Diary of Judith Brockenbrough McGuire: December 14, 1862

Firing in the direction of Fredericksburg renewed this morning, but at irregular intervals. Telegraph wires are cut. No news except from passengers in the trains. The cars are not allowed to go to the town, but stop at a point some miles below. They report that every thing goes on well for us, of which we were sure, from the receding sound of the cannon. Praise the Lord, O my soul, and all that is within me praise His holy name! How can we be thankful enough for such men as General Lee, General Jackson, and our glorious army, rank and file!

Nine o'Clock at Night. — A sad, sad train passed down a short time ago, bearing the bodies of Generals Cobb, of Georgia, and Maxcy Gregg, of South Carolina. Two noble spirits have thus passed away from us. Peace to their honoured remains! The gentlemen report many wounded on the train, but not very severely. I fear it has been another bloody Sabbath. The host of wounded will pass to-morrow; we must be up early to prepare to administer to their comfort. The sound of cannon this evening was much more distant, and not constant enough for a regular fight. We are victorious again! Will they now go from our shores forever? We dread to hear of the casualties. Who may not be among the wounded to-morrow?

Lieutenant-Colonel Rutherford B. Hayes to Sardis Birchard, December 23, 1861

Fayetteville, Virginia, December 23, 1861.

Dear Uncle: — I have just heard by telegraph of the birth of my fourth son. In these times, boys are to be preferred to girls. Am glad to hear Lucy is doing well. . . .

Yes, we are in winter quarters, most comfortable quarters. I have to myself as nice a room as your large room, papered, carpeted, a box full of wood, and with a wild snow-storm blowing outside to make it more cheerful by contrast. We have had eighteen days of fine weather to get ready in, and are in pretty good condition. We have our telegraph line running down to civilization; get Cincinnati papers irregularly from four to ten days old. I have enjoyed the month here very much. Busy fortifying — not quite ready yet, but a few more days of good weather will put us in readiness for any force. The enemy are disheartened; the masses of the people want to stop. If England does not step in, or some great disaster befall us, we shall conquer the Rebellion beyond doubt, and at no distant period. . . .

I shall go home about the time Dr. Joe starts back here — say the 15th to 20th January, if nothing new occurs to prevent. If you can't come down to Cincinnati, I shall go to Fremont.

John M. Forbes to William Cullen Bryant, February 27, 1862


Boston, February 27,1862.

My Dear Sir, — I think you are wrong in opposing the new order of Stanton as to telegrams. I have had much experience with the telegraph as a business engine, and I know what it must be in war. The weakest and most discouraging point in our war management up to this time has been the looseness with which the telegraph has been left open: and Stanton's move to control it seems to me one of the best things he has done. I only hope he will have a sharp censor or superintendent, and do the thing thoroughly. I urged this measure very strongly in the spring, and was disgusted at the apathy of the higher powers. For with Baltimore and Washington and the public offices ever full of traitors, the free use of the telegraph seemed to me to put Washington in the power of the enemy.

The telegraph is a mighty engine of war, and, if used up to its capacity, is enough to turn the scale.

Upon our single track railroads we find that the erection of a telegraph is worth to us more than a double track would be without the wires. It increases the availability of our engines, cars, and men enormously, besides the value for safety. I mention this as an illustration of what good it may do to the army if put under sharp systematic management; and beyond all, how dangerous, if the enemy are permitted to share its use and our secrets!

Brigadier-General John Sedgwick to his Sister, March16, 1862

Harper's Ferry, March 16, 1862.
My dear sister:

I do not remember from what place I wrote you last. I left here about a week since, expecting to march on Winchester, as it was supposed the enemy were in such force as to give us battle. After making the arrangements to attack the place, the enemy evacuated, and our troops marched in without firing scarcely a gun. Soon after the occupation, my division was ordered to return to this place, where further orders would be received. On our arrival here I telegraphed to Washington, and was directed to await further orders. I presume by to-morrow we shall be on our way to Washington or Annapolis. I am disgusted at the depredations our men are committing — stealing everything they can lay their hands on. I am sorry to say they are supported in it by many of their officers. There is no Union sentiment in this part of the country, and the conduct of our men is calculated to make the enemy more bitter than ever.

We are now in possession of all this valley, and it is likely that enough troops will be left here to hold it. My impression is that this division will go with either General McClellan or will form part of a corps to operate on one of the lines leading to Richmond.

The enemy seem more determined than ever, if you can judge from the tone of their papers. Their policy is not yet developed. Some think they will retire into the Southern States and depend upon the climate to assist them, others that they will give battle this side of Richmond; I am inclined to the latter opinion. All appearances indicate that General McClellan did not overrate their strength or position at Manassas, and that it would have been madness to have attacked them there. If he is let alone he will subdue them; but as for a reunion, that is another matter.

I will write as soon as I know our destination. I hope you have not written. I will tell you where to direct as soon as possible.

Lieutenant-Colonel Rutherford B. Hayes to Lucy Webb Hayes, Sunday, December 8, 1861

Camp Union, December 8, 1861.

Dearest: — It is Sunday — inspection day. Visited all quarters and hospital. All in improving condition. Tell Dr. Joe we have had five bright warm lovely days and a fair prospect for as many more. Roads improving; telegraph wire here, and will be in working order tomorrow or day after.
Have the daily Commercial mailed to me here from the office for one month. If it comes as often as twice a week, I will renew the subscription, otherwise not.

A trunk full of nice doings, socks, mittens, small looking-glasses, needle doings, etc., etc., came up from Gauley among our baggage. Nothing to show who from or who to. I assumed that it was an instalment from Cleveland for the Twenty-third and Dr. McCurdy disposes of it accordingly. . . .
I am feeling anxious about you. Write often all about yourself. Love to the dear boys and all. Ever so much for yourself.

Lieutenant-Colonel Rutherford B. Hayes to Laura Platt, November 29, 1861

Fayetteville, Virginia, November 29, 1861.

Dear Laura: — Thanks for your letter. I hope I may think your health is improved, especially as you insist upon the pair of swollen cheeks. We are to stay here this winter. Our business for the next few weeks is building a couple of forts and getting housed fifteen hundred or two thousand men. We occupy a good brick house, papered and furnished, deserted by its secession proprietor on our approach. Our mess consists of Colonel Scammon, now commanding [the] Third Brigade, Colonel Ewing of [the] Thirtieth, Dr. Joe, and a half dozen other officers.

The village was a fine one — pretty gardens, fruit, flowers, and pleasant homes. All natives gone except three or four families of ladies — two very attractive young ladies among them, who are already turning the heads or exciting the gallantry of such “gay and festive” beaux as the doctor.
We are in no immediate danger here of anything except starvation, which you know is a slow death and gives ample time for reflection. All our supplies come from the head of navigation on the Kanawha over a road remarkable for the beauty and sublimity of its scenery, the depth of its mud, and the dizzy precipices which bound it on either side. On yesterday one of our bread waggons with driver and four horses missed the road four or six inches and landed ("landed" is not so descriptive of the fact as lit) in the top of a tree ninety feet high after a fall of about seventy feet. The miracle is that the driver is here to explained that one of his leaders hawed when he ought to have geed.

We are now encouraging trains of pack mules. They do well among the scenery, but unfortunately part of the route is a Serbonian Bog where armies whole might sink if they haven't, and the poor mules have a time of it. The distance luckily to navigable water is only sixteen to twenty miles. If, however, the water gets low, the distance will increase thirty to forty miles, and if it freezes — why, then we shall all be looking for the next thaw for victuals.

We are to have a telegraph line to the world done tomorrow, and a daily mail subject to the obstacles aforesaid, so we can send you dispatches showing exactly how our starvation progresses from day to day.

On the whole, I rather like the prospect. We are most comfortably housed, and shall no doubt have a pretty jolly winter. There will be a few weeks of busy work getting our forts ready, etc., etc. After that I can no doubt come home and visit you all for a brief season.

So the nice young lieutenant is a Washington. Alas! that so good a name should sink so low.
I am interrupted constantly. Good-bye. Love to all. Can't write often. Send this to Lucy.

Major Wilder Dwight: August 18, 1861

Camp Below Sandy Hook, August 18, 1861.

Progress is the law of life. Therefore retreat is I abnormal and depressing. When I looked at Harper's Ferry drifting again under bare poles into secessionism, I felt low. There was the flagstaff in the silent town, — the flag had just been hauled down. The last flat-boat, with its last company, was coming across the river. On Friday evening the orders came to strike tents, leave a force on the Heights, and for the regiment to be ready to move. Colonel Gordon left me, with three companies, on our old ground. He took the rest below and waited the crossing of the river by Colonel Andrews.

It was just at dusk when the regiment moved off. The mists were drifting thickly down the mountain sides as the men wound off into the woods. I posted a new guard, got the men under cover as well as I could, and awaited the inevitable rain. We were without tents and without huts. The night passed wearily in a driving rain. The bands were playing confusedly on the other side of the mountain, as the forces were moving down the river. At last came light enough to call it Saturday morning. I was up and out agitating the breakfast question. By good luck I got hold of some stores accidentally left by the Quartermaster, and distributing them, succeeded in getting a hot breakfast into my three wet companies. Then I waited orders. At last Colonel Andrews brought them. I got the men in marching order, and in the blue rain we started. I got my command safely down to the river, and rejoined the regiment in Sandy Hook, where I found it just ready to march. Then again came orders to remain to hold Sandy Hook, and to send a force over to Harper's Ferry to seize all the flour in Herr's mill. Colonel Andrews returned to the Ferry with five companies. All last night the flour was coming across the river in boats. Our friend Mr. Herr was treated very unceremoniously, but he liked it. He seemed to think it a choice between secession bonds and Union gold; and if he could get the latter for his flour, he would be content. So the troops seized his premises and took his flour, and he acquiesced with a good grace. The rest of the regiment came down two miles below Harper's Ferry, and here we are, this Sunday morning, waiting to be joined by Colonel Andrews's companies, who have recrossed the river this morning, with all their flour safe on this side. I am scribbling this letter in the Doctor's tent, interrupted by questions, and bothered by difficulties of commissariat. These sudden moves and this detached service are hard tests of ingenuity. You see all the army conveniences move with the army. The regiment that is left behind is ill provided. We have been using the telegraph, and killing fresh beef, and seizing flour, and I think we shall not go hungry. The impression seems to be, that an attempt will be made by the Rebels to reach Baltimore, or get round Washington. That is thought to be the cause of our movement. If such an attempt is made, it will fail. My baggage is all gone.

I have nothing but a tent and a blanket, and so am free from care. Colonel Gordon is just galloping into camp. Orders are out for striking tents. We shall soon be in the midst of the work of getting into shape in a new camp nearer Harper's Ferry.

We are to stay here, build a little fort or two, keep here fifteen hundred men or so — sixty horsemen, a battery of four or six small cannon, etc., etc. We shall live in comfortable houses. The telegraph will be finished here in a day or two. We shall have a daily mail to the head of navigation — sixteen miles down the Kanawha. On the whole a better prospect than I expected in western Virginia. Our colonel will command. I am consequently in command of the Twenty-third Regiment. This is the fair side. The other side is, sixteen miles of the sublimest scenery to travel over. We get supplies chiefly, and soon will wholly, by pack mules. We have a waggon in a tree top ninety feet high. If a mule slips, good-bye mule! This is over the “scenery,” and where there is no scenery, the mud would appal an old-time Black Swamp stage-driver. If rations or forage give out, this is not a promising route, but then we can, if forced, march the sixteen miles in one day — we have done it — and take the mouths to the food if the food can't be carried to the mouths.

If the river gets very low, as it sometimes does, the head of navigation will move thirty or forty miles further off; and if it freezes, as it does once in six or eight years, there will be no navigation, and then there will be fifteen hundred souls hereabouts anxiously looking for a thaw.

You now have the whole thing. I rather like it. I wish you were in health. It would be jolly for you to come up and play chess with the colonel and see things. As soon as we are in order, say four or five weeks, I can come home as well as not and stay a short time. . . .

Pacific Railroad Act of 1862: July 1, 1862

An Act to aid in the Construction of a Railroad and Telegraph Line from the Missouri River to the Pacific Ocean, and to secure to the Government the Use of the same for Postal, Military, and Other Purposes.

Taylor, Alvin Saunders, of Nebraska; John Evans, of Colorado; together with commissioners to be appointed by the Secretary of the Interior, and all persons who shall or may be associated with them, and their successors, are hereby created and erected into a body corporate and politic in deed and in law, by the name, style, and title of “The Union Pacific Railroad Company;” and by that name shall have perpetual succession, and shall be able to sue and to be sued, plead and be impleaded, defend and be defended, in all courts of law and equity within the United States, and may make and have a common seal; and the said corporation is hereby authorized and empowered to layout, locate, construct, furnish, maintain, and enjoy a continuous railroad and telegraph, with the appurtenances, from a point on the one hundredth meridian of longitude west from Greenwich, between the south margin of the valley of the Republican River and the north margin of the valley of the Platte River, in the Territory of Nebraska, to the western boundary of Nevada Territory, upon the route and terms hereinafter provided, and is hereby vested with all the powers, privileges, and immunities necessary to carry into effect the purposes of this act as herein set forth. The capital stock of said company shall consist of one hundred thousand shares of one thousand dollars each, which shall be subscribed for and held in not more than two hundred shares by anyone person, and shall be transferable in such manner as the by-laws of said corporation shall provide. The persons hereinbefore named, together with those to be appointed by the Secretary of the Interior, are hereby constituted and appointed commissioners, and such body shall be called the Board of Commissioners of the Union Pacific Railroad and Telegraph Company, and twenty-five shall constitute a quorum for the transaction of business. The first meeting of said board shall be held at Chicago at such time as the commissioners from Illinois herein named shall appoint, not more than three nor less than one month after the passage of this act, notice of which shall be given by them to the other commissioners by depositing a call thereof in the post office at Chicago, post paid, to their address at least forty days before said meeting, and also by publishing said notice in one daily newspaper in each of the cities of Chicago and Saint Louis. Said board shall organize by the choice from its number of a president, secretary, and treasurer, and they shall require from said treasurer such bonds as may be deemed proper, and may from time to time increase the amount thereof as they may deem proper. It shall be the duty of said board of commissioners to open books, or cause books to be opened, at such times and in such principal cities in the United States as they or a quorum of them shall deter- mine, to receive subscriptions to the capital stock of said corporation, and a cash payment of ten per centum on all subscriptions, and to receipt therefor. So soon as two thousand shares shall be in good faith subscribed for, and ten dollars per share actually paid into the treasury of the company, the said president and secretary of said board of commissioners shall appoint a time and place for the first meeting of the subscribers to the stock of said company, and shall give notice thereof in at least one newspaper in each State in which subscription books have been opened at least thirty days previous to the day of meeting, and such subscribers as shall attend the meeting so called, either in person or by proxy, shall then and there elect by ballot not less than thirteen directors for said corporation; and in such election each share of said capital shall entitle the owner thereof to one vote. The president and secretary of the board of commissioners shall act as inspectors of said election, and shall certify under their hands the names of the directors elected at said meeting; and the said commissioners, treasurer, and secretary shall then deliver over to said directors all the properties, subscription books and other books in their possession, and thereupon the duties of said commissioners, and the officers previously appointed by them shall cease and determine forever, and thereafter the stockholders shall constitute said body politic and corporate. At the time of the first and each triennial election of directors by the stockholders two additional directors shall be appointed by the President of the United States, who shall act with the body of directors, and to be denominated directors on the part of the government; any vacancy happening in the government directors at any time may be filled by the President of the United States. The directors to be appointed by the President shall not be stockholders in the Union Pacific Railroad Company. The directors so chosen shall, as soon as may be after their election, elect from their own number a president and vice-president, and shall also elect a treasurer and secretary. No person shall be a director in said company unless he shall be a bona fide owner of at least five shares of stock in the said company, except the two directors to be appointed by the President as aforesaid. Said company, at any regular meeting of the stockholders called for that purpose, shall have power to make by-laws, rules, and regulations as they shall deem needful and proper, touching the disposition of the stock, property, estate, and effects of the company, not inconsistent herewith, the transfer of shares, the term of office, duties, and conduct of their officers and servants, and all matters whatsoever which may appertain to the concerns of said company; and the said board of directors shall have power to appoint such engineers, agents, and subordinates as may from time to time be necessary to carry into effect the object of this act, and to do all acts and things touching the location and construction of said road and telegraph. Said directors may require payment of subscriptions to the capital stock, after due notice, at such times and in such proportions as they shall deem necessary to complete the railroad and telegraph within the time in this act prescribed. Said president, vice-president, and directors shall hold their office for three years, and until their successors are duly elected and qualified, or for such less time as the by-laws of the corporation may prescribe; and a majority of said directors shall constitute a quorum for the transaction of business. The secretary and treasurer shall give such bonds, with such security, as the said board shall from time to time require, and shall hold their offices at the will and pleasure of the directors. Annual meetings of the stockholders of the said corporation, for the choice of officers (when they are to be chosen) and for the transaction of annual business, shall be holden at such time and place and upon such notice as may be prescribed in the by-laws.

SEC. 2. And he it further enacted, That the right of way through the public lands be, and the same is hereby, granted to said company for the construction of said railroad and telegraph line; and the right, power, and authority is hereby given to said company to take from the public lands adjacent to the line of said road, earth, stone, timber, and other materials for the construction thereof; said right of way is granted to said railroad to the extent of two hundred feet in width on each side of said railroad where it may pass over the public lands, including all necessary grounds for stations, buildings, workshops, and depots, machine shops, switches, side tracks, turntables, and, water stations. The United States shall extinguish as rapidly as may be the Indian titles to all lands falling under the operation of this act and required for the said right of way and; grants hereinafter made.

SEC 3. And be it further enacted, That there be, and is hereby , granted to the said company, for the purpose of aiding in the construction , of said railroad and telegraph line, and to secure the safe and speedy transportation of the mails, troops, munitions of war, and public stores thereon, every alternate section of public land, designated by odd numbers, to the amount of five alternate sections per mile on each side of said railroad, on the line thereof, and within the limits often miles on each side of said ro1ld, not sold, reserved, or otherwise disposed of by the United States, and to which a preemption or homestead claim may not have attached, at the time the line of said road is definitely fixed : Provided, That all mineral lands shall be excepted from the operation of this act; but where the same shall contain timber, the timber thereon is hereby granted to said company. And all such lands, so granted by this section, which shall not be sold or disposed of by said company within three years after the entire road shall have been completed, shall be subject to settlement and preemption, like other lands, at a price not exceeding one dollar and twenty-five cents per acre, to be paid to said company.

SEC. 4. And be it further enacted, That whenever said company shall have completed forty consecutive miles of any portion of said railroad and telegraph line, ready for the service contemplated by this act, and supplied with all necessary drains, culverts, viaducts, crossings, sidings, bridges, turnouts, watering places, depots, equipments, furniture, and all other appurtenances of a first class railroad, the rails and all the other iron used in the construction and equipment of said road to be American manufacture of the best quality, the President of the United States shall appoint three commissioners to examine the same and report to him in relation thereto; and if it shall appear to him that forty consecutive miles of said railroad and telegraph line have been completed and equipped in all respects as required by this act, then, upon certificate of said commissioners to that effect, patents shall issue conveying the right and title to said lands to said company, on each side of the road as far as the same is completed, to the amount aforesaid; and patents shall in like manner issue as each forty miles of said railroad and telegraph line are completed, upon certificate of said commissioners. Any vacancies occurring in said board of commissioners by death, resignation, or otherwise, shall be filled by the President of the United States: Provided, however, That no such commissioners shall be appointed by the President of the United States unless there shall be presented to him a statement, verified on oath by the president of said company, that such forty miles have been completed, in the manner required by this act, and setting forth with certainty the points where such forty miles begin and where the same end; which oath shall be taken before a judge of a court of record.

SEC. 5. And be it further enacted, That for the purposes herein mentioned the Secretary of the Treasury shall, upon the certificate in writing of said commissioners of the completion and equipment of forty consecutive miles of said railroad and telegraph, in accordance with the provisions of this act, issue to said company bonds of the United States of one thousand dollars each, payable in thirty years after date, bearing six per centum per annum interest (said interest payable semi-annually,) which interest may be paid in United States treasury notes or any other money or currency which the United States have or shall declare lawful money and a legal tender, to the amount of sixteen of said bonds per mile for such section of forty miles; and to secure the repayment to the United States, as hereinafter provided, of the amount of said bonds so issued and delivered to said company, together with all interest thereon which shall have been paid by the United States, the issue of said bonds and delivery to the company shall ipso facto constitute a first mortgage on the whole line of the railroad and telegraph, together with the rolling stock, fixtures and property of every kind and description, and in consideration of which said bonds may be issued; and on the refusal or failure of said company to redeem said bonds, or any part of them, when required so to do by the Secretary of the Treasury, in accordance with the provisions of this act the said road, with all the rights, functions, immunities, and appurtences thereunto belonging, and also all lands granted to the said company by the United States, which, at the time of said default, shall remain in the ownership of the said company, may be taken possession of by the Secretary of the Treasury, for the use and benefit of the United States: Provided, this section shall not apply to that part of any road now constructed.

SEC. 6. And be it further enacted, That the grants aforesaid are made upon condition that said company shall pay said bonds at maturity, and shall keep said railroad and telegraph line in repair and use, and shall at all times transmit despatches over said telegraph line, and transport mails, troops, and munitions of war, supplies, and public storage upon said railroad for the government, whenever required to do so by any department , thereof, and that the government shall at all times have the preference in the use of the same for all the purposes aforesaid, (at fair and reasonable rates of compensation, not to exceed the amounts paid by private parties for the same kind of service;) and all compensation for services rendered for the government shall be applied to the payment of said bonds and interest until the whole amount is fully paid. Said company may also pay the United States, wholly or in part, in the same or other bonds, treasury notes, or other evidences of debt against the United States, to be allowed at par; and after said road is completed, until said bonds and interest are paid, at least five per centum of the net earnings of said road shall also be annually applied to the payment thereof.

SEC. 7. And be it further enacted, That said company shall file their assent to this act, under the seal of said company, in the Department of the Interior, within one year after the passage of this act, and shall complete said railroad and telegraph from the point of beginning as herein provided, to the western boundary of Nevada Territory before the first day of July, one thousand eight hundred and seventy-four: Provided, That within two years after the passage of this act said company shall designate the general route of said road, as near as may be, and shall file a map of the same in the Department of the Interior, whereupon the Secretary of the Interior shall cause the lands within fifteen miles of said designated route or routes to be withdrawn from preemption, private entry, and sale; and when any portion of said route shall be finally located, the Secretary of the Interior shall cause the said lands hereinbefore granted to be surveyed and set off as fast as may be necessary for the purposes herein named: Provided, That in fixing the point of connection of the main trunk with the eastern connections, it shall be fixed at the most practicable point for the construction of the Iowa and Missouri branches, as hereinafter provided.

SEC. 8. And be it further enacted, That the line of said railroad and telegraph shall commence at a point on the one hundredth meridian of a longitude west from Greenwich, between the south margin of the valley of the Republican River and the north margin of the valley of the Platte River, in the Territory of Nebraska, at a point to be fixed by the President of the United States, after actual surveys; thence running westerly upon the most direct, central, and practicable route, through the territories of the United States, the western boundary of the Territory of Nevada, there to meet and connect with the line of the Central Pacific Railroad Company of California.

SEC. 9. And be it further enacted, That the Leavenworth, Pawnee, and Western Railroad Company of Kansas are hereby authorized to construct a railroad and telegraph line, from the Missouri River, at the mouth of the Kansas River, on the south side thereof, so as to connect with the Pacific railroad of Missouri, to the aforesaid point, on the one hundredth meridian of longitude west from Greenwich, as herein provided, upon the same terms and conditions in all respects as are provided in this act for the construction of the railroad and telegraph line first mentioned, and to meet and connect with the same at the meridian of longitude aforesaid ; and in case the general route or line of road from the Missouri River to the Rocky Mountains should be so located as to require a departure northwardly from the proposed line of said Kansas railroad before it reaches the meridian of longitude aforesaid, the location of said Kansas road shall be made so as to conform thereto; and said railroad through Kansas shall be so located between the mouth of the Kansas River, as aforesaid, and the aforesaid point, on the one hundredth meridian of longitude, that the several railroads from Missouri and Iowa, herein authorized to connect with the same, can make connection within the limits prescribed in this act, provided the same can be done without deviating from the general direction of the whole line to the Pacific coast. The route in Kansas, west of the meridian of Fort Riley, to the aforesaid point, on the one hundredth meridian of longitude, to be subject to the approval of the President of the United States, and to be determined by him on actual survey. And said Kansas company may proceed to build said railroad to the aforesaid point, on the one hundredth meridian of longitude west from Greenwich, in the territory of Nebraska. The Central Pacific Railroad Company of California, a corporation existing under the laws of the State of California, are hereby authorized to construct a railroad and telegraph line from the Pacific coast, at or near San Francisco, or the navigable waters of the Sacramento River, to the eastern boundary of California, upon the same terms and conditions, in all respects, as are contained in this act for the construction of said railroad and telegraph line first mentioned, and to meet and connect with the first mentioned railroad and telegraph line on the eastern boundary of California. Each of said companies shall file their acceptance of the conditions of this act in the Department of the Interior within six months after the passage of this act.

SEC. 10. And be it further enacted, That the said company chartered, by the State of Kansas shall complete one hundred miles of their said road, commencing at the mouth of the Kansas River as aforesaid, within two years after filing their assent to the conditions of this act, as herein provided, and one hundred miles per year thereafter until the whole is completed; and the said Central Pacific Railroad Company of California shall complete fifty miles of their said road within two years after filing their assent to the provisions of this act, as herein provided, and fifty miles per year thereafter until the whole is completed; and after completing their roads, respectively, said companies, or either of them, may unite upon equal terms with the first-named company in constructing so much of said railroad and telegraph line and branch railroads and telegraph lines in this act hereinafter mentioned, through the Territories from the State of California to the Missouri River, as shall then remain to be constructed, on the same terms and conditions as provided in this act in relation to the said Union Pacific Railroad Company. And the Hannibal and St. Joseph Railroad, the Pacific Railroad Company of Missouri, and the first-named company, or either of them, on filing their assent to this act, as aforesaid, may unite upon equal terms, under this act, with the said Kansas company, in constructing said railroad and telegraph, to said meridian of longitude, with the consent of the said State of Kansas; and in case said first-named company shall complete their line to the eastern boundary of California before it is completed across said State by the Central Pacific Railroad Company of California, said first-named company is hereby authorized to continue in constructing the same through California, with the consent of said State, upon the terms mentioned in this act, until said roads shall meet and connect, and the whole line of said railroad and telegraph is completed; and the Central Pacific Railroad Company of California, after completing its road across said State, is authorized to continue the construction of said railroad and telegraph through the Territories of the United States to the Missouri River, including the branch roads specified in this act, upon the routes hereinbefore and hereinafter indicated, on the terms and conditions provided in this act in relation to the said Union Pacific Railroad Company, until said roads shall meet and connect, and the whole line of said railroad and branches and telegraph is completed.

SEC. 11. And be it further enacted, That for three hundred miles of said road most mountainous and difficult of construction, to wit: one hundred and fifty miles westwardly from the eastern base of the Rocky Mountains, and one hundred and fifty miles eastwardly from the western , base of the Sierra Nevada mountains, said points to be fixed by the President of the United States, the bonds to be issued to aid in the construction thereof shall be treble the number per mile hereinbefore provided, and the same shall be issued, and the lands herein granted be set apart, upon the construction of every twenty miles thereof, upon the certificate of the commissioners as aforesaid that twenty consecutive miles of the same are completed. and between the sections last named of one hundred and fifty miles each, the bonds to be issued to aid in the construction thereof shall be double the number per mile first mentioned, and the same shall be issued, and the lands herein granted be set apart, upon the construction of every twenty miles thereof, upon the certificate of the commissioners as aforesaid that twenty consecutive miles of the same are completed: Provided, That no more than fifty thousand of said bonds shall be issued under this act to aid in constructing the main line of said railroad and telegraph.

SEC. 12. And be it further enacted, That whenever the route of said railroad shall cross the boundary of any State or Territory, or said meridian of longitude, the two companies meeting or uniting there shall agree upon its location at that point, with reference to the most direct and practicable through route, and in case of difference between them as to said location the President of the United States shall determine the said location; the companies named in each State and Territory to locate the road across the same between the points so agreed upon, except as herein provided. The track upon the entire line of railroad and branches shall be of uniform width, to be determined by the President of the United States, so that, when completed, cars can be run from the Missouri River to the Pacific coast; the grades and curves shall not exceed the maximum grades and curves of the Baltimore and Ohio railroad; the whole line of said railroad and branches and telegraph shall be operated and used for all purposes of communication, travel, and transportation, so far as the public and government are concerned, as one connected, continuous line; and the companies herein named in Missouri, Kansas, and California, filing their assent to the provisions of this act, shall receive and transport all iron rails, chairs, spikes, ties, timber, and all materials required for constructing and furnishing said first-mentioned line between the aforesaid point, on the one hundredth meridian of longitude and western boundary of Nevada Territory, whenever the same is required by said first-named company, at cost, over that portion of the roads of said companies constructed under the provisions of this act.

SEC. 13. And be it further enacted, That the Hannibal and Saint Joseph Railroad Company of Missouri may extend its roads from Saint Joseph, via Atchison, to connect and unite with the road through Kansas, upon filing its assent to the provisions of this act, upon the same terms and conditions, in all respects for one hundred miles in length next to the Missouri River, as are provided in this act for the construction of the railroad and telegraph line first mentioned, and may for this purpose use any railroad charter which has been or may be granted by the legislature of Kansas; Provided, That if actual survey shall render it desirable, the said company may construct their road, with the consent of the Kansas legislature, on the most direct and practicable route west from St. Joseph, Missouri, so as to connect and unite with the road leading from the western boundary of Iowa at any point east of the one hundredth meridian of west longitude, or with the main trunk road at said point; but in no event shall lands or bonds be given to said company, as herein directed, to aid in the construction of their said road for a greater distance than one hundred miles. And the Leavenworth, Pawnee, and Western Railroad Company of Kansas may construct their road from Leavenworth to unite with the road through Kansas.

SEC. 14. And be it further enacted, That the said Union Pacific Railroad Company is hereby authorized and required to construct a single line of railroad and telegraph from a point on the western boundary of the State of Iowa, to be fixed by the President of the United States, upon the most direct and practicable route, to be subject to his approval, so as to form a connection with the lines of said company at some point on the one hundredth meridian of longitude aforesaid, from the point of commencement on the western boundary of the State of Iowa, upon the same terms and conditions, in all respects, as are contained in this act for the construction of the said railroad and telegraph first mentioned; and the said Union Pacific Railroad Company shall complete one hundred miles of the road and telegraph in this section provided for, in two years after filing their assent to the conditions of this act, as by the terms of this act required, and at the rate of one hundred miles per year thereafter, until the whole is completed: Provided, That a failure upon the part of said company to make said connection in the time aforesaid, and to perform the obligations imposed on said company by this section and to operate said road in the same manner as the main line shall be operated, shall forfeit to the government of the United States all the rights, privileges, and franchises granted to and conferred upon said company by this act. And whenever there shall be a line of railroad completed through Minnesota or Iowa to Sioux City, then the said Pacific Railroad Company is hereby authorized and required to construct a railroad and telegraph from Said Sioux City upon the most direct and practicable route to a point on, and so as to connect with, the branch railroad and telegraph in this section hereinbefore mentioned, or with the said Union Pacific Railroad, said point of junction to be fixed by the President of the United States, not further west than the one hundredth meridian of longitude aforesaid, and on the same terms and conditions as provided in this act for the construction of the Union Pacific Railroad as aforesaid, and to complete the same at the rate of one hundred miles per year; and should said company fail to comply with the requirements of this act in relation to the said Sioux City railroad and telegraph, the said company shall suffer the same forfeitures prescribed in relation to the Iowa branch railroad and telegraph hereinbefore mentioned.

SEC. 15. And be it further enacted, That any other railroad company now incorporated, or hereafter to be incorporated, shall have the right to connect their road with the road and branches provided for by this act, at such places and upon such just and equitable terms as the President of the United States may prescribe. Wherever the word company is used in this act it shall be construed to embrace the words their associates, successors, and assigns, the same as if the words had been properly added thereto.

SEC. 16. And be it further enacted, That at any time after the passage of this act all of the railroad companies named herein, and assenting hereto, or any two or more of them, are authorized to form themselves into one consolidated company; notice of such consolidation, in writing, shall be filed in the Department of the Interior, and such consolidated company shall thereafter proceed to construct said railroad and branches and telegraph line upon the terms and conditions provided in this act.

SEC. 17. And be it further enacted, That in case said company or companies shall fail to comply with the terms and conditions of this act, by not completing said road and telegraph and branches within a reasonable time, or by not keeping the same in repair and use, but shall permit the same, for an unreasonable time, to remain unfinished, or out of repair, and unfit for use, Congress may pass any act to insure the speedy completion of said road and branches, or put the same in repair and use, and may direct the income of said railroad and telegraph line to be thereafter devoted to the use of the United States, to repay all such expenditures caused by the default and neglect of such company or companies: Provided, That if said roads are not completed, so as to form a continuous line of railroad, ready for use, from the Missouri River to the navigable waters of the Sacramento River, in California, by the first day of July, eighteen hundred and seventy-six, the whole of all of said railroads before mentioned and to be constructed under the provisions of this act, together with all their furniture, fixtures, rolling stock, machine shops, lands, tenements, and hereditaments, and property of every kind and character, shall be forfeited to and be taken possession of by the United States: Provided, That of the bonds of the United States in this act provided to be delivered for any and all parts of the roads to be constructed east of the one hundredth meridian of west longitude from , Greenwich, and for any part of the road west of the west foot of the Sierra Nevada mountain, there shall be reserved of each part and installment twenty-five per centum, to be and remain in the United States treasury, undelivered, until said road and all parts thereof provided for in this act are entirely completed; and of all the bonds provided to be delivered for the said road, between the two points aforesaid, there shall be reserved out of each installment fifteen per centum, to be and remain in the treasury until the whole of the road provided for in this act is fully completed; and if the said road or any part thereof shall fail of completion at the time limited therefor in this act, then and in that case the said part of said bonds so reserved shall be forfeited to the United States.

SEC. 18. And be it further enacted, That whenever it appears that the net earnings of the entire road and telegraph, including the amount allowed for services rendered for the United States, after deducting all, expenditures, including repairs, and the furnishing, running, and managing of said road, shall exceed ten per centum upon its cost, exclusive of the five per centum to be paid to the United States, Congress may reduce the rates of fare thereon, if unreasonable in amount, and may fix and establish the same by law. And the better to accomplish the object of this act, namely, to promote the public interest and welfare by the construction of said railroad and telegraph line, and keeping the same in working order, and to secure to the government at all times (but particularly in time of war) the use and benefits of the same for postal, military and other purposes, Congress may, at any time, having due regard for the rights of said companies named herein, add to, alter, amend, or repeal this act.

SEC. 19. And be it further enacted, That the several railroad companies herein named are authorized to enter into an arrangement with the Pacific Telegraph Company, the Overland Telegraph Company, and the California State Telegraph Company, so that the present line of telegraph between the Missouri River and San Francisco may be moved upon or along the line of said railroad and branches as fast as said roads and branches are built; and if said arrangement be entered into and the transfer of said telegraph line be made in accordance therewith to the line of said railroad and branches, such transfer shall, for all purposes of this act, be held and considered a fulfillment on the part of said railroad companies of the provisions of this act in regard to the construction of said line of telegraph. And, in case of disagreement, said telegraph companies are authorized to remove their line of telegraph along and upon the line of railroad herein contemplated without prejudice to the rights of said railroad companies named herein.

SEC. 20. And he it further enacted, That the corporation hereby created and the roads connected therewith, under the provisions of this act, shall make to the Secretary of the Treasury an annual report wherein shall be set forth –

First. The names of the stockholders and their places of residence, so far as the same can be ascertained;

Second. The names and residences of the directors, and all other officers of the company;

Third. The amount of stock subscribed, and the amount thereof actually paid in;

Fourth. A description of the lines of road surveyed, of the lines thereof fixed upon for the construction of the road, and the cost of such surveys;

Fifth. The amount received from passengers on the road;

Sixth. The amount received for freight thereon;

Seventh. A statement of the expense of said road and its fixtures;

Eighth. A statement of the indebtedness of said company, setting forth the various kinds thereof. Which report shall be sworn to by the president of the said company, and shall be presented to the Secretary of the Treasury on or before the first day of July in each year.

Colonel Charles Russell Lowell to Josephine Shaw, July 7, 1863

Camp On Seneca Creek, July 7, 1863.

Don't you wish that your Colonel was one who belonged to the Army of the Potomac? He does, I'm sure. We haven't seen the papers since Sunday, but we have scraps of news by telegraph and by messengers, and, as far as we can learn, Lee is in full retreat and Meade in hot pursuit: they say even that the pontoons at Shepardstown (if there were any there) have been destroyed by a column from Frederick: if so, we are likely to make the defeat a rout. Beyond the natural rejoicing at so great a victory to our arms, the circumstances under which this fight was won make it doubly acceptable: a defeat would have forced the Administration to take back McClellan, and, as a citizen, I should have regarded that as very unfortunate, — a victory under Hooker might have been almost as bad as a defeat.

But Meade is a good man and a modest man, — his head will not be turned, — and furthermore, he having been so short a time in command, I think that, while due credit is given to him for skilful disposition and for pluck, we may yet without injustice attribute something more to Fortune, and much more to the Army itself, than we should have been disposed to, had Meade's command been even a week older. How do you adapt this victory to your theory, — do you give up the theory, or do you expound the victory as an indication that we have been sufficiently humiliated, have mended our ways and are now all right? I hope people in general will not take the latter view, for it seems to me that this is only the beginning of our real danger, and that it is going to be more difficult to use victories than to bear defeats. Oh, I can't help often wishing that the times were not quite so much out of joint. Will and I were counting over the “satisfactory” people of our acquaintance, the other day, and very few they were: it seems to me that this change in public affairs has entirely changed my standard, and that men whom two years ago I should have almost accepted as satisfactory, now show lamentably deficient: men do not yet seem to have risen with the occasion, and the perpetual perception of this is uncomfortable.

Lieutenant-Colonel Theodore Lyman to Elizabeth Russell Lyman, Friday, October 2, 1864

Abou Ben Butler had quite a stampede last night. Having got so far away from home, he conceived that the whole southern host was massed to crush him, and communicated the same with much eloquence, by the instrumentality of the magnetic telegraph; whereat Major-General Humphreys, Chief-of-Staff, had the brutality to laugh! We made our usual peregrination to Globe Tavern, where we got about 10 o'clock. Here General Meade sent me to look for a new camp, first enquiring if I felt well enough for that arduous service, as he looks on me as a tender convalescent! It was a tedious business getting a spot; for the whole country was either occupied, or was very dirty from old camps. At quarter to eleven, as I was poking about, I heard firing to the left, pretty sharp for a few minutes, and supposed there might be quite a fight; but it died away, shortly, except the cannon, which were not frequent. I got to the front about one, and met General Meade at the Peeble house. He had been to the Pegram house and it was near there he had such a narrow escape from a shell. I told them that, had I been there, I should have been the odd man that would have been hit; for they all said that the Staff could not well have been arranged again so that there would have been room for a three-inch shot to pass without hitting somebody. The cause of the firing was, that the whole line advanced, except the right division, and established a front position at the Pegram house. . . .

The engineers were trotting round briskly, you may depend, ordering a redoubt here and a battery there, all intent on fencing in our new property. Luckily, the soil is very light and easy to dig, for our earthworks have now to be measured by miles. Not only must the front be protected, but the exposed flank and the rear. With what men we have, we do a great deal. Since we left Culpeper, I have not seen the troops look so healthy. If we could work a little more backbone into that 9th Corps, it would help wonderfully; but they started green and that is no way to ripen men. Many faults there have been also in the command. The men are in good spirits, I think, and well conditioned for the prosecution of the campaign. The evening of Sunday we went to our new camp, having lived nearly three months in the old one. It seemed quite like leaving home; for you get used to your little canvas house, pitched in a particular spot. The new camp is well enough placed, but in a region of evil savors. There is a timber bridge near by, and, every waggon that went over it, the General would jump and say, “By Jove, there is heavy musketry!” Gradually he learned the difference of sound and settled down quietly. The weather has been very warm the last day or two.

Yesterday, as soon as I reached here, where there is a telegraph, I telegraphed to City Point to enquire about Willie,1 and received a reply from the medical officer in charge of the hospital that Willie had left the day before for Washington, doing well, the ball having been extracted. You can therefore imagine how shocked I was about midnight to get a despatch from Sandy Dallas, at Washington, stating Willie had died on the passage. I presume he must have died of hemorrhage, or some of those secondary causes that suddenly occur in gun-shot wounds. What a dreadful shock for his poor wife and your mother, and how it will mar the exultation of our recent victories!

Willie had established a high character for himself, and was doing so well that it seems hard he should be thus suddenly taken off. My God, what misery this dreadful war has produced, and how it comes home to the doors of almost every one!

I have written you fully, urging on you patience and resignation. Popular fame is at best but ephemeral, and so long as one has a clear conscience that he has done his duty, he can look, or at least should look, with indifference on the clamor of the vulgar.

I have received a very kind letter from Cortlandt Parker, and I enclose you one received to-day from Mr. Jay, of New York, so that I am not entirely without friends, though the few I have render them the more valuable. But, with or without friends, we ought to be happy so long as God spares our lives and blesses us with health, and our consciences are clear that we have done all we could. I trust we will soon have peace, and then I may be permitted to return to you and the children. This will compensate me for all I have gone through.

The telegraph will have conveyed to you, long before this reaches you, the joyful intelligence that Petersburg and Richmond have fallen, and that Lee, broken and dispirited, has retreated towards Lynchburg and Danville. We have had three glorious days, the fighting not so severe as much we have done before, but in the results. We are now moving after Lee, and if we are successful in striking him another blow before he can rally his troops, I think the Confederacy will be at an end.

George1 is quite well, having left his uncle at City Point, where it was deemed advisable he should stop for awhile. Willie2 was doing very well, and is not considered in any danger.

Markoe Bache arrived this morning just in time to march into Petersburg with us.

The strong demonstration we made on Lee's right caused him so to attenuate his lines that, notwithstanding their strength, we broke through his left, and poured in such a force that he had to fly to save himself. He was fortunate in keeping us out of the town till dark, which enabled him to get over the Appomattox what remained of his army. The last estimate of our prisoners amounted to fifteen thousand, and deserters and stragglers are being picked up by the thousands. Let us hope the war will soon be over.

Major Rutherford B. Hayes to Lucy Webb Hayes, October 8, 1861

Tuesday morning, 6 A. M., October 8.
Your election day.

Dearest: — This wet dirty letter and its writer have had considerable experience in the last twenty-four hours, and since the above was written. In the first place we have had another bitter storm, and this cold raw morning we shiver unless near the fires. At one time yesterday I thought I should have to take back a good deal of what I said in the letter I had just started for Cincinnati. I was at the hospital three-quarters mile from camp, helping Dr. Joe and Captain Skiles put the sick into wagons to be transported to Gallipolis and Cincinnati, when firing was heard and word came that the enemy in force had attacked our camp. The doctor and I hurried back leaving Captain Skiles to look after the sick. All the army, seven regiments (five to six thousand men), were forming in line of battle. I joined my regiment, and after waiting a half hour or so we were ordered to quarters with word that it was only a scouting party driving in our pickets. This was all in a rain-storm. The poor fellows in hospital — many of them — panic-stricken, fled down the road and were found by Dr. Joe on his return three or four miles from the hospital. Three of our regiment got up from their straw piles, got their guns and trudged up the road and took their places in line of battle. The behavior of the men was for the most part perfectly good. The alarm was undoubtedly a false one. No enemy is near us.

We shall go, if the sun comes out, seven miles nearer home, to Mountain Cove, and begin to build quarters and fortifications for a permanent stronghold. This brings us within an easy day's ride of the navigable waters of the Kanawha. Thence a steamboat can take us in about a day or so to Cincinnati. Pretty near to you. Telegraph also all the way.

Speaking of telegraph makes me think I ought to say Captain Gaines (our prosecuting attorney) has done as much, I think more, useful service, dangerous too, than any other officer in western Virginia. The history of his company, protecting the telegraph builders, would be a volume of romantic adventures.

Lieutenant Christie, of General Cox's staff, tells me Union Chapel has had a division, and troubles. Sorry to hear it. If you are compelled to leave, be in no haste to choose a new church. I want to confer on that subject. I think it important to be connected with a church, and with the right one. Mere nearness is important. This would favor the church near Seventh and Mound, if you can consent to go to a Presbyterian [church]. But of this hereafter.

I somehow think we shall meet within a month or two. I am very well and very full of fun this morning. A credit to be jolly.

Major-General George G. Meade to Margaretta Sergeant Meade, January 10, 1865

Tuesday Evening, January 10, 1865.

I reached City Point at 6 P. M. to-day. I found the cause of my recall to be as I expected. General Grant had received information of Lee's sending off two divisions of troops, and was, and is, under the impression that it is the commencement of the evacuation of Richmond. Should this prove to be the case, or should Lee materially weaken his force, we will take the initiative, and for this contingency I was required. I explained to General Grant Sergeant's1 condition and my earnest desire to remain with him. He expressed regret he had not known all I told him, and promised to let me return to Philadelphia as soon as this affair was settled. As I do not believe Lee is going to give us any chance, I am in hopes it will not be long before I return. I telegraphed you this morning from Fortress Monroe, because we had last night an accident on the bay, which I feared might be exaggerated in the papers, and you alarmed. The night was dark and foggy, and we were run into by a schooner. Fortunately the damage was confined to the upper works, and although four lives were lost, and several bruised, we received no material injury, and our boat continued on. For a time, however, before the extent of the injury was known, there was much alarm and excitement on board our boat, which was unusually crowded, owing to the ice on the Potomac.

The great subject of discussion in the army is the recent relieving of General Butler.2 He was relieved by the President, on Grant's request. The particular cause had not been made public.

It is hardly necessary I should tell you how much I have suffered since I left you. All I can do is earnestly to pray God to have mercy on dear Sergeant and yourself, and to give you strength to bear up under the affliction you are visited with. My heart is too full to write more.

June 23, 1864

All were up at an early hour and ready for an advance, which had been ordered. On the right, towards the Gregory house, we were already against them, and I suppose my friend there, Major Crow, had seen us under more hostile circumstances.  . . . By 4.30 General Meade started for General Wright's Headquarters at the Williams house, where he ordered me to stay, when he left at seven.  . . . I rode about with General Wright, who visited his line, which was not straight or facing properly. That's a chronic trouble in lines in the woods. Indeed there are several chronic troubles. The divisions have lost connection; they cannot cover the ground designated, their wing is in the air, their skirmish line has lost its direction, etc., etc. Then General Meade gets mad with the delay. The commanders say they do as well as they can, etc. Well, Ricketts ran one way and Russell another; and then the 2d Corps — how did that run? and were the skirmishers so placed as to face ours? and what would General Birney do about it? How long was the line? could it advance in a given direction, and, if so, how? All of which is natural with a good many thousand men in position in a dense wood, which nobody knows much about. All this while the men went to sleep or made coffee; profoundly indifferent to the perplexities of their generals; that was what generals were paid for. When General Wright had looked a great deal at his line, and a great deal more at his pocket compass, he rode forth on the left to look at the pickets, who were taking life easy like other privates. They had put up sun-shades with shelter-tents and branches, and were taking the heat coolly. . . .

About this time a Vermont captain (bless his soul!) went and actually did something saucy and audacious. With eighty sharpshooters he pushed out boldly, drove in a lot of cavalry, and went a mile and a quarter to the railroad, which he held, and came back in person to report, bringing a piece of the telegraph wire.  . . . Some time in the morning, I don't exactly know when, the signal officers reported a large force, say two divisions, marching out from the town, along the railroad, whereof we heard more anon. At noon there still had been no advance, and General Wright went to General Birney to arrange one. There was General Meade, not much content with the whole affair. They all pow-wowed a while, and so we rode back again, through the dreary woods, through which fires had run. It was after two when we returned. Now then — at last — all together — skirmishers forward! And away they go, steadily. Oh, yes! but Rebs are not people who let you sit about all the day and do just as you like; remember that always, if nothing else. There are shots away out by the railroad — so faint that you can scarce hear them. In comes a warm sharpshooter: “They are advancing rapidly and have driven the working party from the railroad.” Here come the two divisions, therefore, or whatever they are. “Stop the advance,” orders General Wright. “General Wheaton, strengthen that skirmish line and tell them to hold on." The remainder of Wheaton's division is formed on the flank, and begins making a breastwork; more troops are sent for. The fire of the skirmishers now draws nearer and gets distinct; but, when the reinforcement arrives, they make a stout stand, and hold them.  . . . All the while the telegraph is going: “Don't let 'em dance round you, pitch into them!” suggests General Meade (not in those exact words). “Don't know about that — very easy to say — will see about it,” replies the cautious W.; etc., etc. Pretty soon the cavalry comes piling in across the Aiken oat-field; they don't hold too long, you may be certain. This exposes the flank of the picket line, which continues to shoot valiantly. In a little while more, a division officer of the day gallops in and says they have broken his skirmishers and are advancing in line of battle. But the Rebels did not try an approach through the open oat-field: bullets would be too thick there; so they pushed through the woods in our rear. I could hear them whooping and ki-yi-ing, in their peculiar way. I felt uncomfortable, I assure you. It was now towards sunset. Our position was right in the end of the loop, where we should get every bullet from two sides, in event of an attack. General Grant, of the Vermont Brigade, walked up and said, in his quiet way: “Do you propose to keep your Headquarters here?” “Why not?” says Ricketts. “Because, when the volleys begin, nothing can live here.” To which Ricketts replied, “Ah?” as if someone had remarked it was a charming evening, or the like. I felt very like addressing similar arguments to General Wright, but pride stood in the way, and I would have let a good many volleys come before I would have given my valuable advice. A column of attack was now formed by us, during which the enemy pushed in their skirmishers and the bullets began to slash among the trees most spitefully; for they were close to; whereat Wright (sensible man!) vouchsafed to move on one side some seventy yards, where we only got accidental shots. And what do you think? It was too dark now for us to attack, and the Rebs did not — and so, domino, after all my tremendous description! Worse than a newspaper isn't it? I was quite enraged to be so scared for no grand result.1

Diary of John Beauchamp Jones: April 21, 1861

Received several letters to-day which had been delayed in their transmission, and were doubtless opened on the way. One was from my wife, informing me of the illness of Custis, my eldest son, and of the equivocal conduct of some of the neighbors. The Rev. Mr. D., son of the late B___p, raised the flag of the Union on his church.

The telegraphic wires are still in operation.

Lieutenant-Colonel Theodore Lyman to Elizabeth Russell Lyman, May 12, 1864


May 12, 1864

This was the date of one of the most fearful combats, which lasted along one limited line, and in one spot, more than fourteen hours, without cessation. I fancy this war has furnished no parallel to the desperation shown here by both parties. It must be called, I suppose, the taking of the Salient.

Hancock was ordered to attack with his corps as soon after four in the morning as possible and Burnside was to follow the example. A little after daylight we were all gathered round General Grant's tent, all waiting for news of importance. The field telegraph was laid to all corps Headquarters and there we could hear from all parts. At a little after five o'clock, General Williams approached from the telegraph tent; a smile was on his face: Hancock had carried the first line! Thirty minutes after, another despatch: he had taken the main line with guns, prisoners and two generals! Great rejoicings now burst forth. Some of Grant's Staff were absurdly confident and were sure Lee was entirely beaten. My own experiences taught me a little more scepticism. Hancock presently sent to ask for a vigorous attack on his right, to cover and support his right flank. General Wright was accordingly ordered to attack with a part of the 6th Corps. As I stood there waiting, I heard someone say, “Sir, this is General Johnson.” I turned round and there was the captured Major-General, walking slowly up. He was a strongly built man of a stern and rather bad face, and was dressed in a double-breasted blue-grey coat, high riding boots and a very bad felt hat. He was most horribly mortified at being taken, and kept coughing to hide his emotion. Generals Meade and Grant shook hands with him, and good General Williams bore him off to breakfast. His demeanor was dignified and proper. Not so a little creature, General Steuart, who insulted everybody who came near him, and was rewarded by being sent on foot to Fredericksburg, where there was plenty of mud and one stream up to his waist. Our attack was a surprise: the assaulting columns rushed over the breastworks without firing a shot, and General Johnson, running out to see the reason of the noise, found himself surrounded by blue blouses. I was now sent by General Meade to see how far General Wright's column of attack was prepared. I found the columns going into the woods south of the Brown house; the enemy had seen them and the shells were crashing through the thick pines. When I came back and reported, the General said: “Well, now you can take some orderlies and go to General Wright and send me back intelligence from time to time.” There are some duties that are more honorable than pleasant! As I turned into the pines, the musketry began, a good way in front of me. I pressed past the column that was advancing. Presently the bullets began to come through the pine trees. Then came back a Staff officer, yelling: “Bring up that brigade! Bring it up at the double-quick!” "Doublequick," shouted the officers, and the column started on a run.

Major Rutherford B. Hayes to Sardis Birchard, August 26, 1861

August 26, 1861.

Dear Uncle : — We are camped somewhere near, I think, the head of Tygart's Valley, near Cheat Mountain Pass. Several regiments are in sight, and the enemy under Lee so near that our outposts have fights with his daily. We are under a capital general, and are fast getting ready. I think we are safe; if not, we shall be within a very short time. We expect to stay here until we or the enemy are whipped, or back out for fear of a whipping — probably weeks.

We are in [a] lovely little valley on a fine clear trout stream, with high mountains on all sides and large trees over us. A perfect camp, perfectly protected by entrenchments for miles up the valley, pickets and scouts in all directions, etc., etc. A telegraph finished to headquarters of our general from General Rosecrans' at Clarksburg, and rapid mail carriers daily to the same place. For instance, your letter of the 19th was handed to me at my tent by the courier within half an hour after our arrival here.

Glad Fanny is with you. Lee will not whip us unless we attack him with a force too small. If he attacks us, we are the best off. The postage stamps are all gone.
