involved these disastrous consequences was made while Congress was in session, to which body the Constitution gives the war-making power. The barriers of the Constitution have availed nothing for the purposes of peace or freedom, since the blood-thirsty appetite for conquest and slavery propagation seized upon the nation.

Entertaining the views I have expressed of the immediate causes of the war, I lately voted for the amendment offered to a resolution by the gentleman from Massachusetts, (Mr. ASHMUN,) stating that the war was "unnecessarily and unconstitutionally commenced by the President." This has been taken up in the newspapers and pronounced to be "treasonable." I, then, have sinned deeply, for I confess and aver that I never gave a vote more cordially, and have seldom enjoyed more satisfaction than in the success of that amendment, and the indication which it wafted on the wings of the wind to my constituents and the country. In common with millions of patriotic citizens, I thank the gentleman for that timely amendment. It was most appropriately offered by one of the "immortal fourteen," who refused to vote in the 29th Congress for "the lying preamble.”

This is not only an "unnecessary and unconstitutional" war, in its commencement, and therefore wicked, but the controlling motives of its present prosecution are identical with those which led to annexation. This is proved by the fact that, when the Wilmot Proviso, in the last Congress, was attached to a bill of supplies, the personal advisers of the President immediately exerted all their influence to defeat the bill. Why was this the case, unless there was a determination to make slavery co-extensive with our southwestern border? This is apparent, also, from a clause in a late letter from the Chairman of Military Affairs of the Senate, (Gov. CASS,) which he has published in order to show his recantation of faith in the Wilmot Proviso.

The third reason he gives for abandoning the provision that slavery be prohibited in any territory to be acquired from Mexico, is in the following language:

"3. Because I believe in the general conviction, that should such proposition succeed, it would lead to an immediate withholding of the supplies, and thus to a dishonorable termination of the war. I think no dispassionate observer at the seat of Government can doubt this result."

I ask why such a proposition would result in "withholding supplies," unless those supplies are wanted for the purpose, chiefly, of acquiring new slave territory? Gentlemen may affect to scorn the idea that slavery can make progress into Mexico. But, sir, the design of the war is to get as much of that country as possible, and then to admit it by States into the Union as fast as slavery obtains over it a predominant influence. However much or little be obtained, mark the fact, no part of it will ever be admitted, unless with a constitution recognising slavery.

This is a war conceived in sin, and brought forth in iniquity; and, in its objects and progress, is more characteristic of the 19th century before, than the 19th century after Christ. The people are heart-sick of it, and demand that it cease. They see that we have abandoned the mission on which our nation gloriously embarked; and, forgetting the political precepts of our fathers, and the moral admonitions of our holy religion, we are precipitating a sorrowful failure of the great republican experiment.

I regret that my time will not allow me to examine the array of fearful apprehensions that our circumstances unavoidably bring before me. Look at the plains of Mexico, covered with the slain thousands of our own citizens, and the slain tens of thousands of our sister republic—look at the multitudes in mourning throughout the land-and tell me, whether we are not treasuring up for ourselves "wrath against the day of wrath!" There are other evils besides sacrifice of life. War reverses the order of society; it raises those who should be low, and depresses those who should be high; it exalts without merit, and casts down without fault. Military renown has been the affliction of the nation for 25 years. Hero worship has been the order of the day, and opinions have had less currency on account of their correctness, than on account of their origin. The multiplication of slaves, the multiplication of military heroes, (scarcely less calamitous,) a standing army, a Mexican pro-consulate, an intolerable executive patronage, (now almost too much for liberty,) and the eventual dissolution of our present Government, with the inevitable retributions of Him who rules in Heaven and on earth, are seen in the distance. Let us pause before it is too late.

I avow my position in regard to supplies, which is, to grant them only for the purpose of bringing the army home by the shortest route. Being found in a wrong, let us restore the nation status ante bellum. We have spoken our sentiments about the necessity of the war, let us not take a course which will oblige us to say it too;

"We know the right, and we approve

We know the wrong, and yet the wrong pursue.”

Let the same vote that declared the war unnecessary and unconstitutional, starve it to death by withholding supplies.

On the subject of the acquisition of territory, it is my belief that, whatever we may acquire, will not make us any the richer, more powerful, or happy, And, I understand, that what we now have south of 36° 30’, produces more annual cost than revenue to the Government. But, as those who talk about our "destiny" are determined to have territory, I go by all means for the re-enactment of the ordinance of 1787; otherwise, for the Wilmot Proviso.

I know what denunciations are hurled against those who express the sentiments I have avowed. But I cannot regard them; my convictions are deep, and my course is plain. I trust I shall never betray myself, or my country, by giving "aid and comfort" to a war which I believe is wrong, dishonorable, and dangerous. Burke, Barre, and Chatham stood by their country in the time of our revolution, and gave advice, remonstrance, and solemn warning, which, if followed, would have saved to England her colonies. In the belief that even the humblest member of this House has the opportunity to imitate their glorious example, I shall denounce the Mexican war, expose the reckless ambition of its authors, and, to the extent of my ability, warn the people against its consequences. If this be treason, my revilers may make the most of it.
