Congressman Rutherford B. Hayes to Guy M. Bryan, February 15, 1866

WASHINGTON, D. C., February 15, 1866.

DEAR GUY:— Enclosed you will find Stephen's papers. The reason I didn't write again [was that] I discovered on another visit after writing you that you had previously been pardoned.

There is really no reason to feel any uneasiness because of the delays in acting upon the cases of the different Southern States. Those which send Union men will be represented in Congress, and fully restored without any severe or degrading conditions. There is a great deal of nonsense on all sides, but no substantial interests are likely to be sacrificed. I am told that the Committee on Reconstruction will report favorably on Tennessee at an early day.

I really can't tell about land sales. We hear some hard stories about the treatment Northern people get in many parts of the South. This for a time will naturally discourage the purchase of lands.

I am in much haste. Love to yours.

Diary of Congressman Rutherford B. Hayes: January 8, 1866

Mr. Shellabarger made a speech on reconstruction that took better than anything thus far of the kind. He read it from manuscript, but with energy and unction. It was a decided success. He was much complimented. Good for Ohio!

Rutherford B. Hayes to Lieutenant-Colonel Russell Hastings, May 20, 1865

New CREEK, WEST VIRGINIA, May 20, 1865.

DEAR COLONEL:— My wife came here last evening. I have sent in my resignation and asked to be relieved. I hope to get to Washington to the great doings to come off next week.

I take "Old Whitey” home (to Fremont, Ohio,) and hope you will be able to ride him again.

It is not yet known when troops of the class of Twenty-third, Thirty-sixth, and First West Virginia Veterans will be mustered out. They are all now at Staunton and appear to enjoy it much.

I have had the Cincinnati papers withdraw my name from the candidate list. I am of course much obliged to the brigade, but it would not be the thing for me to allow it.

My wife says she is glad you have sound views on the treatment of Rebels. She doubts her husband.

If Sherman did it with an eye to political advancement, as some say, of course it is bad, but if he thought to follow the policy of Lincoln as indicated by Weitzell's programme (and this I believe), he surely ought not to be abused for it.

My wife sends regards to your sister and yourself. Excuse haste.

Diary of John Beauchamp Jones: August 24, 1864

Clear and pleasant.

Operations now must be initiated by the enemy. Gen. Lee writes that he is too weak to attempt to dislodge the Yankees from the Weldon Railroad. He cannot afford the loss of men necessary to accomplish it. He says the enemy, however, was "worsted" in the two conflicts, that of Friday and Sunday. And if he were to drive him away, the road would still be subject to interruption. He thinks we can still get supplies, by wagons, round the enemy's position, as well as by the Danville Road. He also suggests that corn be imported at Wilmington, and that every effort be made to accumulate supplies here; and he thinks we can hold out until corn matures some six weeks hence, so that the moral effect will be good, when it is apparent the efforts of the enemy to cut off our supplies are thwarted. He thinks the enemy has relinquished the idea of forcing our fortifications. But he says that Grant intended to force his way into Richmond last week.

I wrote a letter to the President to-day, urging the necessity of preventing the transportation of any supplies on the railroads except for distribution at cost, and thus exterminating the speculators. The poor must be fed and protected, if they be relied upon to defend the country. The rich bribe the conscription officers, and keep out of the ranks, invest their Confederate money and bonds in real estate, and would be the first to submit to the United States Government; and the poor, whom they oppress, are in danger of demoralization from suffering and disgust, and might also embrace reunion rather than a prolongation of such miseries as they have so long experienced. The patriotism of 1861 must be revived, or independence cannot be achieved. If a Peace Democrat be elected, no doubt terms of peace will be tendered, on the basis of reunion; and if they be rejected, perhaps the war may be continued. Or Lincoln may modify his conditions of peace; and the rich, always seeking repose and security, may embrace them. The surest plan is to break up speculation, and put the rich as well as the poor in the army. We must deserve independence, else we shall not get it. There must be no partiality, and especially in favor of the rich. I wrote plainly, intimating the danger of Reconstruction, without the greatest care, and a scrupulous performance of duty.

Diary of Gideon Welles: Tuesday, May 16, 1865

Great questions not taken up at the Cabinet. Several minor matters considered. Mr. Harlan, successor of Mr. Usher in the Department of the Interior, was with us to-day. Remarked to President Johnson that Governor Dennison and myself proposed leaving on Saturday next for Charleston, and if the subject of reconstruction and amnesty was to be taken up before we left, there might be haste. He said the whole matter would be satisfactorily disposed of, he presumed, before Saturday; is expecting some North Carolina Union men.

Diary of Gideon Welles: Sunday, April 16, 1865

The President and Cabinet met by agreement at 10 A.M. at the Treasury. The President was half an hour behind time. Stanton was more than an hour late. He brought with him papers, and had many suggestions relative to the measure before the Cabinet at our last meeting with President Lincoln. The general policy of the treatment of the Rebels and the Rebel States was discussed. President Johnson is not disposed to treat treason lightly, and the chief Rebels he would punish with exemplary severity.

Stanton has divided his original plan and made the reestablishing of State government applicable to North Carolina, leaving Virginia, which has a loyal government and governor, to arrange that matter of election to which I had excepted, but elaborating it for North Carolina and the other States.

Being at the War Department Sunday evening, I was detained conversing with Stanton. Finally Senator Sumner came in. He was soon followed by Gooch and Dawes of Massachusetts and some two or three others. One or more general officers also came in. Stanton took from his table, in answer to an inquiry from Sumner, his document which had been submitted to the Cabinet and which was still a Cabinet measure.

It was evident the gentlemen were there by appointment, and I considered myself an intruder or out of place. If so, Stanton did not know how to get rid of me, and it seemed awkward for me to leave. The others doubtless supposed I was there by arrangement; perhaps I was, but I felt embarrassed and was very glad, after he had read to them his first programme for Virginia, and had got about half through with the other, when Sumner demanded to know what provision was made for the colored man to vote. A line was brought me at this time by the messenger, which gave me an opportunity to leave.

Diary of Gideon Welles: Tuesday, April 25, 1865

I find myself unable to get Stanton and McCulloch to the sticking-point on the subject of opening our ports to coast trade. This and Reconstruction were the last subjects before President Lincoln at the Cabinet-meeting on the day before his death.

The course and position were discussed to-day in Cabinet with some earnestness. Speed came strongly charged, and had little doubt that Sherman was designing to put himself at the head of the army. Thought he had been seduced by Breckinridge, and was flattering himself that he would be able to control and direct public affairs. Governor Dennison, while censuring Sherman, would not condemn him unheard; he may have some reasons that we know not of, may have been short of ammunition or supplies.

I suggested that it might be vanity, eccentricity, an error of judgment, the man may have thought himself to be what he is not, – that I had no fears of his misleading the army or seducing them to promote any personal schemes of ambition, if he had such. Every regiment, and probably every company, in that army had intelligent men, fit to be legislators; they were of us and a part of us, would no more tolerate usurpation on the part of Sherman than we would.

“Suppose,” said Speed, "he should arrest Grant when Grant arrived at Raleigh,” etc., etc. Men will have strange phantoms. I was surprised at Speed, but he has, evidently, conversed on this subject before with some one or more, who has similar opinions. This apprehension which I have sometimes heard intimated has never made a serious impression on me, for I have confidence in our people, and so I have in Sherman, who believed himself to be carrying out the wishes of Mr. Lincoln and the policy of the Administration. It is the result of the conference at City Point, and intended to be in furtherance of the proclamation of Weitzel, the revocation of which he has not seen.

In reflecting on this subject, I think we have permitted ourselves amid great excitement and stirring events to be hurried into unjust and ungenerous suspicions by the erroneous statements of the Secretary of War. Speed adopts and echoes the jealousies and wild vagaries of Stanton, who seems to have a mortal fear of the generals and the armies, although courting and flattering them. He went to Savannah to pay court to Sherman when that officer was the favored general and supposed to have eclipsed Grant, but, the latter having gained the ascendant by the fall of Richmond and the capture of Lee, Stanton would now reinstate himself with Grant by prostrating Sherman.

Had conversation with President Johnson in regard to a proclamation that we would no longer forbear proceeding against those who might be taken plundering our commerce as pirates. He concurred with me most fully, after discussing the question, and desired me to bring him the form of proclamation or have it prepared for the next Cabinet day. As the subject of preparing these papers belonged properly to the State Department, I felt it would be improper to slight Mr. Hunter, who is Acting Secretary. I therefore called upon him, and fortunately met Senator Sumner, Chairman of the Committee on Foreign Relations, who entered heartily into the measure and said he had some days since alluded to it as a step that should be taken.

When brought before the Cabinet, Stanton objected to it because the declaration had been made April 19, 1861, and though we had forborne for four years, no new enunciation should be made, but every man we now had or whom we should hereafter capture, should be hung. Speed took much the same ground, though more narrow and technical. President Johnson was very explicit in expressing his opinions, but as the subject was new and there were these differences of opinion it was postponed for consideration.

Diary of Gideon Welles: Friday, April 14, 1865

Last night there was a general illumination in Washington, fireworks, etc. To-day is the anniversary of the surrender of Sumter, and the flag is to be raised by General Anderson.

General Grant was present at the meeting of the Cabinet to-day, and remained during the session. The subject was the relations of the Rebels, the communications, the trade, etc. Stanton proposed that intercourse should be opened by his issuing an order, that the Treasury would give permits to all who wished them to trade, excluding contraband, and he, Stanton, would order the vessels to be received into any port. I suggested that it would be better that the President should issue a proclamation stating and enjoining the course to be pursued by the several Departments.

McCulloch expressed a willingness to be relieved of the Treasury agents. General Grant expressed himself very decidedly against them; thought them demoralizing, etc. The President said we, i. e. the Secretaries of Treasury, War, and Navy, had given the subject more attention than he had and he would be satisfied with any conclusion we would unite upon. I proposed to open the whole coast to any one who wished to trade, and who had a regular clearance and manifest, and was entitled to a coast license. Stanton thought it should not extend beyond the military lines. General Grant thought they might embrace all this side of the Mississippi.

Secretary Stanton requested the Cabinet to hear some remarks which he desired to make, and to listen to a proposition or ordinance which he had prepared with much care and after a great deal of reflection, for reconstruction in the Rebel States. The plan or ordinance embraced two distinct heads, one for asserting the Federal authority in Virginia, the other for reëstablishing a State government. The first struck me favorably, with some slight emendations; the second seemed to me objectionable in several essentials, and especially as in conflict with the principles of self-government which I deem essential. There was little said on the subject, for the understanding was that we should each be furnished with a copy for criticism and suggestion, and in the mean time we were requested by the President to deliberate and carefully consider the proposition. He remarked that this was the great question now before us, and we must soon begin to act. Was glad Congress was not in session.

I objected that Virginia occupied a different position from that of any other State in rebellion; that while regular State governments were to be established in other States, whose Secession governments were nullities and would not be recognized, Virginia had a skeleton organization which she had maintained through the War, which government we had recognized and still recognized; that we to-day acknowledged Peirpoint as the legitimate Governor of Virginia. He had been elected by only a few border counties, it was true; had never been able to enforce his authority over but a small portion of the territory or population; nevertheless we had recognized and sustained him.

The President said the point was well taken. Governor Dennison said he thought we should experience little difficulty from Peirpoint. Stanton said none whatever.

I remarked the fact was not to be controverted that we had treated with the existing government and could not ignore our own acts. The President and a portion of the Cabinet had, in establishing the new State of West Virginia, recognized the validity of the government of Virginia and of Peirpoint's administration, which had given its assent to that division. Without that consent no division could legally have taken place. I had differed with others in that matter, but consistency and the validity of our own act required us to continue to acknowledge the existing government. It was proper we should enforce the Federal authority, and it was proper we should aid Governor Peirpoint, whose government was recognized and established. In North Carolina a legal government was now to be organized and the State reëstablished in her proper relations to the Union.

Inquiry had been made as to army news on the first meeting of the Cabinet, and especially if any information had been received from Sherman. None of the members had heard anything, and Stanton, who makes it a point to be late, and who has the telegraph in his Department, had not arrived. General Grant, who was present, said he was hourly expecting word. The President remarked it would, he had no doubt, come soon, and come favorable, for he had last night the usual dream which he had preceding nearly every great and important event of the War. Generally the news had been favorable which succeeded this dream, and the dream itself was always the same. I inquired what this remarkable dream could be. He said it related to your (my) element, the water; that he seemed to be in some singular, indescribable vessel, and that he was moving with great rapidity towards an indefinite shore; that he had this dream preceding Sumter, Bull Run, Antietam, Gettysburg, Stone River, Vicksburg, Wilmington, etc. General Grant said Stone River was certainly no victory, and he knew of no great results which followed from it. The President said however that might be, his dream preceded that fight.1

“I had,” the President remarked, “this strange dream again last night, and we shall, judging from the past, have great news very soon. I think it must be from Sherman. My thoughts are in that direction, as are most of yours.

I write this conversation three days after it occurred, in consequence of what took place Friday night, and but for which the mention of this dream would probably have never been noted. Great events did, indeed, follow, for within a few hours the good and gentle, as well as truly great, man who narrated his dream closed forever his earthly career.

I had retired to bed about half past-ten on the evening of the 14th of April, and was just getting asleep when Mrs. Welles, my wife, said some one was at our door. Sitting up in bed, I heard a voice twice call to John, my son, whose sleeping-room was on the second floor directly over the front entrance. I arose at once and raised a window, when my messenger, James Smith, called to me that Mr. Lincoln, the President, had been shot, and said Secretary Seward and his son, Assistant Secretary Frederick Seward, were assassinated. James was much alarmed and excited. I told him his story was very incoherent and improbable, that he was associating men who were not together and liable to attack at the same time. “Where," I inquired, “was the President when shot?" James said he was at Ford's Theatre on 10th Street. "Well," said I, “Secretary Seward is an invalid in bed in his house yonder on 15th Street." James said he had been there, stopped in at the house to make inquiry before alarming me.

I immediately dressed myself, and, against the earnest remonstrance and appeals of my wife, went directly to Mr. Seward's, whose residence was on the east side of the square, mine being on the north. James accompanied me. As we were crossing 15th Street, I saw four or five men in earnest consultation, standing under the lamp on the corner by St. John's Church. Before I had got half across the street, the lamp was suddenly extinguished and the knot of persons rapidly dispersed. For a moment and but a moment I was disconcerted to find myself in darkness, but, recollecting that it was late and about time for the moon to rise, I proceeded on, not having lost five steps, merely making a pause without stopping. Hurrying forward into 15th Street, I found it pretty full of people, especially so near the residence of Secretary Seward, where there were many soldiers as well as citizens already gathered.

Entering the house, I found the lower hall and office full of persons, and among them most of the foreign legations, all anxiously inquiring what truth there was in the horrible rumors afloat. I replied that my object was to ascertain the facts. Proceeding through the hall to the stairs, I found one, and I think two, of the servants there holding the crowd in check. The servants were frightened and appeared relieved to see me. I hastily asked what truth there was in the story that an assassin or assassins had entered the house and assaulted the Secretary. They said it was true, and that Mr. Frederick was also badly injured. They wished me to go up, but no others. At the head of the first stairs I met the elder Mrs. Seward, who was scarcely able to speak but desired me to proceed up to Mr. Seward's room. I met Mrs. Frederick Seward on the third story, who, although in extreme distress, was, under the circumstances, exceedingly composed. I asked for the Secretary's room, which she pointed out, — the southwest room. As I entered, I met Miss Fanny Seward, with whom I exchanged a single word, and proceeded to the foot of the bed. Dr. Verdi and, I think, two others were there. The bed was saturated with blood. The Secretary was lying on his back, the upper part of his head covered by a cloth, which extended down over his eyes. His mouth was open, the lower jaw dropping down. I exchanged a few whispered words with Dr. V. Secretary Stanton, who came after but almost simultaneously with me, made inquiries in a louder tone till admonished by a word from one of the physicians. We almost immediately withdrew and went into the adjoining front room, where lay Frederick Seward. His eyes were open but he did not move them, nor a limb, nor did he speak. Doctor White, who was in attendance, told me he was unconscious and more dangerously injured than his father.

As we descended the stairs, I asked Stanton what he had heard in regard to the President that was reliable. He said the President was shot at Ford's Theatre, that he had seen a man who was present and witnessed the occurrence. I said I would go immediately to the White House. Stanton told me the President was not there but was at the theatre. “Then,” said I, “let us go immediately there.” He said that was his intention, and asked me, if I had not a carriage, to go with him. In the lower hall we met General Meigs,2 whom he requested to take charge of the house, and to clear out all who did not belong there. General Meigs begged Stanton not to go down to 10th Street; others also remonstrated against our going. Stanton, I thought, hesitated. Hurrying forward, I remarked that I should go immediately, and I thought it his duty also. He said he should certainly go, but the remonstrants increased and gathered round him. I said we were wasting time, and, pressing through the crowd, entered the carriage and urged Stanton, who was detained by others after he had placed his foot on the step. I was impatient. Stanton, as soon as he had seated himself, turned round, rose partly, and said the carriage was not his. I said that was no objection. He invited Meigs to go with us, and Judge Cartter of the Supreme Court3 mounted with the driver. At this moment Major Eckert4 rode up on horseback beside the carriage and protested vehemently against Stanton's going to 10th Street; said he had just come from there, that there were thousands of people of all sorts there, and he considered it very unsafe for the Secretary of War to expose himself. I replied that I knew not where he would be more safe, and that the duty of both of us was to attend the President immediately. Stanton concurred. Meigs called to some soldiers to go with us, and there was one on each side of the carriage. The streets were full of people. Not only the sidewalk but the carriage-way was to some extent occupied, all or nearly all hurrying towards 10th Street. When we entered that street we found it pretty closely packed.

The President had been carried across the street from the theatre, to the house of a Mr. Peterson. We entered by ascending a flight of steps above the basement and passing through a long hall to the rear, where the President lay extended on a bed, breathing heavily. Several surgeons were present, at least six, I should think more. Among them I was glad to observe Dr. Hall, who, however, soon left. I inquired of Dr. H., as I entered, the true condition of the President. He replied the President was dead to all intents, although he might live three hours or perhaps longer.

The giant sufferer lay extended diagonally across the bed, which was not long enough for him. He had been stripped of his clothes. His large arms, which were occasionally exposed, were of a size which one would scarce have expected from his spare appearance. His slow, full respiration lifted the clothes with each breath that he took. His features were calm and striking. I had never seen them appear to better advantage than for the first hour, perhaps, that I was there. After that, his right eye began to swell and that part of his face became discolored.

Senator Sumner was there, I think, when I entered. If not he came in soon after, as did Speaker Colfax, Mr. Secretary McCulloch, and the other members of the Cabinet, with the exception of Mr. Seward. A double guard was stationed at the door and on the sidewalk, to repress the crowd, which was of course highly excited and anxious. The room was small and overcrowded. The surgeons and members of the Cabinet were as many as should have been in the room, but there were many more, and the hall and other rooms in the front or main house were full. One of these rooms was occupied by Mrs. Lincoln and her attendants, with Miss Harris. Mrs. Dixon and Mrs. Kinney came to her about twelve o'clock. About once an hour Mrs. Lincoln would repair to the bedside of her dying husband and with lamentation and tears remain until overcome by emotion.

1 General Grant interrupted to say Stone River was no victory, — that a few such fights would have ruined us. The President looked at Grant curiously and inquiringly; said they might differ on that point, and at all events his dream preceded it. This was the first occasion I had to notice Grant's jealous nature. In turning it over in my mind at a later period, I remembered that Rawlins had been sent to Washington to procure action against General McClernand at Vicksburg. Later there was jealousy manifested towards General Thomas and others who were not satellites. - G. W.

Diary of Gideon Welles: November 25, 1864

For some weeks I have been unable to note down occurrences daily. On the evening of the election, the 8th, I went to the War Department about nine o'clock by invitation of the President. Took Fox with me, who was a little reluctant to go lest he should meet Stanton, who had for some days been ill. The Department was locked, but we were guided to the south door. The President was already there, and some returns from different quarters had been received. He detailed particulars of each telegram which had been received. Hay soon joined us and, after a little time, General Eaton. Mr. Eckert, the operator, had a fine supper prepared, of which we partook soon after 10. It was evident shortly after that the election had gone pretty much one way. Some doubts about New Jersey and Delaware. We remained until past one in the morning and left. All was well.

The President on two or three occasions in Cabinet meeting alluded to his message. It seemed to dwell heavy on his mind, — more than I have witnessed on any former occasion. On Friday, the 25th, he read to us what he had prepared. There was nothing very striking, and he evidently labors in getting it up. The subject of Reconstruction and how it should be effected is the most important theme. He says he cannot treat with Jeff Davis and the Jeff Davis government, which is all very well, but whom will he treat with, or how commence the work? All expressed themselves very much gratified with the document and his views. I suggested whether it would not be well to invite back not only the people but the States to their obligations and duties. We are one country. I would not recognize what is called the Confederate government, for that is a usurpation, but the States are entities and may be recognized and treated with. Stanton, who was present for the first time for six weeks, after each had expressed his views, and, indeed, after some other topic had been taken up and disposed of, made some very pertinent and in the main proper and well-timed remarks, advising the President to make no new demonstration or offer, to bring forward his former policy and maintain it, to hold open the doors of conciliation and invite the people to return to their duty. He would appeal to them to do so, and ask them whether it would not have been better for them and for all, had they a year since accepted his offer.

Each of the members of the Cabinet were requested to prepare a brief statement of the affairs of their respective Departments. Seward had already handed in much of his. I told the President I would hand him my brief the next day.

At this meeting on the 25th, Mr. Usher made some allusion to the gold that was forthcoming in the Territories.

The President interrupted him, saying he had been giving that matter a good deal of attention and he was opposed to any excitement on the subject. He proposed that the gold should remain in the mountains until the War was over, for it would now only add to the currency and we had already too much currency. It would be better to stop than 1 to increase it.

Mr. Fessenden said something must be done, for he could not any longer negotiate on the basis of paying interest in coin. We cannot, he says, get the specie and must stop paying it out. I was amused. Neither of them appeared to have even the rudiments of finance and currency. Gold is no longer a currency with us. It is merchandise, and all that may be got from Idaho, Nevada, Arizona, and California will not swell the volume of currency. Our banking and irredeemable paper issues are legal tenders and made currency not based on specie, and of course it is an inferior currency.

Our Secretary of the Treasury must learn that if he does not demand and pay out gold he will have none. If he will reduce the volume of paper currency, so as to create a demand for gold, he will get it, but he will never have it if he slights it. He has schemes for getting out cotton to relieve him and the Treasury in making payments, and the blockade is to be indirectly violated in order to get cotton from the Rebels with which to purchase gold. Of course we shall have to pay the Rebels if not in gold, in its equivalent, for all the cotton we get of them, and shall thus furnish them with the sinews of war.

It cannot be otherwise than that the country will become impoverished with such ideas pervading the government. There will be devastation and ruin, if not corrected, before us. Fessenden is of the old Whig school of folly on finance and currency; is resorting to flimsy expedients, instead of honest, hard truth. Gold is truth; irredeemable paper and flimsy expedients are not.

Diary of Gideon Welles: Monday, July 25, 1864

There has been a little ferment in military circles, as newspaper correspondents write. Blair told me a few days since that Cutts came on his steps to sympathize and express his regret that the vandals should have burnt his (Blair's) house. Blair said that nothing better could be expected while poltroons and cowards had the management of military affairs. Cutts left abruptly. I now hear it stated that General Halleck reported the remark to Stanton, and Stanton forwarded Halleck's letter to the President, who remarked that men would speak their minds freely in this country. I have no idea that either Halleck or Stanton will press the subject farther. It would please Blair, I think, if they would.

Mr. Solicitor Whiting spent an hour at my house last evening. The principal topic of discussion was that of Reconstruction. He maintains that the States which have seceded have no rights, - that they cannot resume position in the Union without consent, and the formation of a new constitution in each which excludes slavery. I denied the right of Congress to impose that condition on a State, like North Carolina for instance, and insisted that the States must be equal in political rights, — that if Massachusetts or any of the old States reserved and retained that power, it belonged as well to North Carolina. An amendment of the Constitution would be necessary abolishing slavery in all. Without meeting that point, he expressed a disbelief in the reserved right of Massachusetts on that subject. He denied that a majority, or the whole people, of North Carolina could establish or reëstablish a government and continue to be or to become a member of the Union after having been in rebellion, except by consent or permission. “Then," said I, "you recognize the right and the fact of secession.” This he was unwilling to admit, but dwelt on international law, belligerent attitudes, and matters outside of the Constitution to punish States inside. I asked what he would do with loyal citizens in Rebel States, those who had never borne arms or done any act to forfeit their allegiance, men like John Minor Botts or Andrew Johnson, for instance. He maintained that being in States that rebelled they were to be treated like the Rebels.

Solicitor Whiting is self-sufficient but superficial, with many words, some reading, but no very sound or well-founded political views. Yet he considers himself a pater conscriptus, a teacher learned in the law and wise on the subject of government. Seward consults him, and Stanton uses him. He writes letters and opinions to order, gets up pamphlets; is serving without pay, and is careful to tell that fact. One of these years, sooner or later, let no one be surprised to find all his services fully compensated. Men who profess to serve the government gratuitously are usually better paid than others.

Met General Emory at Blair's. Has just come in from pursuit of the raiders, without overtaking them. Had quite a talk concerning matters on the Red River and our disaster there. He gives an interesting detail. Tells the old story of a multitude of fussy men who accompanied Banks with little carpet-bags filled with greenbacks, etc.

Donald McKay publishes a letter defending the Navy Department from newspaper attacks on the subject of the monitors. It is very well done and unexpected. The Evening Post publishes it, and so does the Times copy it, but not yet the Tribune.

Blair is sore and vexed because the President frequently makes a confidant and adviser of Seward, without consulting the rest of the Cabinet. I told him this had been the course from the beginning; Seward and Chase had each striven for the position of Special Executive Counsel; that it had apparently been divided between them, but Seward had outgeneraled or outintrigued Chase. The latter was often consulted when others were not, but often he was not aware of things which were intrusted to Seward (who was superserviceable) and managed by him.

Diary of John Beauchamp Jones: January 14, 1864

Mr. A. ——, editor of the ——, recommends the Secretary of War to get Congress to pass, in secret session, a resolution looking to a reconstruction of the Union on the old basis, and send Commissioners to the Northern Governors. Meantime, let the government organize an army of invasion, and march into Pennsylvania. The object being to sow dissension among the parties of the North.

A letter from a Mr. Stephens, Columbia, S. C, to the President, says it is in his power to remove one of the evils which is bringing the administration into disrepute, and causing universal indignation—Gen. Winder. The writer says Winder drinks excessively, is brutish to all but Marylanders, and habitually receives bribes, etc. The President indorsed on it that he did not know the writer, and the absence of specifications usually rendered action unnecessary. But perhaps the Secretary may find Mr. S.'s character such as to deserve attention.

Captain Warner says it is believed there will be a riot, perhaps, when Col. Northrop, the Commissary-General, may be immolated by the mob. Flour sold to-day at $200 per barrel; butter, $8 per pound; and meat from $2 to $4. This cannot continue long without a remedy.

The President has another reception to-night.

A Yankee Account Of The Treatment Op Confederate Prisoners.—The Chicago Times gives the account which follows of the treatment of our soldiers at Camp Douglas.

It is said that about four weeks ago one of the prisoners was kindling his fire, which act he had a right to perform, when one of the guard accosted him with, “Here, what are you doing there?” The prisoner replied, “That is not your business,” when the guard instantly drew his musket and shot the fellow dead. It is said also that a mulatto boy, a servant of one of the Confederate captains, and, of course, a prisoner of war, who was well known to have a pass to go anywhere within the lines, was walking inside the guard limits about a day after the above occurrence, when the guard commanded him to halt. He did not stop, and was instantly killed by a bullet.

It is also charged that, at the time the discovery was made of an attempt on the part of some of the prisoners to escape, a party of three or four hundred was huddled together and surrounded by a guard; that one of them was pushed by a comrade and fell to the ground, and that instantly the unfortunate man was shot, and that three or four others were wounded. It is further stated that it is no uncommon thing for a soldier to fire on the barracks without any provocation whatever, and that two men were thus shot while sleeping in their bunks a week or two ago, no inquiry being made into the matter. No court-martial has been held, no arrest has been made, though within the past month ten or twelve of the prisoners have been thus put out of the way. Another instance need only be given: one of the prisoners asked the guard for a chew of tobacco, and he received the bayonet in his breast without a word.

Major-General William T. Sherman to Major-General Henry W. Halleck, September 17, 1863

DEAR GENERAL: I have received your letter of August 29, and with pleasure confide to you fully my thoughts on the important matters you suggest, with absolute confidence that you will use what is valuable and reject the useless or superfluous.

That part of the continent of North America known as Louisiana, Mississippi, and Arkansas is in my judgment the key to the whole interior. The Valley of the Mississippi is America, and although railroads have changed the economy of intercommunication, yet the water channels still mark the lines of fertile land and afford carriage to the heavy products of it. The inhabitants of the country on the Monongahela, the Illinois, the Minnesota, the Yellowstone, and Osage are as directly concerned in the security of the Lower Mississippi as are those who dwell on its very banks in Louisiana, and now that the nation has recovered its possession this generation of men would commit a fearful mistake if we again commit its charge to a people liable to mistake their title, and assert, as was recently done, treat because they dwell by sufferance on the banks of this mighty stream they had a right to control its navigation.

I would deem it very unwise at this time, or for years to come, to revive the State Governments of Louisiana, &c., or to institute in this quarter any civil government in which the local people have much to say. They had a government, and so mild and paternal that they gradually forgot they had any at all, save what they themselves controlled; they asserted absolute right to seize public moneys, forts, arms, and even to shut up the natural avenues of travel and commerce. They chose war; they ignored and denied all the obligations of the solemn contract of government and appealed to force. We accepted the issue, and now they begin to realize that war is a two-edged sword, and, it may be, that many of the inhabitants cry for peace. I know them well and the very impulses of their nature; and to deal with the inhabitants of that part of the South which borders the great river we must recognize the classes into which they have naturally divided themselves.

First, the large planters owning lands, slaves, and all kinds of personal property. These are on type whole the ruling class. They are educated, wealthy, and easily approached. In some districts they are as bitter as gall, and have given up slaves, plantations, and all, serving in the armies of the Confederacy, whereas in others they are conservative. None dare admit a friendship to us, though they say freely that they were opposed to war and disunion. I know we can manage this class, but only by action; argument is exhausted, and words have not their usual meaning. Nothing but the logic of events touches their understanding, but of late this has worked a wonderful change. If our country were like Europe, crowded with people, I would say it would be easier to replace this population than to reconstruct it subordinate to the policy of the nation; but as this is not the case, it is better to allow them, with individual exceptions, gradually to recover their plantations, to hire any species of labor, and adapt themselves to the new order of things. Still their friendship and assistance to reconstruct order out of the present ruin cannot be depended on. They watch the operations of our armies, and hope still for a Southern Confederacy that will restore to them the slaves and privileges which they feel are otherwise lost forever. In my judgment we have two more battles to win before we should even bother our minds with the idea of restoring civil order, viz, one near Meridian in November, and one near Shreveport in February and March, when Red River is navigable by our gunboats. When these are done, then, and not until then, win the planters of Louisiana, Arkansas, and Mississippi submit. Slavery is already gone, and to cultivate the land negro or other labor must be hired. This of itself is a vast revolution, and time must be afforded to allow men to adjust their minds and habits to the new order of things. A civil government of the representative type would suit this class far less than a pure military rule, one readily adapting itself to actual occurrences and able to enforce its laws and orders promptly and emphatically.

Second, the smaller farmers, mechanics, merchants, and laborers. This class will probably number three-fourths of the whole, have in fact no real interest in the establishment of a Southern Confederacy, and have been led or driven into war on the false theory that they were to be benefited somehow, they knew not how. They are essentially tired of the war, and would slink back home if they could. These are the real tiers-état of the South, and are hardly worthy a thought, for they swerve to and fro according to events they do not comprehend or attempt to shape. When the time for reconstruction comes they will want the old political system of caucuses, legislatures, &c., something to amuse them and make them believe they are achieving wonders, but in all things they will follow blindly the lead of the planter. The Southern politicians, who understand this class, use them as the French use their masses. Seemingly consulting their prejudices, they make their orders and enforce them. We should do the same.

Third, the Union men of the South. I must confess I have little respect for this class. They allowed a clamorous set of demagogues to muzzle and drive them as a pack of curs. Afraid of shadows, they submit tamely to squads of dragoons, and permit them, without a murmur to burn their cotton, take their horses, corn, and everything, and when we reach them they are full of complaints if our men take a few fence rails for fire or corn to feed our horses. They give us no assistance or information, and are loudest in the complaints at the smallest excess of our soldiers. Their sons, horses, arms, and everything useful are in the army against us, and they stay at home, claiming all the exemptions of peaceful citizens. I account them as nothing in this great game.

Fourth, the young bloods of the South, sons of planters, lawyers about towns, good billiard players, and sportsmen—men who never did work nor never will. War suits them, and the rascals are brave; fine riders, bold to rashness, and dangerous subjects in every sense. They care not a sou for niggers, land, or anything. They hate Yankees per se, and don't bother their brains about the past, present, or future. As long as they have good horses, plenty of forage, and an open country, they are happy. This is a larger class than most men supposed, and are the most dangerous set of men which this war has turned loose upon the world. They are splendid riders, shots, and utterly reckless. Stuart, John Morgan, Forrest, and Jackson are the types and leaders of this class. This class of men must all be killed or employed by us before we can hope for peace. They have no property or future, and therefore cannot be influenced by anything except personal considerations. I have two brigades of these fellows to my front, commanded by Cosby, of the old army, and Whitfield, of Texas, Stephen D. Lee in command of the whole. I have frequent interviews with the officers and a good understanding. Am inclined to think when the resources of their country are exhausted we must employ them. They are the best cavalry in the world, but it will tax Mr. Chase's genius of finance to supply them with horses. At present horses cost them nothing, for they take where they find and don't bother their brains who is to pay for them. Some of the corn-fields which have, as they believe, been cultivated by a good-natured people for their special benefit, we propose to share with them the free use of these corn-fields planted by willing hands that will never gather it.

Now that I have sketched the people who inhabit the district of country under consideration, I will proceed to discuss the future. A civil government for any part of it would be simply ridiculous. The people would not regard it, and even the military commanders of the antagonistic party would treat it lightly. Governors would be simply petitioners for military assistance to protect supposed friendly interests, and military commanders would refuse to disperse and weaken their armies for military reasons. Jealousies would arise between the two conflicting powers, and instead of contributing to the end we all have in view, would actually defer it. Therefore I contend that the interests of the United States and of the real parties concerned demand the continuance of the simple military rule till long after all the organized armies of the South are dispersed, conquered, and subjugated. All this region is represented in the Army of Virginia, Charleston, Mobile, and Chattanooga. They have sons and relations in each, and naturally are interested in their fate. Though we hold military possession of the key-points of this country, still they contend, and naturally, that should Lee succeed in Virginia or Bragg at Chattanooga, a change will occur here also. We cannot for this reason attempt to reconstruct parts of the South as we conquer it till all idea of the establishment of a Southern Confederacy is abandoned. We should avail ourselves of the lull here to secure the geographical points that give us advantage in future military movements, and should treat the idea of civil government as one in which we as a nation have a minor or subordinate interest. The opportunity is good to impress on the population the truth that they are more interested in civil government than we are, and that to enjoy the protection of laws they must not be passive observers of events, but must aid and sustain the constituted authorities in enforcing the laws; they must not only submit themselves, but pay their taxes and render personal services when called on. It seems to me, in contemplating the past two years history, all the people of our country, North, South, East, and West have been undergoing a salutary political schooling, learning lessons which might have been taught all by the history of other people, but we had all become so wise in our own conceit that we would only learn by actual experience of our own.

The people, even of small and unimportant localities, North as well as South, had reasoned themselves into the belief that their opinions were superior to the aggregated interest of the whole nation. Half our territorial nation rebelled on a doctrine of secession that they themselves now scout, and a real numerical majority actually believed that a little State was endowed with such sovereignty that it could defeat the policy of the great whole. I think the present war has exploded that notion, and were this war to cease now, the experience gained, though dear, would be worth the expense.

Another great and important natural truth is still in contest and can only be solved by war. Numerical majorities by vote is our great arbiter. Heretofore all have submitted to it in questions left open, but numerical majorities are not necessarily physical majorities. The South, though numerically inferior, contend they can whip the Northern superiority of numbers, and therefore by natural law are not bound to submit. This issue is the only real one, and in my judgment all else should be deferred to it. War alone can decide it, and it is the only question left to us as a people. Can we whip the South? If we can, our numerical majority has both the natural and constitutional right to govern. If we cannot whip them, they contend for the natural right to select their own government, and they have the argument. Our armies must prevail over theirs. Our officers, marshals, and courts must penetrate into the innermost recesses of their land before we have the natural right to demand their submission.

I would banish all minor questions and assert the broad doctrine, that as a nation the United States has the right, and also the physical power, to penetrate to every part of the national domain, and that we will do it; that we will do it in our own time, and in our own way; that it makes no difference whether it be in one year or two, or ten or twenty; that we will remove and destroy every obstacle—if need be, take every life, every acre of land, every particle of property, everything that to us seems proper; that we will not cease until the end is attained. That all who do not aid are enemies, and we will not account to them for our acts. If the people of the South oppose, they do so at their peril; and if they stand by mere lookers-on the domestic tragedy, they have no right to immunity, protection, or share in the final result.

I even believe, and contend further, that in the North every member of the nation is bound by both natural and constitutional to "maintain and defend the Government against all its opposers whomsoever." If they fail to do it they are derelict., and can be punished or deprived of all advantage arising from the labors of those who do. If any man, North or South, withholds his share of taxes or physical assistance in this crisis of our history, he should and could be deprived of all voice in the future elections of this country, and might be banished or reduced to the condition of a denizen of the land.

War is upon us; none can deny it. It is not the act of the Government of the United States but of a faction. The Government was forced to accept the issue or submit to a degradation fatal and disgraceful to all the inhabitants. In accepting war it should be pure and simple as applied to the belligerents. I would keep it so till all traces of the war are effaced; till those who appealed to it are sick and tired of it, and come to the emblem of our nation and sue for peace. I would not coax them or even meet them half way, but make them so sick of war that generations would pass before they would again appeal to it.

I know what I say when I repeat that the insurgents of the South sneer at all overtures looking to their interest. They scorn the alliance with copperheads. They tell me to my face that they respect Grant, McPherson, and our brave associates who fight manfully and well for a principle, but despise the copperheads and sneaks who profess friendship for the South and opposition to the war as mere covers for their knavery and poltroonery.

God knows that I deplored this fratricidal war as much as any man living; but it is upon us, a physical fact, and there is only one honorable issue from it. We must fight it out, army against army and man against man, and I know and you know and civilians begin to realize the fact that reconciliation and reconstruction will be easier through and by means of strong, well-equipped and organized armies than through any species of conventions that can be framed. The issues are made, and all discussion is out of place and ridiculous.

The section of 30-pounder Parrott rifles now drilling before my tent is a more convincing argument than the largest Democratic meeting the State of New York could assemble at Albany, and a simple order of the War Department to draft enough men to fill our skeleton regiments would be more convincing as to our national perpetuity than an humble pardon to Jeff. Davis and all his misled host.

The only government now needed or deserved by the States of Louisiana, Arkansas, and Mississippi now exists in Grant's army. It needs simply enough privates to fill its ranks; all else will follow in due season. This army has its well-defined code of laws and practice, and can adapt itself to the wants and necessities of a city, the country, the rivers, the sea; indeed, to all parts of this land. It better subserves the interest and policy of the General Government, and the people prefer it to any weak or servile combination that would at once, from force of habit, revive and perpetuate local prejudices and passions. The people of this country have forfeited all right to a voice in the councils of the nation. They know it and feel it, and in after years they will be the better citizens from the dear-bought experience of the present crisis. Let them learn now, and learn it well, that good citizens must obey as well as command. Obedience to law—absolute, yea, even abject—is the lesson that this war, under Providence, will teach the free and enlightened American citizen; as a nation we will be the better for it. I never have apprehended foreign interference in our family quarrel. Of course governments founded on a different, and it may be antagonistic, principle with ours, would naturally feel a pleasure at our complications, but in the end England and France will join with us in jubilations in the triumph of a constitutional government over faction; even now the English manifest this.

I do not profess to understand Napoleon's design in Mexico, but I do not see that his taking military possession of Mexico concerns us. We have as much territory as we want. The Mexicans have failed in self-government, and it was a question to what nation she would fall a prey. That is solved, and I don't see that we are damaged. We have the finest part of the North American continent, all we can people and take care of, and if we can suppress rebellion in our land and compose the strife generated by it, we will have people, resources, and wealth which, if well combined, can defy interference from any and every quarter.

I therefore hope the Government of the United States will continue as heretofore in collecting in well-organized armies the physical strength of the nation; apply it as heretofore in asserting the national authority, persevering without relaxation to the end. This, whether near or far off, is not for us to say, but, fortunately, we have no choice. We must succeed; no other choice is left us but degradation. The South must be ruled or will rule. We must conquer them ourselves or be conquered. There is no middle course. They ask and will have nothing else, and all the talk of compromise is bosh, for we know they would even now scorn the offer. I wish the war could have been deferred for twenty years, till the superabundant population of the North should flow in and replace the losses sustained by war, but this could not be, and we are forced to take things as they arise.

All therefore I can now venture to advise is the pushing the draft to its maximum, fill the present regiments to as large a standard as possible, and push the war, pure and simple.

Great attention should be paid to the discipline of our armies, for on them will be founded the future stability of our Government. The cost of the war is of course to be considered, but finances will adjust themselves to the-actual state of affairs, and even if we would we could not change the cost. Indeed, the larger the cost now the less will it be in the end, for the end must be attained somehow, regardless of cost of life and treasure, and is merely a question of time.

Gerrit Smith: Destroy Not Man's Faith In Man!, June 12, 1862

ACCEPT THE RIGHT MAN, WHICHEVER PARTY NOMINATES HIM!

A people are demoralized by being trained to the ready entertainment of charges of corruption against those, whom they select to be their rulers, teachers and exemplars. For, when they can easily suspect such ones of baseness and crime, their faith in man is destroyed. It scarcely need be added that, when they have no longer faith in man, they will be quick to acquiesce in the application of a very low standard of morality to their leaders, and a still lower one to themselves. I say a still lower one, inasmuch as they will, naturally, expect a less degree of moral worth in the masses than in the individual, who is, here and there, selected from the masses on account of his superior wisdom and virtue. How much better it would be to persuade the people that it is their duty to hold sacred the reputation of those, whom they elevate to posts of honor! For how much more like would they, then, be to elevate those only, whose reputation is worthy to be held sacred! Moreover, what could be more elevating to themselves than such carefulness in selecting their guides and representatives!

I have been led to make these remarks by seeing the recent calumnious and contemptuous treatment of the Chief Justice and such Senators as Mr. Fessenden and Mr. Trumbull. The flood-gates of defamation were opened upon Mr. Fessenden and Mr. Trumbull, because they voted for the acquittal of the President. I wish they had voted for his conviction. For, although I had not, previously, taken much interest in the proposition to impeach him, nevertheless, after reading those parts of his last Annual Message in which he traduces the colored citizens of our country, I was quite willing to have him removed from office. Were Victoria to take such an outrageous liberty with the Irish or Scotch or Welsh, she would quickly be relieved of her crown. I do not forget that insulting the negro is an American usage. But not with impunity should the President of the whole American people insult, in his official capacity, any of the races, which make up that people — least of all the race, which is, already, the most deeply wronged of them all. This gross violation of the perfect impartiality, which should ever mark the administration of the President's high Office — this ineffable meanness of assailing the persecuted and weak, whom he might rather have consoled and cheered, should not have been overlooked, but should have been promptly and sternly rebuked. How petty the President's affair with Mr. Stanton, compared with his unrelenting wicked war upon these black millions, to whose magnanimous forgiveness of our measureless wrongs against them, and to whose brave help of our Cause we were so largely indebted for its success!

I said that I wish Mr. Fessenden and Mr. Trumbull had voted for the conviction of the President. Nevertheless, in the light of their life-long uprightness, I have not the least reason to doubt that they voted honestly. Nay, in the light of their eminent wisdom, I am bound to pause and inquire of my candid judgment whether they did not vote wisely as well as honestly.

This clamor against the Chief Justice was not, as is pretended, occasioned by his conduct in the Impeachment Trial. That this conduct was wise and impartial, scarcely one intelligent man can doubt. This clamor proceeded from the purpose of preventing his nomination to the Presidency. It is said that he desires to be President. But a desire for this high Office is not, necessarily, culpable. Instead of being prompted in all instances by selfishness, it may in some instances be born of a high patriotism and a disinterested philanthropy. For one, I should rejoice to see the Chief Justice in the Presidency; — and I say this, after a-many-years intimate acquaintance with him — after much personal observation of the workings of his head and heart. I, however, expect to vote for Grant and Colfax. I like them both; and, in the main, I like the platform on which they stand. Nevertheless, if contrary to my expectations, the Democrats shall have the wisdom to nominate the Chief Justice, and along with him a gentleman of similar views and spirit — a gentleman honest both toward the Nation's creditors and toward the negro — I shall prefer to vote for the Democratic Candidates. And why, in the case of such nomination by the Democrats, should not every Republican be willing, nay glad, to sustain the nomination? If the Democrats, at last sick and ashamed, as I have no doubt tens of thousands of them are, of ministering to the mean spirit of caste — prating for “a white man's government,” and defying the sentiment of the civilized world — shall give up their nonsense and wickedness, and nominate for office such men as Republicans have been eager to honor — how wanting in magnanimity and in devotion to truth, and how enslaved to Party, would Republicans show themselves to be, were they not to welcome this overture, and generously respond to these concessions!

By all means should the Republicans let, ay and help, the Democratic Party succeed at the coming Election, provided only that its candidates be the representatives of a real and righteous, instead of a cutaneous and spurious, Democracy. That success would bring to an end this too-long-continued War between Republicans and Democrats. That success would turn us all into Republicans and all into Democrats. The old and absorbing issues about Slavery and its incidents would, then, have passed away. The “everlasting negro,” having gained his rights, would then have sunk out of sight. Doubtless, new Parties would, ere long, be formed. But they would be formed with reference to new questions or, more generally, to old ones, which, by reason of the engrossing interest in the Slavery Battle, have been compelled to wait very long, and with very great detriment to the public weal, for their due share of the public attention.

And, then too, when the quarrel between the Republican and Democratic Parties had ended, Peace between the North and the South would speedily come. Hitherto, the Republican Party has been so anxious to keep a bad Party out of power, that it has not been in a mood to use or study all the means for producing Peace between the North and South. It should, immediately on the surrender of the South, have inculcated on the North the duty of penitently confessing her share of the responsibility for the War—a share as great as the South's, since the responsibility of the North for Slavery, out of which the War grew, was as great as the South's. Quickly would the South have followed this example of penitent confession. And, then, the two would have rivalled each other in expressions of mutual forgiveness and mutual love. Amongst these expressions would have been the avowal of the North to charge no one with Treason, and to open wide the door for the return of every exile, who had not, by some mean or murderous violation of the laws of war, shut himself out of the pale of humanity. And amongst these expressions would have been the joyful consent of the North to let fifty or a hundred millions go from the National Treasury toward helping her War-impoverished sister rise up out of her desolations. The heart of the South would, now, have been won; and she would have manifested the fact by tendering to the North a carte blanche — feeling no fear that there would be any designed injustice in the terms of “Reconstruction,” which her forgiving and generous foe should write upon it. Yes, there would, then, have been Peace between the North and the South — a true and loving and enduring Peace. Ashamed of their past, they would unitedly and cordially have entered upon the work of making a future for our country as innocent and as happy as that past had been guilty and sorrowful. It is not, now, too late to have, by such means, such a Peace. We should, surely, have it, were there to be, at the coming Election, that oneness between Republicans and Democrats, which good sense and good feeling call for.

Is it said that the money, which in loans or (preferably) gifts to the South, I ask to have used in effecting this Peace would make the Peace cost too much? I answer that it would be returned tenfold. The improvement in our National credit, resulting from such a Peace, would, very soon, enable our Government to borrow at an interest of four per cent. Comparatively small, then, would be our taxes, and, by the way, comparatively small, then, would be the temptation to cheat the Nation's creditors.

PETERBORO, June 6, 1864.
MRs. E. CADY STANTON, New-York:

MY DEAR Cousin: I have your letter. It would be too great labor to answer all, who seek to know my choice amongst the presidential candidates. But I must answer you.

I have no choice. The first of September will be time enough for me and for every other person to have one. Intermediate events and changes will be indispensable lessons in our learning who should be the preferred candidate. To commit ourselves in time of war to a candidate one month before it is necessary, is worse than would be a whole year of such prematureness in time of peace. Then there is the absorbing, not to say frenzying, interest, which attends our important elections. That it is frenzying is manifest from the scornful reproach and wild invective, which the press is already heaping up on Lincoln and Fremont — both of them honest and able men, and both of them intent on saving the country. How unwise, nay how insane, to let this absorbing and frenzying interest come needlessly early into rivalry with our interest in the one great work of crushing the rebellion! For more than half a year have I frequently and faithfully, both with lips and pen, deprecated the premature agitation of the question who should be the chosen candidate. If, therefore, the Cleveland and Baltimore Conventions shall have the effect to divide the loyal voters so far as to let a pro-slavery and sham Democrat slip into the Presidency through their divisions, I, at least, shall not be responsible for the ruin that may come of it.

My concern whether it shall be Lincoln or Fremont or Chase or Butler or Grant who shall reach the presidential chair is comparatively very slight. But my concern to keep out of it a man, who would make any other terms with the rebels than their absolute submission is overwhelming. For any other terms would not only destroy our nation, but lessen the sacredness of nationality everywhere, and sadly damage the most precious interests of all mankind.

Since the Rebellion broke out, I have been nothing but an anti-rebellion man. So unconditionally have I gone for putting it down unconditionally, as to make no stipulations in behalf of m most cherished objects and dearest interests. And so shall I continue to go. I love the anti-slavery cause. Nevertheless, I would have the rebellion put down at whatever necessary expense to that cause. I love the Constitution; and deprecate the making of any even the slightest change in it. Nevertheless, I make infinitely less account of saving it than of destroying the rebellion. I love my country. But sooner than see her compromise with the rebels, I would see her exhaust herself and perish in her endeavors to defeat their crime — that greatest crime of all the ages and all the world. I do not forget that many of my old fellow abolitionists accuse me of having been unfaithful to the anti-slavery cause during the rebellion. My first answer to them is — that to help suppress the rebellion is the duty which stands nearest to me: and my second answer — that in no way so well as in suppressing it can the anti-slavery cause or any other good cause be promoted. There is not a good cause on the earth that has not an enemy in the unmixed and mighty wickedness of this rebellion.

You will rightly infer from what I have said, that my vote will be cast just where I shall judge it will be like to go farthest in keeping a disloyal man out of the Presidency. My definition of a disloyal man includes every one who would consent to obtain peace by concessions to the rebels – concessions however slight. Should the rebellion be disposed of before the election, I might possibly refuse to vote for any of the present candidates. When voting in time of war, and especially such a fearful war as the present, for a Governor or President, I vote for a leader in the war rather than for a civil ruler. Where circumstances leave me free to vote for a man with reference mainly to his qualifications as a civil ruler, I am, as my voting for thirty years proves, very particular how I vote. In 1856, Fremont was in nomination for the Chief Magistracy. I honored him — but I did not vote for him. In 1860, Lincoln was nominated for it. I had read his Debate with Senator Douglas, and I thought well of him. But neither for him did I vote. To-day, however, I could cheerfully vote for either to be the constitutional head of the army and navy. I go further, and say, that to save the Presidential office from going into the hands of one who would compromise with the rebels I, would vote for a candidate far more unsound on slavery than the severest abolition critic might judge either Lincoln or Fremont to be. But were there no such danger, I would sternly refuse to vote for any man who recognizes, either in or out of the Constitution, a law for slavery, or who would graduate any human rights, natural or political, by the color of the skin.

This disposition to meddle with things before their time is one that has manifested itself, and worked badly, all the way through the war. The wretched attempts at “Reconstruction” are an instance of it. “Reconstruction” should not so much as have been spoken of before the rebellion was subdued. I hope that by that time all loyal men, the various doctrines and crotchets to the contrary notwithstanding, will be able to see that the seceded States did, practically as well as theoretically, get themselves out of the Union and Nation — as effectually out as if they had never been in. Our war with Mexico ended in a treaty of peace with her. Doubtless our war with the South will end in like manner. If we are the conqueror, the treaty will, I assume, be based on the unconditional surrender of the South. And then the South, having again become a portion of our nation, Congress will be left as free to ordain the political divisions of her territory, as it was to ordain those of the territory we conquered from Mexico. Next in order, Congress will very soon, as I have little doubt, see it to be safe and wise to revive our old State lines. Nevertheless, I trust, that such revival would never be allowed until Congress should see it to be clearly safe and wise. We hear much of the remaining constitutional rights of the loyal men in the seceded States. But they, no more than their rebellious neighbors, have such rights. It is true that the rebellion is their misfortune instead of their crime. Nevertheless, it severed every political cord as well between the nation and themselves as between the nation and those rebellious neighbors. The seceded States embarked in a revolution, which swept away all the political relations of all their people, loyal as well as disloyal. Such is the hazard, which no man, however good, can escape from. If the major part or supreme power of his State carries it to destruction, he is carried along with it. A vigilant, informed, active, influential member of his body politic does it therefore behoove every good man to be. In his haste for “Reconstruction,” the President went forward in it — whereas he is entitled to not the least part in it, until Congress has first acted in it. In the setting up of military or provisional governments, as we proceed in our conquests, his is the controlling voice — for he is the military head of the nation. But in regard to the setting up of civil governments in the wake of those conquests, he is entitled to no voice at all until after Congress has spoken. Another instance of meddling with things before their time is this slapping of the face of France with the “Monroe Doctrine.” I was about to say that doing so serves but to provoke the enmity of France. There is, however, one thing more which it provokes and that is the ridicule of the world. For us, whilst the rebels are still at the throat of our nation, and may even be at her funeral, to be resolving that we will protect the whole Western Continent from the designs of the whole Eastern Continent, is as ludicrous a piece of impotent bravado as ever the world laughed at. And still another instance of our foolish prematureness is the big words in which we threaten to punish the leaders of the rebellion. It would be time enough for these big words when we had subdued the rebellion and captured the leaders. In the mean time there should be only big blows. Moreover, if we shall succeed in getting these leaders into our hands, it will be a question for the gravest consideration whether we should not beg their pardon instead of punishing them. What was it that stirred up the rebellion? The spirit of slavery. That alone is the spirit by means of which Southern treason can build up a fire in the Southern heart whose flames shall burst out in rebellion. Slavery gone from the South, and there will never more be rebellions there to disturb the peace and prosperity in which North and South will ever after dwell together. Who was the guiltier party in feeding and inflaming that spirit? The pro-slavery and preponderant North. The guiltier North it was, that had the more responsible part in moulding the leaders of the rebellion. Does it then become this guiltier North to be vengeful toward these her own creations—her own children ?—and, what is more, vengeful toward them for the bad spirit which she herself had so large a share in breathing into them? — for the Satanic character which she herself did so much to produce in them? But I shall be told that the North has repented of her in upholding slavery, and thereby furnishing the cause of the rebellion; and that the South should have followed her example. But if her repentance did not come until after the rebellion broke out, then surely it came too late to save her from responsibility for the rebellion. Has it, however, come even yet? I see no proof of it. I can see none so long as the American people continue to trample upon the black man. God can see none. Nor will he stay his desolating judgments so long as the American Congress, instead of wiping out penitently and indignantly all fugitive slave statutes, is infatuated enough to be still talking of “the rights of slaveholders,” and of this being “a nation for white men.” Assured let us be, that God will never cease from his controversy with this guilty nation until it shall have ceased from its base and blasphemous policy of proscribing, degrading, and outraging portions of his one family. The insult to him in the persons of his red and black children, of which Congress was guilty in its ordinance for the Territory of Montana, will yet be punished in blood, if it be not previously washed out in the tears of penitence. And this insult, too, whilst the nation is under God’s blows for like insults! What a silly as well as wicked Congress! And then that such a Congress should continue the policy of providing chaplains for the army! Perhaps, however, it might be regarded as particularly fit for such a Congress to do this. Chaplains to pray for our country's success whilst our country continues to perpetrate the most flagrant and diabolical forms of injustice! As if the doing of justice were not the indispensable way of praying to the God of justice! It is idle to imagine that God is on the side of this nation. He can not be with us. For whilst he is everywhere with justice, he is nowhere with injustice. I admit that he is not on the side of the rebellion. From nothing in all his universe can his soul be further removed than from this most abominable of all abominations. If we succeed in putting it down, our success, so far as God is concerned, will be only because he hates the rebellion even more than he hates our wickedness. To expect help from him in any other point of view than this, is absurd. Aside from this, our sole reliance must be, as was the elder Napoleon's, on having “the strongest battalions.” I believe we shall succeed — but that it will be only for the reasons I have mentioned — only because we are the stronger party and that God is even more against the rebels than he is against us. How needful, however, that we guard ourselves from confounding success against the rebellion with the salvation of the nation! Whether the nation shall be saved is another question than whether the rebellion shall be suppressed. In the providence of God, even a very wicked nation may be allowed to become a conqueror — may be used to punish another wicked nation before the coming of its own turn to be conquered and punished. But a nation, like an individual, can be saved only by penitence and justice.

Gerrit Smith’s Speech on the Fort Pillow and Plymouth Massacres: Peterboro, Massachusetts, April 26, 1864.

The whole civilized world will be startled and horrified by this slaughter of probably not less than five or six hundred persons. The excuse in the case of a part of the slaughtered is, that they were traitorous citizens of the Confederacy: in the case of another part, that they were whites fighting by the side of blacks: in the case of the remainder, including women and even children, that they were blacks. That these were blacks, was cause enough why, though numbering three or four hundred, they should be murdered — murdered in utter contempt of all the sacred rights of prisoners of war. It is of the crime against these, I would now speak.

Who are to be held amenable for this crime? The rebels. Yes, but not the rebels only. The authorship of this crime, so matchless in its worst features, is very comprehensive. The responsibility for it is wider than our nation. England shares in the authorship and responsibility, because it was she who planted slavery in America, and because it is slavery out of which this crime has come. Our own nation, however, is the far guiltier one. The guilt of this crime is upon all her people who have contributed to that public sentiment, which releases white men from respecting the rights of black men. Our highest Court says that this satanic sentiment prevailed in the early existence of our nation. Certain it is, that it has prevailed in all the later periods of that existence. Who are they who have contributed to generate it? All who have held that blacks are unfit to sit by the side of whites in the church, the school, the car and at the table. All who have been in favor of making his complexion shut out a black man from the ballot-box. All who have been for making a man's title to any of the rights of manhood turn on the color of the skin in which his Maker has chosen to wrap him. All, in short, who have hated or despised the black man.

Even President Lincoln, whom God now blesses and will yet more bless for the much he has done for his black brethren, is not entirely innnocent of the Fort Pillow and Plymouth massacres. Had his plan of “Reconstruction” recognized the right of the black men to vote, it would thereby have contributed to lift them up above outrage, instead of contributing, as it now does, to invite outrage upon them. By the way, it is a pity that he undertook “Reconstruction.” It was entirely beyond his civil capacity to do so: and it was entirely beyond his military capacity to have a part in setting up any other than a military or provisional government. Moreover, this is the only kind of government which it is proper to set up in the midst of war. The leisure and advantages of peace are necessary in the great and difficult work of establishing a permanent government. In this connection let me advert for a moment to the doctrine, “Once a State always a State” — a doctrine so frequently wielded against “Reconstruction” on any terms. Where is the authority for this doctrine? In the Constitution, it is said. But nowhere does the Constitution say that a State may plunge into war, secure at all hazards from some of the penalties of war. But amongst the penalties of war is whatever change the conqueror may choose to impose upon the conquered territory. I admit that it is very desirable to have all the revolting States reestablished — reinstated. But that there is any law by which this becomes inevitable is absurd. Nowhere does the Constitution say that a State is to be exempt from the operation of the law of war. Nowhere does it undertake to override the law of war. How clear is it, then, that by this paramount law these revolted States will, when conquered, lie at the will of the conqueror! And how clear is it, that it will then turn not at all upon the Constitution, but upon this will of the conqueror, backed by this paramount law of war, whether the old statehood of these States shall be revived, or whether they shall be remanded to a territorial condition, and put upon their good behavior!

There is another instance in which the President has contributed to that cruel public sentiment, which leaves the black race unprotected. I refer to his so strangely long delay in promising protection to the black soldier, and to the even longer and not yet ended delay in affording it. The President is a humane as well as an honest man; and the only explanation I can find for his delay to protect the black soldier and to put an end, so far as in him lies, to the various, innumerable, incessant outrages upon the freedmen is in the continuance of his childish and cowardly desire to conciliate his native Kentucky and the Democratic party.

I argued that even President Lincoln is responsible in some degree for that public sentiment, which invites outrage upon the black man and leaves him a prey to the wicked. Those Members of Congress, who are opposing the reasonable measure of letting the black man vote in the Territories, are also guilty of favoring that public sentiment which broke out in the crime at Fort Pillow and Plymouth. Similarly guilty are those members who would make the pay of a black soldier less than that of a white one. And so are those members who consent to leave a fugitive slave statute in existence. In a word, all should tax their consciences with the sin of this public sentiment and with the resulting crime at Fort Pillow and Plymouth, whose influence, by either word or deed, has been to keep up in this heathen land the caste-spirit—that preeminent characteristic of heathenism. I call this a heathen land. To the Christ-Religion — that simple religion of equal rights and of doing as you would be done by — there can be no greater insult than to call a nation in which, as in this, the most cruel and murderous caste-spirit prevails, a Christian nation.

Both on the right hand and on the left, I hear that our nation is to be saved. But my fears that it will not, often become very strong. That the Rebellion is to be crushed, I deeply believe. Often in the course of Providence a wicked people, which is itself to be afterward destroyed, is previously to be used in destroying another and generally more wicked people. There are striking illustrations of this in the Bible. The duty of abolitionists and anti-abolitionists, Democrats and Republicans, to work unitedly, incessantly, and unconditionally for the overthrow of the Rebellion I have not only never doubted, but ever urged. I hold it to be unpatriotic and even traitorous for the Abolitionists to make any conditions in behalf of their specialty, and to propose, as some of them do, to go against the Rebellion only so far as going against it will be going against slavery. So too are those Democrats unpatriotic and even traitorous who can favor the War, only under the stipulation that it be so conducted as to harm neither the Democratic party nor the Constitution. To put down the Rebellion is an object immeasurably higher than to save a party or to save the Constitution, or even to save the country. No man is right-minded, who would not have it put down, even though it be at the expense of the last man and the last dollar.

If anything makes me doubt that the Rebellion will be crushed it is the omission of Congress to abolish slavery, now when it is so clearly seen that the abolition of slavery is an indispensable means to the abolition of the Rebellion. The proposed Amendment to the Constitution I take no interest in. One reason why I do not, is, that it is not a proposition to abolish slavery now. Another is, that war is not the time to be tinkering at constitutions. I see it denied that Congress has the power, even as a war measure, to abolish slavery. Amazing delusion! There is in every nation an absolute power for carrying on war. The nation that disclaims it may as well give up being a nation. In our own, this power is vested in Congress. Congress is to declare war: and Congress is “to make all laws necessary and proper (itself of course the sole judge of the necessity and propriety) for carrying into execution” the declaration. Is it the institution of apprenticeship, which it finds to be in the way of the successful prosecution of the war — then is it to sweep it out of the way. Is it the abomination of slavery? — then is it to strike at that.

There is, however, one thing more which sometimes, though not often, raises a doubt in me whether the Rebellion will be crushed. It is the premature agitation of the Presidential question. When the Rebellion broke out, I assumed that it would be put down in a few months — for I assumed that this greatest crime against nationality and humanity would arouse and unite the whole North. How greatly was I mistaken Very soon the Democratic party was seen to prefer itself to the country. The Republican party stood by the country. But at the present time there is no little danger that the country may be sacrificed in a strife between the members of the Republican party. For, taking advantage of this strife, the Democratic party may succeed in getting the reins of Government into the hands of one of its pro-slavery peacemakers. But I may be asked — will not the rebels be conquered and the country saved before the next Election? I still hope so — and until the last few months I believed so. But is there not some reason to fear that the North will be wrought up to a greater interest in this year's Presidential than in this year's military campaign In other words, is there not some reason to fear that, for the coming six months, politics instead of patriotism will be in the ascendant?

I still say, as through the past winter I have frequently said, written, and printed — that the Presidential question should not have been talked of, no, nor so much as thought of, until midsummer. The first of September is quite early enough to make the nomination; and in the mean time, undistracted by this so distracting subject, we should be working as one man for the one object of ending the Rebellion — and of ending it before reaching the perils of a presidential election. And such working would best educate us to make the best choice of a candidate. Moreover, it is the condition the country will be in three or four months hence, rather than the condition it is now in, that should be allowed to indicate the choice. Great and rapidly successive are the changes in the circumstances of a country in time of war. To nominate a President in time of peace, six months earlier than is necessary, all would admit to be great folly. But greater folly would it be to nominate him in time of war even a single month earlier than is necessary. The Baltimore Convention is understood to be a movement for renominating President Lincoln, and the Cleveland Convention one for nominating General Fremont. Would that both Conventions were dropped Would indeed that the whole subject were dropped until July or August! — and would too that it were dropped with the understanding, that it should then be taken up, not by the politicians, but by the people!

The people would present a loyal and an able candidate: and whether it were Lincoln or Fremont, Chase or Butler, Dickinson or Dix, the country would be safe.

I recall at this moment the large and respectable meeting for consultation held in Albany last January. What a pity that the meeting took fright at the temperate and timely resolutions reported to it! What a pity that the meeting saw in them danger to the country, or perhaps, more properly speaking, to a party! One of these resolutions and its advocates urged the importance of postponing until the latest possible day the whole subject of a Presidential nomination: and, had it been adopted and published, it would not unlikely have exerted sufficient influence to bring about such postponement. Time has proved the wisdom of the other resolutions also. I wish I could, without seeming egotism, say that slavery, and slavery alone, having brought this war upon us, they, who have given but little thought to slavery, should be too modest to toss aside indignantly and sneeringly the suggestions of those who have made it their life-long study. Were these resolutions now published, almost every man who opposed them, would wonder that he had so little foresight as to oppose them.

And there is still another thing which should perhaps be allowed to suggest a doubt whether the rebellion will be crushed. It is, that we are so reluctant to pay the cost of crushing it. Our brave soldiers and sailors give their lives to this end. But we who stay at home shrink from the money tax which is, and which should be far more largely put upon us. Our nation is imperiled by the incessant outflow of a big stream of gold. Wise and patriotic as he is, our Secretary of the Treasury will nevertheless labor in vain to diminish this stream unless importations shall be taxed far more heavily. Deeply disgraceful are these importations when it is by all that is precious in the very life of our nation that they are forbidden. Surely it is no time now to be indulging in foreign luxuries: and as to necessaries, our own country can furnish them all. Luxuries, whether foreign or domestic, should all come now with great cost to the consumer. And only a small return for protecting their estates from the rebels would it be for the rich to pay over to Government one fourth, and the very rich one half of their incomes. Let me add in this connection that the State Banks should be so patriotic, as to rejoice in the national advantage of an exclusively National currency.

I expressed my belief that the rebellion will be crushed — but my doubt whether the nation will be saved. A guilty nation, like a guilty individual, can be saved through repentance only. But where are the proofs that this nation has so much as begun to repent of the great sin, which has brought the great calamity upon her? She has, it is true, dome much to prove that she regards slavery as a political and economical evil, and a source of great peril to the nation: but she has done exceedingly little toward proving that she has a penitent sense of her sin in fastening the yoke of slavery on ten to twenty millions of this and former generations. It is only here and there — at wide intervals both of time and space — that has been heard the penitent exclamation, “We are verily guilty concerning our brother;” — only at these wide intervals that has been seen any relaxation of the national hatred and scorn for the black man. “Abolitionist,” which, when the nation shall be saved, will be the most popular name in it, is still the most odious and contemptible name in it. That the fugitive slave statute is still suffered to exist, is ample proof that this nation has still a devil's heart toward the black man. How sad that even now, when because of the sin of slaveholding, God is making blood flow like water in this land, there should be found members of Congress, who claim this infernal statute to be one of the rights of slaveholding! As if slaveholding had rights! As if any thing else than punishment were due to it! — punishment adequate to its unmingled, unutterable, and blasphemous wrongs!

I shall, however, be told that slavery will soon be abolished by an Amendment of the Constitution. And what will such an Amendment say? Why, nothing more than that slavery ought not to be — must not be — when it shall no longer be constitutional. What, however, the American people need to say, is, that be it constitutional or unconstitutional, slavery shall not be. So they are always prepared to say regarding murder. But slavery is worse than murder. Every right-minded man had far rather his child were murdered than enslaved. Why, then, do they not affirm that, in no event, will they tolerate slavery any more than murder? The one answer is — because it is the black man, and the black man only, on whom slavery falls. Were white Americans to be enslaved in a Barbary State, or anywhere else, our nation would respect no pleadings of statutes or even of constitutions for their enslavement. In defiance of whatever pleas or whatever restraints, she would release them if she could. The most stupendous hypocrisy of which America has been guilty, is first professing that there is law for slavery — law for that which all law proclaims an outlaw — law for that in which there is not one element of law, but every element of which is an outrage upon law; and second, in professing it, not because she has a particle of belief in it — but simply because blacks instead of whites are the victims of her slavery. America declared that John Brown was “rightly hung.” How hypocritical was the declaration, may be inferred from the fact that had they been white instead of black slaves whom he flung away his life to rescue, she would have honored him as perhaps man has never been honored. And she would have made his honors none the less, but heaped them up all the more, if, in prosecuting his heroic and merciful work, he had tossed aside statutes and broken through sacred constitutions. Oh! if this nation shall ever be truly saved, it will no longer regard John Brown as worthy of the fate of a felon; but it will build the whitest monuments to his memory, and cherish it as the memory. of the sublimest and most Christ-like man the nation has ever produced! Some of the judgments of John Brown — especially such as led him to Harper's Ferry — were unsound and visionary. Nevertheless, even when committing his mistakes, he stood, by force of the disinterestedness and greatness of his soul, above all his countrymen.

Would Congress contribute most effectively to put down the rebellion, and to save the nation by the great salvations of penitence and justice — the only real salvations? Would it do this? — then let it pass, solemnly and unanimously, a resolution that there never was and never can be, either inside or outside of statutes or constitutions, law for slavery; and then another resolution that whoever shall attempt to put the yoke of slavery on however humble a neck, black or white, deserves to be put to death.

A word further in regard to the proposed Amendment. Were the impudent and monstrous claim of its being law set up for murder, no one would propose an amendment of the Constitution forbidding murder. The only step in that case would be to make the penalty for the crime more sure and if possible more severe. Such an amendment would be strenuously objected to, in that it would stain the Constitution with the implication that murder had been constitutional. And now, if we shall have a Constitutional Amendment, which, in terms, forbids slavery, (it is already forbidden by the spirit, principles, and even provisions of the Constitution,) shall we not be virtually admitting to the world and to posterity that this nation had been guilty of tolerating, if not indeed of positively authorizing, in its Constitution the highest crime of earth o God save us from an admission, which shall serve both to stamp us with infamy and to perpetuate the infamy!
