Diary of John Beauchamp Jones: April 2, 1863

This morning early a few hundred women and boys met as by concert in the Capitol Square, saying they were hungry, and must have food. The number continued to swell until there were more than a thousand. But few men were among them, and these were mostly foreign residents, with exemptions in their pockets. About nine A.m. the mob emerged from the western gates of the square, and proceeded down Ninth Street, passing the War Department, and crossing Main Street, increasing in magnitude at every step, but preserving silence and (so far) good order. Not knowing the meaning of such a procession, I asked a pale boy where they were going. A young woman, seemingly emaciated, but yet with a smile, answered that they were going to find something to eat I could not, for the life of me, refrain from expressing the hope that they might be successful; and I remarked they were going in the right direction to find plenty in the hands of the extortioners. I did not follow, to see what they did; but I learned an hour after that they marched through Cary Street, and entered diverse stores of the speculators, which they proceeded to empty of their contents. They impressed all the carts and drays in the street, which were speedily laden with meal, flour, shoes, etc. I did not learn whither these were driven; but probably they were rescued from those in charge of them. Nevertheless, an immense amount of provisions, and other articles, were borne by the mob, which continued to increase in numbers. An eye-witness says he saw a boy come out of a store with a hat full of money (notes); and I learned that when the mob turned up into Main Street, when all the shops were by this time closed, they broke in the plate-glass windows, demanding silks, jewelry, etc. Here they were incited to pillage valuables, not necessary for subsistence, by the class of residents (aliens) exempted from military duty by Judge Campbell, Assistant Secretary of War, in contravention of Judge Meredith's decision. Thus the work of spoliation went on, until the military appeared upon the scene, summoned by Gov. Letcher, whose term of service is near its close. He had the Riot Act read (by the mayor), and then threatened to fire on the mob. He gave them five minutes' time to disperse in, threatening to use military force (the city battalion being present) if they did not comply with the demand. The timid women fell back, and a pause was put to the devastation, though but few believed he would venture to put his threat in executions If he had done so, he would have been hung, no doubt.

About this time the President appeared, and ascending a dray, spoke to the people. He urged them to return to their homes, so that the bayonets there menacing them might be sent against the common enemy. He told them that such acts would bring famine upon them in the only form which could not be provided against, as it would deter people from bringing food to the city. He said he was willing to share his last loaf with the suffering people (his best horse had been stolen the night before), and he trusted we would all bear our privations with fortitude, and continue united against the Northern invaders, who were the authors of all our sufferings. He seemed deeply moved; and indeed it was a frightful spectacle, and perhaps an ominous one, if the government does not remove some of the quartermasters who have contributed very much to bring about the evil of scarcity. I mean those who have allowed transportation to forestalled and extortioners.

Gen. Elzey and Gen. Winder waited upon the Secretary of War in the morning, asking permission to call the troops from the camps near the city, to suppress the women and children by a summary process. But Mr. Seddon hesitated, and then declined authorizing any such absurdity. He said it was a municipal or State duty, and therefore he would not take the responsibility of interfering in the matter. Even in the moment of aspen consternation, he was still the politician.

I have not heard of any injuries sustained by the women and children. Nor have I heard how many stores the mob visited j and it must have been many.

All is quiet now (three p.m.); and I understand the government is issuing rice to the people.

Diary of John Beauchamp Jones: March 24, 1863

Judge Lyons has granted an injunction, arresting the impressment of flour by the Secretary of War, and Congress is debating a bill which, if passed, will be a marked rebuke to the government.

Notwithstanding the wishes of the Secretary of War, the President, and Gen. Rains, Lt.-Col. Lay is still exempting Marylanders, and even foreigners who have bought real estate, and resided for years in this country, if they have “not taken the oath of domicile.”

In Eastern Tennessee, 25,500 conscripts were enrolled, and yet only 6000 were added to the army. The rest were exempted, detailed, or deserted. Such is the working of the Conscription Act, fettered as it is by the Exemption Law, and still executed under Judge Campbell's decision. Gen. Rains has the title, but does not execute the functions of Superintendent of the Bureau of Conscription. The President has been informed of everything.

Diary of John Beauchamp Jones: March 17, 1863

On Saturday, the enemy's lower Mississippi fleet attacked our batteries at Port Hudson. The result reported is that only one of their gun-boats got past, and that in a damaged condition. The frigate Mississippi, one of the best war steamers of the United States, was burned, and the rest retired down the river, badly repulsed. We sustained no loss.

To-day, the Secretary of War sent in a paper indorsing Judge Meredith's opinion in regard to foreigners who have accepted service in our country, viz., that they are liable to conscription. This is in the teeth of the decision of the Assistant Secretary, Judge Campbell, Col. Lay's father-in-law, and upon which the bureau has been acting, although Gen. Rains, the Superintendent, permitted it with reluctance, upon the assurance of Col. L. that such was the will of the department. This business may produce an explosion.

I walked with Gen. Rains this afternoon in Capitol Square. He is annoyed at the action of Col. Lay in following the instructions of the Assistant Secretary of War in regard to foreigners. The decision had not the sanction of the Secretary of War, Mr. Seddon. He thinks several thousand men may have been permitted to escape military service by it He intended to lay Judge Campbell's decision before the President, but it disappeared very mysteriously from his desk. And to-day it reappeard just as mysteriously. And, simultaneously, and quite as mysteriously, a paper appeared, signed by Mr. Seddon, Secretary of War, suggesting that the bureau act in conformity with Judge Meredith's opinion, directly in the teeth of Mr. Assistant Secretary Campbell's decision! And-it was dated March 13th, full four days before. What delayed it, and who brought it, no one seemed to know. Col. Lay suggested that it be sent back, with an indorsenent that the bureau had been already acting under the decision of Judge Campbell (just the reverse of the opinion), Assistant Secretary of War, “by order of the Secretary of War.” To this Gen. R. demurred, and said the bureau would conform its action to Mr. Seddon's suggestions; and he charged a clerk to preserve that paper. Col. L. grumbled awfully at Mr. Seddon's off-hand decision, without mature reflection.

Gen. Stewart (of Maryland) was at the office a short time before, and advocated Mr. Seddon's views; for he knew how many Marylanders would be embraced in the decision, as well as other foreigners.

Lieut.-Col. A. C. Jones, Assistant Adjutant-General, had, in the name of the bureau, notified Gen. Winder, this morning, that Marylanders, etc. were not liable to bear arms for the South after being in the service two years!

The general says he will have all the commandants of conscripts written to immediately; and that he will have an interview with the Secretary of War in relation to the matter.

Every man we can put in the field is demanded; and many fear we shall not have a sufficient number to oppose the overwhelming tide soon to be surging over the land. At such a crisis, and in consideration of all the circumstances attending this matter, involving the loss of so many men, one is naturally startled at Judge Campbell's conduct.

Diary of John Beauchamp Jones: March 8, 1863

Judge Meredith's opinion, that foreigners, Marylanders, and others, who have served in the army, have become domiciled, and are liable to conscription, has produced a prodigious commotion. Gen. Winder's door is beset with crowds of eager seekers of passports to leave the Confederacy; and as these people are converting their Confederate money into gold, the premium on specie has advanced.

Judge Campbell, Assistant Secretary of War, has decided that Judge Meredith's opinion is not authority; and hence his son-inlaw, Lieut.-Col. Lay, who at present wields the Conscription Bureau, acts accordingly. But Gen. Rains has a contrary opinion; and he intended to see the President yesterday, who is understood to coincide with Judge Meredith. It is also alleged that Secretary Seddon concurs in this opinion; and if this be the case, an explosion is imminent — for Judge Campbell must have given instructions “by order of the Secretary,” without the Secretary's knowledge or consent.

I advised the general to see the President and Secretary once a week, and not rely upon verbal instructions received through a subordinate; he said the advice was good, and he should follow it. But he is much absorbed in his subterrene batteries.

Diary of John Beauchamp Jones: November 20, 1862

A letter from Brig. H. Marshall, Abingdon, Ky., in reply to one from the Secretary, says his Kentuckians are not willing to be made Confederate hog-drivers, but they will protect the commissary's men in collecting and removing the hogs. Gen. M. criticises Gen. Bragg's campaign very severely. He says the people of Kentucky looked upon their fleeting presence as a horse-show, or military pageantry, and not as indicating the stern reality of war. Hence they did not rise in arms, and hence their diffidence in following the fortunes of the new Confederacy. Gen. M. asks if it is the purpose of the government to abandon Kentucky, and if so, is he not functus officio, being a Kentucky general, commanding Kentucky troops?

Col. Myers has placed on file in the department a denial of having said to Gen. Wise's quartermaster, “Let them suffer.”

Several ladies, near relatives of Judge Campbell, Assistant Secretary of War, came over yesterday under flag of truce. They lived, I believe, in Alexandria.

Another requisition has been made by the engineer for 5000 negroes to work on the fortifications of Richmond.

No letters were received from Gen. Lee to-day, and he may be (busy in the field. Accounts say the enemy is planting batteries in the heights opposite Fredericksburg.

It has been raining occasionally the last day or two. I hope the ground is soft, and the mud deep; if so, Burnside cannot move on Richmond, and we shall have time to prepare for “contingencies.”

Yesterday salt sold at auction for $1.30 per pound. We are getting into a pretty extreme condition.

Memorandum of Justice John A. Campbell, March 22, 1861

No. 3.

As the result of my interviewing of to-day I have to say that I have still unabated confidence that Fort Sumter will be evacuated, and that no delay that has occurred excites in me any apprehension or distrust, and that the state of things existing at Fort Pickens will not be altered prejudicially to the Confederate States. I counsel inactivity in making demands on the Government for the present. I shall have knowledge of any change in the existing status.

No. 2.

My confidence in the two facts stated in my note of the 15th, to wit: that Fort Sumter is to be evacuated, and that provisions have been made for that purpose and will be completed without
any delay or any disposition for delay, is unabated.

2d. That no prejudicial movement to the South is contemplated as respects Fort Pickens. I shall be able to speak positively to-morrow afternoon.

Notes of Justice J. A. Campbell, Copy “A,” March 15, 1861

No. 1.

I feel perfect confidence in the fact that Fort Sumter will be evacuated in the next five days, and that this is felt to be a measure imposing vast responsibility upon the administration.

I feel perfect confidence that no measure changing the existing status of things prejudicially to the Southern Confederate States is at present contemplated.

I feel entire confidence that any immediate demand for an answer to the communication of the Commissioners will be productive of evil and not of good. I do not believe that it should be pressed.

I earnestly ask for a delay until the effect of the evacuation of Fort Sumter can be ascertained — or at least for a few days, say ten days.

Diary of John Beauchamp Jones: November 2, 1862

I watch the daily orders of Adjutant and Inspector-Gen. Cooper. These, when “by command of the Secretary of War,” are intelligible to any one, but not many are by his command. When simply “by order,” they are promulgated by order of the President, without even consulting the Secretary; and they often annul the Secretary's orders. They are edicts, and sometimes thought very arbitrary ones. One of these orders says liquor shall not be introduced into the city; and a poor fellow, the other day, was sentenced to the ball-and-chain for trying to bring hither his whisky from Petersburg. On the same day Gov. Brown, of Georgia, seized liquor in his State, in transitu over the railroad, belonging to the government!

Since the turning over of the passports to Generals Smith and Winder, I have resumed the position where all the letters to the department come through my hands. I read them, make brief statements of their contents, and send them to the Secretary. Thus all sent by the President to the department go through my hands, being epitomized in the same manner.

The new Assistant Secretary, Judge Campbell, has been ordering the Adjutant-General too peremptorily; and so Gen. Cooper has issued an order making Lieut.-Col. Deas an Acting Assistant Secretary of War, thus creating an office in defiance of Congress.

Diary of John Beauchamp Jones: October 22, 1862

Back at the department at work, but not much to do yet. The mails are not heavy.

We have Bragg's report of the battle of Perryville. He beat the enemy from his positions, driving him back two miles, when night set in. But finding overwhelming masses accumulating around him, he withdrew in good order to Bryattsville. Thus Kentucky is given up for the present!

McClellan has retired back into Maryland, hoping, I suppose, Lee will follow and fall into his ambuscade.

The President will call out, under the Conscription Act, all between the ages of eighteen and forty. This will furnish, according to the Secretary's estimate, 500,000, after deducting the exempts. A great mistake.

A letter from Gen. Lee indicates that he is in favor of making Treasury notes a legal tender. It was so with Washington concerning Continental money — but Congress pays no attention to the subject. Why does not the President recommend it? It would then pass — for, at present, he is master.

The paper from the Provost Marshal, referred by the latter to the President, came back to-day. The Secretary, in referring it, seems to incline to the opinion that the writ of habeas corpus not being suspended, there was no remedy for the many evils the Provost Marshal portrayed. The President, however, did not wholly coincide in that opinion. He says: “The introduction and sale of liquors must be prevented. Call upon the city authorities to withhold licenses, and to abate the evil in the courts, or else an order will be issued, such as the necessity requires.

Judge Campbell, late of the United States Supreme Court, has been appointed Assistant Secretary of War.

Diary of William Howard Russell: May 18, 1861

An exceedingly hot day, which gives bad promise of comfort for the Federal soldiers, who are coming, as the Washington Government asserts, to put down rebellion in these quarters. The mosquitoes are advancing in numbers and force. The day I first came I asked the waiter if they were numerous. “I wish they were a hundred times as many,” said he. On my inquiring if he had any possible reason for such an extraordinary aspiration, he said, “because we would get rid of these darned black republicans out of Fort Pickens all the sooner.” The man seemed to infer that they would not bite the Confederate soldiers.

I dined at Dr. Nott's, and met Judge Campbell, who has resigned his high post as one of the Judges of the Supreme Court of the United States, and explained his reasons for doing so in a letter, charging Mr. Seward with treachery, dissimulation, and falsehood. He seemed to me a great casuist rather than a profound lawyer, and to delight in subtle distinctions and technical abstractions; but I had the advantage of hearing from him at great length the whole history of the Dred Scott case, and a recapitulation of the arguments used on both sides, the force of which, in his opinion, was irresistibly in favor of the decision of the Court. Mr. Forsyth, Colonel Hardee, and others were of the company.

To me it was very painful to hear a sweet ringing silvery voice, issuing from a very pretty mouth, “I'm so delighted to hear that the Yankees in Fortress Monroe have got typhus fever. I hope it may kill them all.” This was said by one of the most charming young persons possible, and uttered with unmistakable sincerity, just as if she had said, “I hear all the snakes in Virginia are dying of poison.” I fear the young lady did not think very highly of me for refusing to sympathize with her wishes in that particular form. But all the ladies in Mobile belong to “The Yankee Emancipation Society.” They spend their days sewing cartridges, carding lint, preparing bandages, and I'm not quite sure that they don't fill shells and fuses as well. Their zeal and energy will go far to sustain the South in the forthcoming struggle, and no where is the influence of women greater than in America.

As to Dr. Nott, his studies have induced him to take a purely materialist view of the question of slavery, and, according to him, questions of morals and ethics, pertaining to its consideration, ought to be referred to the cubic capacity of the human cranium — the head that can take the largest charge of snipe shot will eventually dominate in some form or other over the head of inferior capacity. Dr. Nott detests slavery, but he does not see what is to be done with the slaves, and how the four millions of negroes are to be prevented from becoming six, eight, or ten millions, if their growth is stimulated by high prices for Southern produce.

There is a good deal of force in the observation which I have heard more than once down here, that Great Britain could not have emancipated her negroes had they been dwelling within her border, say in Lancashire or Yorkshire. No inconvenience was experienced by the English people per se in consequence of the emancipation, which for the time destroyed industry and shook society to pieces in Jamaica. Whilst the States were colonies, Great Britain viewed the introduction of slaves to such remote dependencies with satisfaction, and when the United States had established their sovereignty they found the institution of slavery established within their own borders, and an important, if not essential, stratum in their social system. The work of emancipation would have then been comparatively easy; it now is a stupendous problem which no human being has offered to solve.

Diary of Mary Boykin Chesnut: March 10, 1865


Went to church crying to Ellen, “It is Lent, we must fast and pray.” When I came home my good fairy, Colonel Childs, had been here bringing rice and potatoes, and promising flour. He is a trump. He pulled out his pocket-book and offered to be my banker. He stood there on the street, Miss Middleton and Isabella witnessing the generous action, and straight out offered me money. “No, put up that,” said I. “I am not a beggar, and I never will be; to die is so much easier.”

Alas, after that flourish of trumpets, when he came with a sack of flour, I accepted it gratefully. I receive things I can not pay for, but money is different. There I draw a line, imaginary perhaps. Once before the same thing happened. Our letters of credit came slowly in 1845, when we went unexpectedly to Europe and our letters were to follow us. I was a poor little, inoffensive bride, and a British officer, who guessed our embarrassment, for we did not tell him (he came over with us on the ship), asked my husband to draw on his banker until the letters of credit should arrive. It was a nice thing for a stranger to do.

We have never lost what we never had. We have never had any money — only unlimited credit, for my husband's richest kind of a father insured us all manner of credit. It was all a mirage only at last, and it has gone just as we drew nigh to it.

Colonel Childs says eight of our Senators are for reconstruction, and that a ray of light has penetrated inward from Lincoln, who told Judge Campbell that Southern land would not be confiscated.

Diary of Mary Boykin Chesnut: January 17, 1865

The Bazaar for the benefit of the hospitals opens now. Sherman marches constantly. All the railroads are smashed, and if I laugh at any mortal thing it is that I may not weep. Generals are as plenty as blackberries, but none are in command.

The Peace Commissioner, Blair, came. They say he gave Mr. Davis the kiss of peace. And we send Stephens, Campbell, all who have believed in this thing, to negotiate for peace. No hope, no good. Who dares hope?

Repressed excitement in church. A great railroad character was called out. He soon returned and whispered something to Joe Johnston and they went out together. Somehow the whisper moved around to us that Sherman was at Branchville. “Grant us patience, good Lord,'” was prayed aloud. “Not Ulysses Grant, good Lord,” murmured Teddy, profanely. Hood came yesterday. He is staying at the Prestons' with Jack. They sent for us. What a heartfelt greeting he gave us. He can stand well enough without his crutch, but he does very slow walking. How plainly he spoke out dreadful words about “my defeat and discomfiture; my army destroyed, my losses,” etc., etc. He said he had nobody to blame but himself. A telegram from Beauregard to-day to my husband. He does not know whether Sherman intends to advance on Branchville, Charleston, or Columbia.

Isabella said: “Maybe you attempted the impossible,” and began one of her merriest stories. Jack Preston touched me on the arm and we slipped out. “He did not hear a word she was saying. He has forgotten us all. Did you notice how he stared in the fire? And the lurid spots which came out in his face, and the drops of perspiration that stood on his forehead?” “Yes. He is going over some bitter scene; he sees Willie Preston with his heart shot away. He sees the panic at Nashville and the dead on the battlefield at Franklin.” “That agony on his face comes again and again,” said tender-hearted Jack. “I can't keep him out of those absent fits.”

Governor McGrath and General Winder talk of preparations for a defense of Columbia. If Beauregard can't stop Sherman down there, what have we got here to do it with? Can we check or impede his march? Can any one?

Last night General Hampton came in. I am sure he would do something to save us if he were put in supreme command here. Hampton says Joe Johnston is equal, if not superior, to Lee as a commanding officer.

My silver is in a box and has been delivered for safe keeping to Isaac McLaughlin, who is really my beau-ideal of a grateful negro. I mean to trust him. My husband cares for none of these things now, and lets me do as I please.

Tom Archer died almost as soon as he got to Richmond. Prison takes the life out of men. He was only half-alive when here. He had a strange, pallid look and such a vacant stare until you roused him. Poor pretty Sally Archer: that is the end of you.1

Diary of Mary Boykin Chesnut: September 10, 1863

CAMDEN, S. C. — It is a comfort to turn from small political jealousies to our grand battles — to Lee and Kirby Smith after Council and Convention squabbles. Lee has proved to be all that my husband prophesied of him when he was so unpopular and when Joe Johnston was the great god of war. The very sound of the word convention or council is wearisome. Not that I am quite ready for Richmond yet. We must look after home and plantation affairs, which we have sadly neglected. Heaven help my husband through the deep waters

The wedding of Miss Aiken, daughter of Governor Aiken, the largest slave-owner in South Carolina; Julia Rutledge, one of the bridesmaids; the place Flat Rock. We could not for a while imagine what Julia would do for a dress. My sister Kate remembered some muslin she had in the house for curtains, bought before the war, and laid aside as not needed now. The stuff was white and thin, a little coarse, but then we covered it with no end of beautiful lace. It made a charming dress, and how altogether lovely Julia looked in it! The night of the wedding it stormed as if the world were coming to an end — wind, rain, thunder, and lightning in an unlimited supply around the mountain cottage.

The bride had a duchesse dressing-table, muslin and lace; not one of the shifts of honest, war-driven poverty, but a millionaire's attempt at appearing economical, in the idea that that style was in better taste as placing the family more on the same plane with their less comfortable compatriots. A candle was left too near this light drapery and it took fire. Outside was lightning enough to fire the world; inside, the bridal chamber was ablaze, and there was wind enough to blow the house down the mountainside.

The English maid behaved heroically, and, with the aid of Mrs. Aiken's and Mrs. Mat Singleton's servants, put the fire out without disturbing the marriage ceremony, then being performed below. Everything in the bridal chamber was burned up except the bed, and that was a mass of cinders, soot, and flakes of charred and blackened wood.

At Kingsville I caught a glimpse of our army. Longstreet's corps was going West. God bless the gallant fellows! Not one man was intoxicated; not one rude word did I hear. It was a strange sight — one part of it. There were miles, apparently, of platform cars, soldiers rolled in their blankets, lying in rows, heads all covered, fast asleep. In their gray blankets, packed in regular order, they looked like swathed mummies. One man near where I sat was writing on his knee. He used his cap for a desk and he was seated on a rail. I watched him, wondering to whom that letter was to go — home, no doubt. Sore hearts for him there.

A feeling of awful depression laid hold of me. All these fine fellows were going to kill or be killed. Why? And a phrase got to beating about my head like an old song, “The Unreturning Brave.” When a knot of boyish, laughing, young creatures passed me, a queer thrill of sympathy shook me. Ah, I know how your home-folks feel, poor children! Once, last winter, persons came to us in Camden with such strange stories of Captain ——, Morgan's man; stories of his father, too; turf tales and murder, or, at least, how he killed people. He had been a tremendous favorite with my husband, who brought him in once, leading him by the hand. Afterward he said to me, “With these girls in the house we must be more cautious.” I agreed to be coldly polite to ——. “After all,” I said, “I barely know him.”

When he called afterward in Richmond I was very glad to see him, utterly forgetting that he was under a ban. We had a long, confidential talk. He told me of his wife and children; of his army career, and told Morgan stories. He grew more and more cordial and so did I. He thanked me for the kind reception given him in that house; told me I was a true friend of his, and related to me a scrape he was in which, if divulged, would ruin him, although he was innocent; but time would clear all things. He begged me not to repeat anything he had told me of his affairs, not even to Colonel Chesnut; which I promised promptly, and then he went away. I sat poking the fire thinking what a curiously interesting creature he was, this famous Captain, when the folding-doors slowly opened and Colonel Chesnut appeared. He had come home two hours ago from the War Office with a headache, and had been lying on the sofa behind that folding-door listening for mortal hours.

“So, this is your style of being ‘coldly polite,’” he said. Fancy my feelings. “Indeed, I had forgotten all about what they had said of him. The lies they told of him never once crossed my mind. He is a great deal cleverer, and, I dare say, just as good as those who malign him.”

Mattie Reedy (I knew her as a handsome girl in Washington several years ago) got tired of hearing Federals abusing John Morgan. One day they were worse than ever in their abuse and she grew restive. By way of putting a mark against the name of so rude a girl, the Yankee officer said, “What is your name?” “Write ‘Mattie Reedy’ now, but by the grace of God one day I hope to call myself the wife of John Morgan.” She did not know Morgan, but Morgan eventually heard the story; a good joke it was said to be. But he made it a point to find her out; and, as she was as pretty as she was patriotic, by the grace of God, she is now Mrs. Morgan! These timid Southern women under the guns can be brave enough.

Aunt Charlotte has told a story of my dear mother. They were up at Shelby, Ala., a white man's country, where negroes are not wanted. The ladies had with them several negroes belonging to my uncle at whose house they were staying in the owner's absence. One negro man who had married and dwelt in a cabin was for some cause particularly obnoxious to the neighborhood. My aunt and my mother, old-fashioned ladies, shrinking from everything outside their own door, knew nothing of all this. They occupied rooms on opposite sides of an open passage-way. Underneath, the house was open and unfinished. Suddenly, one night, my aunt heard a terrible noise — apparently as of a man running for his life, pursued by men and dogs, shouting, hallooing, barking. She had only time to lock herself in. Utterly cut off from her sister, she sat down, dumb with terror, when there began loud knocking at the door, with men swearing, dogs tearing round, sniffing, racing in and out of the passage and barking underneath the house like mad. Aunt Charlotte was sure she heard the panting of a negro as he ran into the house a few minutes before. What could have become of him? Where could he have hidden? The men shook the doors and windows, loudly threatening vengeance. My aunt pitied her feeble sister, cut off in the room across the passage. This fright might kill her!

The cursing and shouting continued unabated. A man's voice, in harshest accents, made itself heard above all: “Leave my house, you rascals!” said the voice. “If you are not gone in two seconds, I'll shoot!” There was a dead silence except for the noise of the dogs. Quickly the men slipped away. Once out of gunshot, they began to call their dogs. After it was all over my aunt crept across the passage. “Sister, what man was it scared them away?” My mother laughed aloud in her triumph, “I am the man,” she said.

“But where is John?” Out crept John from a corner of the room, where my mother had thrown some rubbish over him. “Lawd bless you, Miss Mary opened de do' for me and dey was right behind runnin' me —“ Aunt says mother was awfully proud of her prowess. And she showed some moral courage, too!

At the President's in Richmond once, General Lee was there, and Constance and Hetty Cary came in; also Miss Sanders and others. Constance Cary1 was telling some war anecdotes, among them one of an attempt to get up a supper the night before at some high and mighty F. F. V.'s house, and of how several gentlefolks went into the kitchen to prepare something to eat by the light of one forlorn candle. One of the men in the party, not being of a useful temperament, turned up a tub and sat down upon it. Custis Lee, wishing also to rest, found nothing upon which to sit but a gridiron.

One remembrance I kept of the evening at the President's: General Lee bowing over the beautiful Miss Cary's hands in the passage outside. Miss ––– rose to have her part in the picture, and asked Mr. Davis to walk with her into the adjoining drawing-room. He seemed surprised, but rose stiffly, and, with a scowling brow, was led off. As they passed where Mrs. Davis sat, Miss –––, with all sail set, looked back and said: “Don't be jealous, Mrs. Davis; I have an important communication to make to the President.” Mrs. Davis's amusement resulted in a significant “Now! Did you ever?'”

During Stoneman's raid, on a Sunday I was in Mrs. Randolph's pew. The battle of Chancellorsville was also raging. The rattling of ammunition wagons, the tramp of soldiers, the everlasting slamming of those iron gates of the Capitol Square just opposite the church, made it hard to attend to the service.

Then began a scene calculated to make the stoutest heart quail. The sexton would walk quietly up the aisle to deliver messages to worshipers whose relatives had been brought in wounded, dying, or dead. Pale-faced people would then follow him out. Finally, the Rev. Mr. Minnegerode bent across the chancel-rail to the sexton for a few minutes, whispered with the sexton, and then disappeared. The assistant clergyman resumed the communion which Mr. Minnegerode had been administering. At the church door stood Mrs. Minnegerode, as tragically wretched and as wild-looking as ever Mrs. Siddons was. She managed to say to her husband, “Your son is at the station, dead!” When these agonized parents reached the station, however, it proved to be some one else's son who was dead — but a son all the same. Pale and wan came Mr. Minnegerode back to his place within the altar rails. After the sacred communion was over, some one asked him what it all meant, and he said: “Oh, it was not my son who was killed, but it came so near it aches me yet!”

At home I found L. Q. Washington, who stayed to dinner. I saw that he and my husband were intently preoccupied by some event which they did not see fit to communicate to me. Immediately after dinner my husband lent Mr. Washington one of his horses and they rode off together. I betook myself to my kind neighbors, the Pattons, for information. There I found Colonel Patton had gone, too. Mrs. Patton, however, knew all about the trouble. She said there was a raiding party within forty miles of us and no troops were in Richmond! They asked me to stay to tea — those kind ladies — and in some way we might learn what was going on. After tea we went out to the Capitol Square, Lawrence and three men-servants going along to protect us. They seemed to be mustering in citizens by the thousands. Company after company was being formed; then battalions, and then regiments. It was a wonderful sight to us, peering through the iron railing, watching them fall into ranks.

Then we went to the President's, finding the family at supper. We sat on the white marble steps, and General Elzey told me exactly how things stood and of our immediate danger. Pickets were coming in. Men were spurring to and from the door as fast as they could ride, bringing and carrying messages and orders. Calmly General Elzey discoursed upon our present weakness and our chances for aid. After a while Mrs. Davis came out and embraced me silently.

“It is dreadful,” I said. “The enemy is within forty miles of us — only forty!” “Who told you that tale?” said she, “They are within three miles of Richmond!” I went down on my knees like a stone. “You had better be quiet,” she said, “The President is ill. Women and children must not add to the trouble.” She asked me to stay all night, which I was thankful to do.

We sat up. Officers were coming and going; and we gave them what refreshment we could from a side table, kept constantly replenished. Finally, in the excitement, the constant state of activity and change of persons, we forgot the danger. Officers told us jolly stories and seemed in fine spirits, so we gradually took heart. There was not a moment's rest for any one. Mrs. Davis said something more amusing than ever: “We look like frightened women and children, don't we?”

Early next morning the President came down. He was still feeble and pale from illness. Custis Lee and my husband loaded their pistols, and the President drove off in Dr. Garnett's carriage, my husband and Custis Lee on horseback alongside him. By eight o'clock the troops from Petersburg came in, and the danger was over. The authorities will never strip Richmond of troops again. We had a narrow squeeze for it, but we escaped. It was a terrible night, although we made the best of it.

I was walking on Franklin Street when I met my husband. “Come with me to the War Office for a few minutes,” said he, “and then I will go home with you.” What could I do but go? He took me up a dark stairway, and then down a long, dark corridor, and he left me sitting in a window, saying he “would not be gone a second”; he was obliged to go into the Secretary of War's room. There I sat mortal hours. Men came to light the gas. From the first I put down my veil so that nobody might know me. Numbers of persons passed that I knew, but I scarcely felt respectable seated up there in that odd way, so I said not a word but looked out of the window. Judge Campbell slowly walked up and down with his hands behind his back — the saddest face I ever saw. He had jumped down in his patriotism from Judge of the Supreme Court, U. S. A., to be under-secretary of something or other — I do not know what — C. S. A. No wonder he was out of spirits that night!

Finally Judge Ould came; him I called, and he joined me at once, in no little amazement to find me there, and stayed with me until James Chesnut appeared. In point of fact, I sent him to look up that stray member of my family.

When my husband came he said: “Oh, Mr. Seddon and I got into an argument, and time slipped away! The truth is, I utterly forgot you were here.” When we were once more out in the street, he began: “Now, don't scold me, for there is bad news. Pemberton has been fighting the Yankees by brigades, and he has been beaten every time; and now Vicksburg must go!” I suppose that was his side of the argument with Seddon.

Once again I visited the War Office. I went with Mrs. Ould to see her husband at his office. We wanted to arrange a party on the river on the flag-of-truce boat, and to visit those beautiful places, Claremont and Brandon. My husband got into one of his “too careful” fits; said there was risk in it; and so he upset all our plans. Then I was to go up to John Rutherford's by the canal-boat. That, too, he vetoed “too risky,” as if anybody was going to trouble us!

Diary of William Howard Russell: April 8, 1861

How it does rain! Last night there were torrents of water in the streets literally a foot deep. It still runs in muddy whirling streams through the channels, and the rain is falling incessantly from a dull leaden sky. The air is warm and clammy. There are all kind of rumors abroad, and the barbers' shops shook with “shaves” this morning. Sumter, of course, was the main topic. Some reported that the President had promised the Southern Commissioners, through their friend Mr. Campbell, Judge of the Supreme Court, not to use force in respect to Pickens or Sumter. I wrote to Mr. Seward, to ask him if he could enable me to make any definite statement on these important matters. The Southerners are alarmed at the accounts they have received of great activity and preparations in the Brooklyn and Boston navy yards, and declare that “treachery” is meant. I find myself quite incapable of comprehending their position.How can the United States Government be guilty of  “treachery” toward subjects of States which are preparing to assert their independence, unless that Government has been guilty of falsehood or admitted the justice of the decision to which the States had arrived?

As soon as I had finished my letters, I drove over to the Smithsonian Institute, and was most kindly received by Professor Henry, who took me through the library and museum, and introduced me to Professor Baird, who is great in natural history, and more particularly in ornithology. I promised the professors some skins of Himalayan pheasants, as an addition to the collection. In the library we were presented to two very fine and lively rock snakes, or pythons, I believe, some six feet long or more, which moved about with much grace and agility, putting out their forked tongues and hissing sharply when seized by the hand or menaced with a stick. I was told that some persons doubted if serpents hissed; I can answer for it that rock snakes do most audibly. They are not venomous, but their teeth are sharp and needle like. The eye is bright and glistening; the red forked tongue, when protruded, has a rapid vibratory motion, as if it were moved by the muscles which produce the quivering hissing noise. I was much interested by Professor Henry's remarks on the large map of the continent of North America in his study: he pointed out the climatic conditions which determined the use, profits, and necessity of slave labor, and argued that the vast increase of population anticipated in the valley of the Mississippi, and the prophecies of imperial greatness attached to it, were fallacious. He seems to be of opinion that most of the good land of America is already cultivated, and that the crops which it produces tend to exhaust it, so as to compel the cultivators eventually to let it go fallow or to use manure. The fact is, that the influence of the great mountain-chain in the west, which intercepts all the rain on the Pacific side, causes an immense extent of country between the eastern slope of the chain and the Mississippi, as well as the district west of Minnesota, to be perfectly dry and uninhabitable; and, as far as we know, it is as worthless as a moor, except for the pasturage of wild cattle and the like.

On returning to my hotel, I found a note from Mr. Seward, asking me to visit him at nine o'clock. On going to his house, I was shown to the drawing-room, and found there only the Secretary of State, his son, and Mrs. Seward. I made a parti carré for a friendly rubber of whist, and Mr. Seward, who was my partner, talked as he played, so that the score of the game was not favorable. But his talk was very interesting. “All the preparations of which you hear mean this only. The Government, finding the property of the State and Federal forts neglected and left without protection, are determined to take steps to relieve them from that neglect, and to protect them. But we are determined in doing so to make no aggression. The President's inaugural clearly shadows out our policy. We will not go beyond it — we have no intention of doing so — nor will we withdraw from it.” After a time Mr. Seward put down his cards, and told his son to go for a portfolio which he would find in a drawer of his table. Mrs. Seward lighted the drop light of the gas, and on her husband's return with the paper left the room. The Secretary then lit his cigar, gave one to me, and proceeded to read slowly and with marked emphasis, a very long, strong, and able despatch, which he told me was to be read by Mr. Adams, the American Minister in London, to Lord John Russell. It struck me that the tone of the paper was hostile, that there was an undercurrent of menace through it, and that it contained insinuations that Great Britain would interfere to split up the Republic, if she could, and was pleased at the prospect of the dangers which threatened it.

At all the stronger passages Mr. Seward raised his voice, and made a pause at their conclusion as if to challenge remark or approval. At length I could not help saying, that the despatch would, no doubt, have an excellent effect when it came to light in Congress, and that the Americans would think highly of the writer; but I ventured to express an opinion that it would not be quite so acceptable to the Government and people of Great Britain. This Mr. Seward, as an American statesman, had a right to make but a secondary consideration. By affecting to regard Secession as a mere political heresy which can be easily confuted, and by forbidding foreign countries alluding to it, Mr. Seward thinks he can establish the supremacy of his own Government, and at the same time gratify the vanity of the people. Even war with us may not be out of the list of those means which would be available for re-fusing the broken union into a mass once more. However, the Secretary is quite confident in what he calls “reaction.” “When the Southern States,” he says, “see that we mean them no wrong — that we intend no violence to persons, rights, or things — that the Federal Government seeks only to fulfil obligations imposed on it in respect to the national property, they will see their mistake, and one after another they will come back into the union.” Mr. Seward anticipates this process will at once begin, and that Secession will all be done and over in three months — at least, so he says. It was after midnight ere our conversation was over, much of which of course I cannot mention in these pages.

Diary of William Howard Russell: Monday, April 3, 1861

I had an interview with the Southern Commissioners to-day, at their hotel. For more than an hour I heard, from men of position and of different sections in the South, expressions which satisfied me the Union could never be restored, if they truly represented the feelings and opinions of their fellow-citizens. They have the idea they are ministers of a foreign power treating with Yankeedom, and their indignation is moved by the refusal of Government to negotiate with them, armed as they are with full authority to arrange all questions arising out of an amicable separation — such as the adjustment of Federal claims for property, forts, stores, public works, debts, land purchases, and the like. One of the Judges of the Supreme Court of the United States, Mr. Campbell, is their intermediary, and of course it is not known what hopes Mr. Seward has held out to him; but there is some imputation of Punic faith against the Government on account of recent acts, and there is no doubt the Commissioners hear, as I do, that there are preparations at the Navy Yard and at New York to relieve Sumter, at any rate, with provisions, and that Pickens has actually been reinforced by sea. In the evening I dined at the British Legation, and went over to the house of the Russian Minister, M. de Stoeckl, in the evening. The diplomatic body in Washington constitute a small and very agreeable society of their own, in which few Americans mingle except at the receptions and large evening assemblies. As the people now in power are novi homines, the wives and daughters of ministers and attaches are deprived of their friends who belonged to the old society in Washington, and who have either gone off to Secession, or sympathize so deeply with the Southern States that it is scarcely becoming to hold very intimate relations with them in the face of Government. From the house of M.de Stoeckl I went to a party at the residence of M. Tassara, the Spanish Minister, where there was a crowd of diplomats, young and old. Diplomatists seldom or never talk politics, and so Pickens and Sumter were unheard of; but it is stated nevertheless that Virginia is on the eve of secession, and will certainly go if the President attempts to use force in relieving and strengthening the Federal forts.

Abraham Lincoln’s First Annual Message to Congress: December 3, 1861

Fellow citizens Of The Senate And House Of Representatives:

In the midst of unprecedented political troubles, we have cause of great gratitude to God for unusual good health and most abundant harvests.

You will not be surprised to learn that, in the peculiar exigencies of the times, our intercourse with foreign nations has been attended with profound solicitude, chiefly turning upon our own domestic affairs.

A disloyal portion of the American people have, during the whole year, been engaged in an attempt to divide and destroy the Union. A nation which endures factious domestic division is exposed to disrespect abroad, and one party, if not both, is sure, sooner or later, to invoke foreign intervention.

Nations thus tempted to interfere are not always able to resist the counsels of seeming expediency and ungenerous ambition, although measures adopted under such influences seldom fail to be unfortunate and injurious to those adopting them.

The disloyal citizens of the United States who have offered the ruin of our country in return for the aid and comfort which they have invoked abroad have received less patronage and encouragement than they probably expected. If it were just to suppose, as the insurgents have seemed to assume, that foreign nations, in this case, discarding all moral, social, and treaty obligations, would act solely and selfishly for the most speedy restoration of commerce, including especially the acquisition of cotton, those nations appear as yet not to have seen their way to their object more directly or clearly through the destruction than through the preservation of the Union. If we could dare to believe that foreign nations are actuated by no higher principle than this, I am quite sure a sound argument could be made to show them that they can reach their aim more readily and easily by aiding to crush this rebellion than by giving encouragement to it.
The principal lever relied on by the insurgents for exciting foreign nations to hostility against us, as already intimated, is the embarrassment of commerce. Those nations, however, not improbably saw from the first that it was the Union which made as well our foreign as our domestic commerce. They can scarcely have failed to perceive that the effort for disunion produces the existing difficulty, and that one strong nation promises more durable peace and a more extensive, valuable, and reliable commerce than can the same nation broken into hostile fragments.

It is not my purpose to review our discussions with foreign States, because whatever might be their wishes or dispositions the integrity of our country and the stability of our Government mainly depend, not upon them, but on the loyalty, virtue, patriotism, and intelligence of the American people. The correspondence itself, with the usual reservations, is herewith submitted.
I venture to hope it will appear that we have practiced prudence and liberality toward foreign powers, averting causes of irritation, and with firmness maintaining our own rights and honor.
Since, however, it is apparent that here, as in every other State, foreign dangers necessarily attend domestic difficulties, I recommend that adequate and ample measures be adopted for maintaining the public defenses on every side. While under this general recommendation provision for defending our sea-coast line readily occurs to the mind, I also, in the same connection, ask the attention of Congress to our great lakes and rivers. It is believed that some fortifications and depots of arms and munitions, with harbor and navigation improvements, all at well selected points upon these, would be of great importance to the national defense and preservation. I ask attention to the views of the Secretary of War, expressed in his report, upon the same general subject.

I deem it of importance that the loyal regions of East Tennessee and Western North Carolina should be connected with Kentucky and other faithful parts of the Union by railroad. I therefore recommend, as a military measure, that Congress provide for the construction of such road as speedily as possible. Kentucky no doubt will co-operate, and, through her Legislature, make the most judicious selection of a line. The northern terminus must connect with some existing railroad, and whether the route shall be from Lexington or Nicholasville to the Cumberland Gap, or from Lebanon to the Tennessee line in the direction of Knoxville, or on some still different line, can easily be determined. Kentucky and the General Government co-operating the work can be completed in a very short time, and when done it will be not only of vast present usefulness but also a valuable permanent improvement, worth its cost in all the future.

Some treaties, designed chiefly for the interests of commerce, and having no grave political importance, have been negotiated and will be submitted to the Senate for their consideration.

Although we have failed to induce some of the commercial powers to adopt a desirable melioration of the rigor of maritime war, we have removed all obstructions from the way of this humane reform, except such as are merely of temporary and accidental occurrence.

I invite your attention to the correspondence between Her Britannic Majesty's minister accredited to this Government and the Secretary of State relative to the detention of the British ship Perthshire, in June last, by the U. S. steamer Massachusetts, for a supposed breach of the blockade. As this detention was occasioned by an obvious misapprehension of the facts, and as justice requires that we should commit no belligerent act not founded in strict right, as sanctioned by public law, I recommend that an appropriation be made to satisfy the reasonable demand of the owners of the vessel for her detention.

I repeat the recommendation of my predecessor, in his annual message to Congress in December last, in regard to the disposition of the surplus which will probably remain after satisfying the claims of American citizens against China, pursuant to the awards of the commissioners under the act of the 3d of March, 1859. If, however, it should not be deemed advisable to carry that recommendation into effect, I would suggest that authority be given for investing the principal, over the proceeds of the surplus referred to, in good securities, with a view to the satisfaction of such other just claims of our citizens against China as are not unlikely to arise hereafter in the course of our extensive trade with that Empire.

By the act of the 5th of August last Congress authorized the President to instruct the commanders of suitable vessels to defend themselves against and to capture pirates. This authority has been exercised in a single instance only. For the more effectual protection of our extensive and valuable commerce, in the Eastern seas especially, it seems to me that it would also be advisable to authorize the commanders of sailing vessels to recapture any prizes which pirates may make of U. S. vessels and their cargoes, and the consular courts, now established by law in Eastern countries, to adjudicate the cases, in the event that this should not be objected to by the local authorities.

If any good reason exists why we should persevere longer in withholding our recognition of the independence and sovereignty of Hayti and Liberia, I am unable to discern it. Unwilling, however, to inaugurate a novel policy in regard to them without the approbation of Congress, I submit for your consideration the expediency of an appropriation for maintaining a charge d'affaires near each of those new States. It does not admit of doubt that important commercial advantages might be secured by favorable treaties with them.

The operations of the Treasury during the period which has elapsed since your adjournment have been conducted with signal success. The patriotism of the people has placed at the disposal of the Government the large means demanded by the public exigencies. Much of the national loan has been taken by citizens of the industrial classes, whose confidence in their country's faith and zeal for their country's deliverance from present peril have induced them to contribute to the support of the Government the whole of their limited acquisitions. This fact imposes peculiar obligations to economy in disbursement and energy in action.

The revenue from all sources, including loans, for the financial year ending on the 30th of June, 1861, was $86,835,900.27, and the expenditures for the same period, including payments on account of the public debt, were $84,578,834.47, leaving a balance in the Treasury on the 1st of July of $2,257,005.80. For the first quarter of the financial year, ending on the 30th of September, 1861, the receipts from all sources, including the balance of 1st of July, were $102,532,509.27, and the expenses $98,239,733.09, leaving a balance on the 1st of October, 1861, of $4,292,770.18.

Estimates for the remaining three quarters of the year, and for the financial year 1863, together with his views of ways and means for meeting the demands contemplated by them, will be submitted to Congress by the Secretary of the Treasury. It is gratifying to know that the expenditures made necessary by the rebellion are not beyond the resources of the loyal people, and to believe that the same patriotism which has thus far sustained the Government will continue to sustain it till peace and union shall again bless the land.

I respectfully refer to the report of the Secretary of War for information respecting the numerical strength of the Army, and for recommendations having in view an increase of its efficiency and the wellbeing of the various branches of the service intrusted to his care.  It is gratifying to know that the patriotism of the people has proved equal to the occasion and that the number of troops tendered greatly exceeds the force which Congress authorized me to call into the field.

I refer with pleasure to those portions of his report which make allusion to the creditable degree of discipline already attained by our troops, and to the excellent sanitary condition of the entire Army.

The recommendation of the Secretary for an organization of the militia upon a uniform basis is a subject of vital importance to the future safety of the country, and is commended to the serious attention of Congress.

The large addition to the Regular Army, in connection with the defection that has so considerably diminished the number of its officers, gives peculiar importance to his recommendation for increasing the corps of cadets to the greatest capacity of the Military Academy.

By mere omission, I presume, Congress has failed to provide chaplains for hospitals occupied by volunteers. This subject was brought to my notice, and I was induced to draw up the form of a letter, one copy of which, properly addressed, has been delivered to each of the persons, and at the dates respectively named and stated, in a schedule containing also the form of the letter, marked A, and herewith transmitted.

These gentlemen, I understand, entered upon the duties designated at the times respectively stated in the schedule and have labored faithfully therein ever since. I therefore recommend that they be compensated at the same rate as chaplains in the Army. I further suggest that general provision be made for chaplains to serve at hospitals, as well as with regiments.

The report of the Secretary of the Navy presents in detail the operations of that branch of the service, the activity and energy which have characterized its administration and the results of measures to increase its efficiency and power. Such have been the additions, by construction and purchase, that it may almost be said a navy has been created and brought into service since our difficulties commenced.

Besides blockading our extensive coast, squadrons larger than ever before assembled under our flag have been put afloat and performed deeds which have increased our naval renown.

I would invite special attention to the recommendation of the Secretary for a more perfect organization of the Navy by introducing additional grades in the service.

The present organization is defective and unsatisfactory, and the suggestions submitted by the Department will, it is believed, if adopted, obviate the difficulties alluded to, promote harmony, and increase the efficiency of the Navy.

There are three vacancies on the bench of the Supreme Court — two by the decease of Justices Daniel and McLean and one by the resignation of Justice Campbell. I have so far forborne making nominations to fill these vacancies for reasons which I will now state. Two of the outgoing judges resided within the States now overrun by revolt; so that if successors were appointed in the same localities they could not now serve upon their circuits; and many of the most competent men there probably would not take the personal hazard of accepting to serve, even here, upon the supreme bench. I have been unwilling to throw all the appointments northward, thus disabling myself from doing justice to the South on the return of peace; although I may remark that to transfer to the North one which has heretofore been in the South, would not, with reference to territory and population, be unjust.

During the long and brilliant judicial career of Judge McLean his circuit grew into an empire — altogether too large for any one judge to give the courts therein more than a nominal attendance — rising in population from 1,470,018 in 1830 to 6,151,405 in I860.

Besides this, the country generally has outgrown our present judicial system. If uniformity was at all intended, the system requires that all the States shall be accommodated with circuit courts, attended by supreme judges, while, in fact, Wisconsin, Minnesota, Iowa, Kansas, Florida, Texas, California, and Oregon have never had any such courts. Nor can this well be remedied without a change of the system; because the adding of judges to the Supreme Court, enough for the accommodation of all parts of the country with circuit courts, would create a court altogether too numerous for a judicial body of any sort. And the evil, if it be one, will increase as new States come into the Union. Circuit courts are useful, or they are not useful. If useful, no State should be denied them; if not useful, no State should have them. Let them be provided for all or abolished as to all.

Three modifications occur to me, either of which, I think, would be an improvement upon our present system. Let the Supreme Court be of convenient number in every event. Then, first, let the whole country be divided into circuits of convenient size, the supreme judges to serve in a number of them corresponding to their own number, and independent circuit judges be provided for all the rest; or, secondly, let the supreme judges be relieved from circuit duties, and circuit judges provided for all the circuits; or, thirdly, dispense with circuit courts altogether, leaving the judicial functions wholly to the district courts and an independent Supreme Court.

I respectfully recommend to the consideration of Congress the present condition of the statute laws, with the hope that Congress will be able to find an easy remedy for many of the inconveniences and evils which constantly embarrass those engaged in the practical administration of them. Since the organization of the Government Congress has enacted some 5,000 acts and joint resolutions, which fill more than 6,000 closely printed pages and are scattered through many volumes. Many of these acts have been drawn in haste and without sufficient caution, so that their provisions are often obscure in themselves or in conflict with each other, or at least so doubtful as to render it very difficult for even the best informed persons to ascertain precisely what the statute law really is.

It seems to me very important that the statute laws should be made as plain and intelligible as possible, and be reduced to as small a compass as may consist with the fullness and precision of the will of the Legislature and the perspicuity of its language. This, well done, would, I think, greatly facilitate the labors of those whose duty it is to assist in the administration of the laws, and would be a lasting benefit to the people, by placing before them, in a more accessible and intelligible form, the laws which so deeply concern their interests and their duties.

I am informed by some whose opinions I respect that all the acts of Congress now in force, and of a permanent and general nature, might be revised and rewritten so as to be embraced in one volume (or at most, two volumes) of ordinary and convenient size; and I respectfully recommend to Congress to consider of the subject, and if my suggestion be approved, to devise such plan as to their wisdom shall seem most proper for the attainment of the end proposed.

One of the unavoidable consequences of the present insurrection is the entire suppression, in many places, of all the ordinary means of administering civil justice by the officers and in the forms of existing law. This is the case, in whole or in part, in all the insurgent States; and as our armies advance upon and take possession of parts of those States the practical evil becomes more apparent. There are no courts nor officers to whom the citizens of other States may apply for the enforcement of their lawful claims against citizens of the insurgent States, and there is a vast amount of debt constituting such claims. Some have estimated it as high as $200,000,000, due in large part from insurgents, in open rebellion, to loyal citizens, who are even now making great sacrifices in the discharge of their patriotic duty to support the Government.

Under these circumstances, I have been urgently solicited to establish, by military power, courts to administer summary justice in such cases. I have thus far declined to do it, not because I had any doubt that the end proposed — the collection of the debts — was just and right in itself, but because I have been unwilling to go beyond the pressure of necessity in the unusual exercise of power; but the powers of Congress, I suppose, are equal to the anomalous occasion, and therefore I refer the whole matter to Congress, with the hope that a plan may be devised for the administration of justice in all such parts of the insurgent States and Territories as may be under the control of this Government, whether by a voluntary return to allegiance and order or by the power of our arms; this, however, not to be a permanent institution, but a temporary substitute, and to cease as soon as the ordinary courts can be re-established in peace.

It is important that some more convenient means should be provided, if possible, for the adjustment of claims against the Government, especially in view of their increased number by reason of the war. It is as much the duty of Government to render prompt justice against itself, in favor of citizens, as it is to administer the same between private individuals. The investigation and adjudication of claims in their nature belong to the judicial department; besides, it is apparent that the attention of Congress will be more than usually engaged for some time to come with great national questions. It was intended by the organization of the Court of Claims mainly to remove this branch of business from the halls of Congress; but while the court has proved to be an effective and valuable means of investigation, it in great degree fails to effect the object of its creation for want of power to make its judgments final.

Fully aware of the delicacy, not to say the danger, of the subject, I commend to your careful consideration whether this power of making judgments final may not properly be given to the court, reserving the right of appeal on questions of law to the Supreme Court, with such other provisions as experience may have shown to be necessary.

I ask attention to the report of the Postmaster-General, the following being a summary statement of the condition of the Department:

The revenue from all sources during the fiscal year ending June 30, 1861, including the annual permanent appropriation of $700,000 for the transportation of “free mail matter,” was $9,049,296.40, being about 2 per cent, less than the revenue for 1860.

The expenditures were $13,606,759.11, showing a decrease of more than 8 per cent, as compared with those of the previous year, and leaving an excess of expenditure over the revenue for the last fiscal year of 81,557,462.71.

The gross revenue for the year ending June 30,1863, is estimated at an increase of 4 per cent, on that of 1861, making $8,683,000, to which should be added the earnings of the Department in carrying free matter, viz, $700,000, making $9,383,000.

The total expenditures for 1863 are estimated at $12,528,000, leaving an estimated deficiency of $3,145,000 to be supplied from the Treasury, in addition to the permanent appropriation.

The present insurrection shows, I think, that the extension of this District across the Potomac River at the time of establishing the capital here was eminently wise, and consequently that the relinquishment of that portion of it which lies within the State of Virginia was unwise and dangerous. I submit for your consideration the expediency of regaining that part of the District, and the restoration of the original boundaries thereof, through negotiations with the State of Virginia.

The report of the Secretary of the Interior, with the accompanying documents, exhibits the condition of the several branches of the public business pertaining to that Department. The depressing influences of the insurrection have been especially felt in the operations of the Patent and General Land Offices. The cash receipts from the sales of public lands during the past year have exceeded the expenses of our land system only about $200,000. The sales have been entirely suspended in the Southern States, while the interruptions to the business of the country and the diversion of large numbers of men from labor to military service have obstructed settlements in the new States and Territories of the Northwest.

The receipts of the Patent Office have declined in nine months about $100,000, rendering a large reduction of the force employed necessary to make it self sustaining.

The demands upon the Pension Office will be largely increased by the insurrection. Numerous applications for pensions, based upon the casualties of the existing war, have already been made. There is reason to believe that many who are now upon the pension rolls and in receipt of the bounty of the Government are in the ranks of the insurgent army or giving them aid and comfort. The Secretary of the Interior has directed a suspension of the payment of the pensions of such persons upon proof of their disloyalty. I recommend that Congress authorize that officer to cause the names of such persons to be stricken from the pension rolls.

The relations of the Government with the Indian tribes have been greatly disturbed by the insurrection, especially in the Southern superintendency and in that of New Mexico. The Indian country south of Kansas is in the possession of insurgents from Texas and Arkansas. The agents of the United States appointed since the 4th of March for this superintendency have been unable to reach their posts, while the most of those who were in office before that time have espoused the insurrectionary cause and assume to exercise the powers of agents by virtue of commissions from the insurrectionists. It has been stated in the public press that a portion of those Indians have been organized as a military force and are attached to the army of the insurgents. Although the Government has no official information upon this subject, letters have been written to the Commissioner of Indian Affairs by several prominent chiefs giving assurance of their loyalty to the United States and expressing a wish for the presence of Federal troops to protect them. It is believed that upon the repossession of the country by the Federal forces the Indians will readily cease all hostile demonstrations and resume their former relations to the Government.

Agriculture, confessedly the largest interest of the nation, has not a department nor a bureau, but a clerkship only, assigned to it in the Government. While it is fortunate that this great interest is so independent in its nature as to not have demanded and extorted more from the Government I respectfully ask Congress to consider whether something more cannot be given voluntarily with general advantage.

Annual reports exhibiting the condition of our agriculture, commerce, and manufactures would present a fund of information of great practical value to the country. While I make no suggestion as to details, I venture the opinion that an agricultural and statistical bureau might profitably be organized.

The execution of the laws for the suppression of the African slave trade has been confided to the Department of the Interior. It is a subject of gratulation that the efforts which have been made for the suppression of this inhuman traffic have been recently attended with unusual success. Five vessels being fitted out for the slave trade have been seized and condemned. Two mates of vessels engaged in the trade, and one person in equipping a vessel as a slaver, have been convicted and subjected to the penalty of fine and imprisonment, and one captain, taken with a cargo of Africans on board his vessel, has been convicted of the highest grade of offense under our laws, the punishment of which is death.

The Territories of Colorado, Dakota, and Nevada, created by the last Congress, have been organized, and civil administration has been inaugurated therein under auspices especially gratifying, when it is considered that the leaven of treason was found existing in some of these new countries when the Federal officers arrived there.

The abundant natural resources of these Territories, with the security and protection afforded by organized government, will doubtless invite to them a large immigration when peace shall restore the business of the country to its accustomed channels. I submit the resolutions of the Legislature of Colorado, which evidence the patriotic spirit of the people of the Territory. So far the authority of the United States has been upheld in all the Territories, as it is hoped it will be in the future. I commend their interests and defense to the enlightened and generous care of Congress.

I recommend to the favorable consideration of Congress the interests of the District of Columbia. The insurrection has been the cause of much suffering and sacrifice to its inhabitants, and as they have no representative in Congress, that body should not overlook their just claims upon the Government.

At your late session a joint resolution was adopted authorizing the President to take measures for facilitating a proper representation of the industrial interests of the United States at the exhibition of the industry of all nations to be holden at London in the year 1862. I regret to say I have been unable to give personal attention to this subject — a subject at once so interesting in itself and so extensively and intimately connected with the material prosperity of the world. Through the Secretaries of State and of the Interior a plan, or system, has been devised and partly matured, and which will be laid before you.

Under and by virtue of the act of Congress entitled “An act to confiscate property used for insurrectionary purposes,” approved August 6, 1861, the legal claims of certain persons to the labor and service of certain other persons have become forfeited, and numbers of the latter thus liberated are already dependent on the United States and must be provided for in some way. Besides this, it is not impossible that some of the States will pass similar enactments for their own benefit, respectively, and by operation of which persons of the same class will be thrown upon them for disposal. In such case I recommend that Congress provide for accepting such persons from such States according to some mode of valuation in lieu, pro tanto, of direct taxes, or upon some other plan to be agreed on with such States, respectively; that such persons on such acceptance by the General Government be at once deemed free; and that in any event steps be taken for colonizing both classes (or the one first mentioned if the other shall not be brought into existence) at some place or places in a climate congenial to them. It might be well to consider, too, whether the free colored people already in the United States could not, so far as individuals may desire, be included in such colonization.

To carry out the plan of colonization may involve the acquiring of territory, and also the appropriation of money beyond that to be expended in the territorial acquisition. Having practiced the acquisition of territory for nearly sixty years, the question of constitutional power to do so is no longer an open one with us. The power was questioned at first by Mr. Jefferson, who, however, in the purchase of Louisiana, yielded his scruples on the plea of great expediency. If it be said that the only legitimate object of acquiring territory is to furnish homes for white men, this measure effects that object; for the emigration of colored men leaves additional room for white men remaining or coming here. Mr. Jefferson, however, placed the importance of procuring Louisiana more on political and commercial grounds than on providing room for population.

On this whole proposition, including the appropriation of money with the acquisition of territory, does not the expediency amount to absolute necessity — that, without which the Government itself cannot be perpetuated!

The war continues. In considering the policy to be adopted for suppressing the insurrection, I have been anxious and careful that the inevitable conflict for this purpose shall not degenerate into a violent and remorseless revolutionary struggle. I have, therefore, in every case, thought it proper to keep the integrity of the Union prominent as the primary object of the contest on our part, leaving all questions which are not of vital military importance to the more deliberate action of the Legislature.

In the exercise of my best discretion I have adhered to the blockade of the ports held by the insurgents, instead of putting in force, by proclamation, the law of Congress enacted at the late session for closing those ports.

So, also, obeying the dictates of prudence, as well as the obligations of law, instead of transcending, I have adhered to the act of Congress to confiscate property used for insurrectionary purposes. If a new law upon the same subject shall be proposed, its propriety will be duly considered. The Union must be preserved; and hence, all indispensable means must be employed. We should not be in haste to determine that radical and extreme measures, which may reach the loyal as well as the disloyal, are indispensable.

The inaugural address at the beginning of the Administration and the message to Congress at the late special session were both mainly devoted to the domestic controversy out of which the insurrection and consequent war have sprung. Nothing now occurs to add or subtract, to or from, the principles, or general purposes, stated and expressed in those documents.

The last ray of hope for preserving the Union peaceably expired at the assault upon Fort Sumter; and a general review of what has occurred since may not be unprofitable. What was painfully uncertain then is much better defined and more distinct now; and the progress of events is plainly in the right direction. The insurgents confidently claimed a strong support from north of Mason and Dixon's line; and the friends of the Union were not free from apprehension on the point. This, however, was soon settled definitely, and on the right side. South of the line, noble little Delaware led off right from the first. Maryland was made to seem against the Union. Our soldiers were assaulted, bridges were burned, and railroads torn up within her limits; and we were many days, at one time, without the ability to bring a single regiment over her soil to the capital. Now her bridges and railroads are repaired and open to the Government; she already gives seven regiments to the cause of the Union and none to the enemy; and her people, at a regular election, have sustained the Union by a larger majority and a larger aggregate vote than they ever before gave to any candidate or any question. Kentucky, too, for some time in doubt, is now decidedly, and, I think, unchangeably, ranged on the side of the Union. Missouri is comparatively quiet; and I believe cannot again be overrun by the insurrectionists. These three States of Maryland, Kentucky, and Missouri, neither of which would promise a single soldier at first, have now an aggregate of not less than 40,000 in the field for the Union; while, of their citizens, certainly not more than a third of that number, and they of doubtful whereabouts, and doubtful existence, are in arms against it. After a somewhat bloody struggle of months, winter closes on the Union people of Western Virginia, leaving them masters of their own country.

An insurgent force of about 1,500, for months dominating the narrow peninsular region constituting the counties of Accomuc and Northampton, and known as Eastern Shore of Virginia, together with some contiguous parts of Maryland, have laid down their arms; and the people there have renewed their allegiance to and accepted the protection of the old flag. This leaves no armed insurrectionist north of the Potomac or east of the Chesapeake.

Also we have obtained a footing at each of the isolated points on the Southern coast, of Hatteras, Port Royal, Tybee Island, near Savannah, and Ship Island; and we likewise have some general accounts of popular movements in behalf of the Union in North Carolina and Tennessee.

These things demonstrate that the cause of the Union is advancing steadily and certainly southward.

Since your last adjournment Lieutenant General Scott has retired from the head of the Army. During his long life the nation has not been unmindful of his merits; yet, on calling to mind how faithfully, ably, and brilliantly he has served the country, from a time far back in our history, when few of the now living had been born, and thenceforward continually, 1 cannot but think we are still his debtors. I submit, therefore, for your consideration, what further mark of recognition is due to him, and to ourselves, as a grateful people.

With the retirement of General Scott came the executive duty of appointing, in his stead, a general-in-chief of the army. It is a fortunate circumstance that neither in council nor country was there, so far as I know, any difference of opinion as to the proper person to be selected. The retiring chief repeatedly expressed his judgment in favor of General McClellan for the position; and in this the nation seemed to give a unanimous concurrence. The designation of General McClellan is, therefore, in considerable degree, the selection of the country, as well as of the Executive; and hence there is better reason to hope there will be given him the confidence and cordial support thus, by fair implication, promised, and without which he cannot, with so full efficiency, serve the country.

It has been said that one bad general is better than two good ones; and the saying is true, if taken to mean no more than that an army is better directed by a single mind, though inferior, than by two superior ones at variance and cross-purposes with each other.

And the same is true in all joint operations wherein those engaged can have none but a common end in view, and can differ only as to the choice of means. In a storm at sea no one on board can wish the ship to sink; and yet, not unfrequently, all go down together, because too many will direct, and no single mind can be allowed to control.

It continues to develop that the insurrection is largely, if not exclusively, a war upon the first principle of popular government — the rights of the people. Conclusive evidence of this is found in the most grave and maturely considered public documents, as well as in the general tone of the insurgents. In those documents we find the abridgment of the existing right of suffrage, and the denial to the people of all right to participate in the selection of public officers, except the legislative, boldly advocated, with labored arguments to prove that large control of the people in government is the source of all political evil. Monarchy itself is sometimes hinted at as a possible refuge from the power of the people.

In my present position I could scarcely be justified were I to omit raising a warning voice against this approach of returning despotism.

It is not needed, nor fitting here, that a general argument should be made in favor of popular institutions; but there is one point, with its connections, not so hackneyed as most others, to which I ask a brief attention. It is the effort to place capital on an equal footing with, if not above, labor in the structure of government. It is assumed that labor is available only in connection with capital; that nobody labors unless somebody else, owning capital, somehow by the use of it induces him to labor. This assumed, it is next considered whether it is best that capital shall hire laborers, and thus induce them to work by their own consent, or buy them, and drive them to it without their consent. Having proceeded so far, it is naturally concluded that all laborers are either hired laborers, or what we call slaves. And further, it is assumed that whoever is once a hired laborer is fixed in that condition for life.

Now, there is no such relation between capital and labor as assumed; nor is there any such thing as a free man being fixed for life in the condition of a hired laborer. Both these assumptions are false, and all inferences from them are groundless.

Labor is prior to, and independent of, capital. Capital is only the fruit of labor, and could never have existed if labor had not first existed. Labor is the superior of capital, and deserves much the higher consideration. Capital has its rights, which are as worthy of protection as any other rights. Nor is it denied that there is, and probably always will be, a relation between labor and capital, producing mutual benefits. The error is in assuming that the whole labor of community exists within that relation. A few men own capital, and that few avoid labor themselves, and, with their capital, hire or buy another few to labor for them. A large majority belong to neither class — neither work for others nor have others working for them. In most of the Southern States a majority of the whole people of all colors are neither slaves nor masters; while in the Northern a large majority are neither hirers nor hired. Men with their families — wives, sons, and daughters — work for themselves, on their farms, in their houses, and in their shops, taking the whole product to themselves, and asking no favors of capital on the one hand nor of hired laborers or slaves on the other. It is not forgotten that a considerable number of persons mingle their own labor with capital — that is, they labor with their own hands, and also buy or hire others to labor for them; but this is only a mixed, and not a distinct class. No principle stated is disturbed by the existence of this mixed class.

Again, as has already been said, there is not, of necessity, any such thing as the free hired laborer being fixed to that condition for life. Many independent men everywhere in these States, a few years back in their lives, were hired laborers. The prudent, penniless beginner in the world labors for wages awhile, saves a surplus with which to buy tools or land for himself, then labors on his own account another while, and at length hires another new beginner to help him. This is the just and generous and prosperous system which opens the way to all — gives hope to all, and consequent energy and progress and improvement of condition to all. No men living are more worthy to be trusted than those who toil up from poverty—none less inclined to take, or touch, aught which they have not honestly earned. Let them beware of surrendering a political power which they already possess, and which, if surrendered, will surely be used to close the door of advancement against such as they, and to fix new disabilities and burdens upon them, till all of liberty shall be lost.

From the first taking of our national census to the last are seventy years; and we find our population, at the end of the period, eight times as great as it was at the beginning. The increase of those other things which men deem desirable has been even greater. We thus have, at one view, what the popular principle, applied to government through the machinery of the States and the Union, has produced in a given time; and also what, if firmly maintained, it promises for the future. There are already among us those who, if the Union be preserved, will live to see it contain two hundred and fifty millions. The struggle of to-day is not altogether for to-day — it is for a vast future also. With a reliance on Providence all the more firm and earnest, let us proceed in the great task which events have devolved upon us.
